Your premise reminds me of a story in the news a few years ago about a man who ended up suing his physician. He was diagnosed with a fatal illness and was told he had less than 18 months to live. Realizing how short his time was, he began to live high on the hog, indulging in luxories, cashing out his retirement, travelling the world, and doing all the things he ever wanted to do. As the 18 months drew to a close he was informed that the laboratory had made a mistake and he was not fatally ill after all. Turns out he was just fine. He sued the doctor and lab to recover his financial losses!
My memory is that the court ruled against him. The lab and doctor were not held liable for him cashing out his retirement and blowing the money on what he thought was a last hurrah! 
In my humble opinion, I think the scenario is more complex. Maybe he would never have travelled the world if not for the "diagnosis".
