She should have thought about that before kicking 
She is absolutely wrong and deserved to be arrested for kicking the guy. But the cop escalated the situation by demanding she delete the photo. She's in public and has the right to take pictures of whatever she wants, even if it's classless or in poor taste. The officer's job is to enforce laws, not social etiquette.
