WASHINGTON — The Justice Department's civil rights division on Monday objected to a new photo ID requirement for voters in Texas because many Hispanic voters lack state-issued identification.

Texas is the second state in recent months to become embroiled in a court battle with the Justice Department over photo ID requirements for voters.

The Justice Department said Texas officials failed to show that the newly enacted law has neither a discriminatory purpose nor effect.

The department had been reviewing the law since last year and discussing the matter with state officials. In January, Texas officials sued U.S. Attorney General Eric Holder, seeking a court judgment that the state's recently enacted voter ID law was not discriminatory in purpose or effect.

In a letter to Texas officials that was also filed in the court case in Washington, the Justice Department said Hispanic voters in Texas are more than twice as likely than non-Hispanic voters to lack a driver's license or personal state-issued photo ID. The department said that even the lowest estimates showed about half of Hispanic registered voters lack such identification.

The range was so broad because the state provided two sets of registered voter data.

In December, the Justice Department rejected South Carolina's voter ID law on grounds it makes it harder for minorities to cast ballots. It was the first voter ID law to be rejected by the department in nearly 20 years.

In response, South Carolina sued Holder; the state argued that enforcement of its new law will not disenfranchise any voters.

The Justice Department is objecting to a new photo ID law in Texas for voters, saying the state has failed to demonstrate that the the law is not discriminatory by design against Hispanic voters.

The department's head of the civil rights division, Tom Perez, wrote a a six-page letter to Texas' director of elections saying that Texas has not "sustained its burden" under Section 5 of the Voting Rights Act to show that the new law will not have a discriminatory effect on minority voters. About 11 percent of Hispanic voters reportedly lack state-issued identification.

Perez wrote that while the state says the new photo ID requirement is to "ensure electoral integrity and deter ineligible voters from voting" the state "did not include evidence of significant in-person voter impersonation not already addressed by the state's existing laws."

Perez added that the number of people lacking any personal ID or driver's license issued by the state ranges from from 603,892 to 795,955, but of that span, 29-38 percent of them are Hispanic.

"According to the state's own data, a Hispanic registered voter is at least 46.5 percent, and potentially 120.0 percent, more likely than a non-Hispanic registered voter to lack this identification," Perez wrote.

Even using the data most favorable to the state, Hispanics disproportionately lack either a driver’s license or a personal identification card,” Thomas Perez, head of the Justice Department’s civil rights division, wrote in the letter to Keith Ingram, the director of elections for the Texas Secretary of State.

*The DOJ is blowing smoke..they’re only sampling driver license data or personal ID but here are the forms of acceptable ID’s to vote in Texas:

•a driver’s license or personal identification card issued to the person by the Department of Public Safety or a similar document issued to the person by an agency of another state, regardless of whether the license or card has expired;

•a form of identification containing the person’s photograph that establishes the person’s identity;

•a birth certificate or other document confirming birth that is admissible in a court of law and establishes the person’s identity;

•United States citizenship papers issued to the person;

•a United States passport issued to the person;

•official mail addressed to the person by name from a governmental entity;

•a copy of a current utility bill, bank statement, government check, paycheck, or other government document that shows the name and address of the voter; or

•any other form of identification prescribed by the Secretary of State.

The White House comes to Texas for Hispanic summit in San Antonio

More than 400 community leaders, each carrying their own laundry list of concerns and criticisms about government, came to the White House’s Hispanic Community Action Summit at San Antonio’s Fox Tech High School to unload.

Some vented about immigration. Some offered solutions for creating new cadres of Hispanic college graduates. Others presented a myriad of problems begging for Washington’s attention.

The daylong public event Friday resulted in a sprawling series of discussions that one official said was the White House’s attempt to address public policy changes from the “bottom up.”

It was the 15th regional gathering by the White House since last summer. Summits have been held in 10 states. More are planned in Los Angeles, Milwaukee and Durham, N.C.

San Antonio’s drew 28 administration officials from the White House and from agencies and departments representing education, labor, immigration, environmental protection, small business, housing and human services.

While some participants wondered how much the summit was a result of election-year politics and an attempt by the Obama administration to appeal to Latino voters, others were eager to get the ear of an official not only to express their concerns but to ask for solutions.

(Reuters) - The Obama administration on Monday blocked a new Texas law requiring voters to show photo identification before they can cast a ballot out of concerns it could harm some Hispanic voters who lack such identification.

The state law approved in May 2011 required voters to show government-issued photo identification, which could include a driver's license, a military identification card, a birth certificate with a photo, a current U.S. passport, or a concealed handgun permit.

The Justice Department said that data from Texas showed that almost 11 percent of Hispanic voters, just over 300,000, did not have a driver's license or state issued identification card, and that plans to mitigate those concerns were incomplete.

After news came down today that the Obama administration had successfully blocked a Texas voter ID law from going into effect Greg Abbott, the Texas Attorney General, took to twitter to announce he was suing Eric Holder and the Department of Justice. The Texas Attorney General also released this statement on his website today:

“The Justice Department’s decision to deny preclearance to Texas’ Voter ID law is no surprise given the Obama Administration’s denial of a similar law in South Carolina. In anticipation of this decision, the Texas Attorney General’s office already filed legal action in January seeking judicial preclearance with the court system. The U.S. Supreme Court has already held that Voter ID requirements are constitutional and nondiscriminatory, and several other states–including Georgia, Indiana, Kansas and Wisconsin–are allowed to require photo identification to vote. Texas should not be treated differently and must have the same authority as other states to protect the integrity of our elections.”

Only 22% are opposed to the photo ID requirement.

Woodwick Street was quiet -- with a few residents working in their yards and adding to post-storm brush piles at the curb -- when Texas Watchdog visited on a recent Saturday to try to find Harris County voter Linda K. Hill.

"I'm sorry, but she passed on two years ago," said a mustached man wearing a Dallas Cowboys baseball cap and driving a motorized chair down the street. He was Linda Hill's husband, Henderson Hill Jr.

Linda Kay Hill, a homemaker and Louisiana native, died Aug. 2, 2006, of a heart attack, her husband recalled, and is buried at Houston Memorial Gardens in Pearland. But Harris County voter records indicate she –- or someone using her identity –- cast a ballot in the November election that year. Linda Hill of Woodwick Street voted in person on Election Day, records show.

She is among the more than 4,000 people whose names are listed both on Harris County's voter rolls and also in a federal database of death records, a Texas Watchdog analysis has found.
