GNC Creatine Settlement with MMUSA

This website was established to inform you of a proposed settlement of a lawsuit concerning the Muscle Marketing USA Creatine Serum (MMUSA Creatine Serum) and General Nutrition Corporation (GNC). The lawsuit, is currently pending in the Circuit Court Twentieth Judicial Circuit, St. Clair County, Illinois. Listed below is a summary of information related to the settlement.

This settlement was brought about due to the Plaintiffs allegations that the labeling, packaging and advertising of MMUSA Creatine Serum products was misleading and deceptive in that the MMUSA Creatine Serum did not contain the amount of creatine monohydrate represented in the labeling, packaging and advertising.

GNC denies each and all of the claims and contentions alleged by the Plaintiffs in the Circuit Court Action. Both parties recognize the risks and costs associated with further litigation and have agreed it desirable and beneficial that the action be settled in the manner outlined in the Notice.

A Settlement Fairness Hearing has been scheduled for November 6, 2006. At which time the Circuit Court will determine whether to approve the Settlement as fair, reasonable, and adequate. The Court will also decide at that time whether to approve Class Counsel’s award of attorneys’ fees and expenses.

To qualify for a payment or for a discount certificate from the Settlement, Class members must send in the completed Proof of Claim Form / Class Member Affidavit, along with appropriate documentation, such as receipts, to the Creatine Settlement Administrator postmarked by January 5, 2007.
