This reminds me of an old friend who was a regular on EliteFitness back in the day. He came up with a pretty good energy/mood supp that he marketed as Adderllin. Which is really really close to Adderall, right? Well not only that, but he also had it bottled, packaged, and marketed using the same colors that Adderall was known for.
He never compared it to Adderall.
He never mentioned Adderall or insinuated anything about other ADHD meds.
He never promoted it as anything other than an energy and mood enhancement product with potential weight loss benefit.
He got away with it for about a year and half. Even coming up with an Adderllin XR version - just like the Adderall XR (Actually it was quite a decent product), then he went mainstream and was placing ads in Good Housekeeping, RedBook, etc.. targeting the soccer mom crowd. About 3 months later he got slapped with a lawsuit by the legit pharm maker of Adderall. When he got the cease and desist, he simply shrugged and had the colors on his packaging and bottles changed. Didn't do anything about the name itself. About four months later got hit with a lawsuit over it. He pointed out it was a coincedence that his product and the original adderall had similar colors and he changed that when they contacted him prior. He dodged a fine over that but the judge ordered him to change the name. He did some kind of modification of it (can't remember what). By the time the lawsuit and judge ruling had commenced he had already clocked up millions in sales. He just shrugged and sold the company. The new owner couldn't capture the past success he had and just sort of fizzled out.
