Keep Getting Packages From UPS
« on: June 08, 2015, 01:56:32 PM »
So, wifey just texted saying we got another package from UPS that was labeled with our address but the name of someone we do not know. This is the 5th package in the span of about 3 weeks. Each of the packages had a different name, with our address. This is obviously a scam, but I, my wife and my doorman have no idea what it is.

Time to bring in law enforcement? Finders keepers? What say you, getbig?

Find a radiology department with an uggo behind the desk.
Flirt with her while wife sneaks an x-ray of package.
If package is good repeat until you get something undesirable.
You may have to ultimately throw yourself on that grenade, but risk could outweigh reward.

Honestly, since the packages were addressed to our apartment, I'm not sure we'd be doing anything illegal opening them. I"m not a lawyer, but that sounds like a perfectly cromulent legal position to me.

My wife ended up calling the cops asking if this sounded like a scam they were familiar with and it turns out it is.  :-\

It is not addressed to YOU, therefore it is not yours.  Return to sender, UNOPENED (wrong addressee).  IF it had your name on it, that would be a "finders keepers" situation.

If it had either of our name on it, how would it be a finder's keepers situation? They'd be our packages.

If it had your name on it, then it's yours to do with what you wish ~ keep it, toss it, whatever.  Since it doesn't have your name, it's not legally yours.

Unsolicited goods are those goods which are sent to someone without being asked those goods to be sent. Sending unsolicited goods in itself is not an offence. However, demanding payment for unsolicited goods is a criminal offence. Consumers can retain unsolicited goods or dispose them as they wish. They are under no obligation to keep them safe or to return them.

When unsolicited goods or services are provided to a person, the person has a right to accept the goods or services as a gift, and is not bound to return the goods or services. Goods or services are not considered to have been solicited unless the recipient specifically requested. Demanding payment for unsolicited goods constitutes an unfair or deceptive act or practice in trade or commerce for the purposes of applying Consumer Protection Act.

How exactly is that a scam?? They scam you into getting free shit??  Makes no sense - unless there is something you left out.

This post says nothing about whether or not it would be legal to open the packages. if you were to read it strictly, it actually makes the argument that it's ok to keep the packages.

We live in a doorman building, but typically people use forged or stolen credit cards and have items delivered to non-doorman buildings during the day. The addresses are usually random. From what the cop described, UPS or Fed Ex leaves the item outside of an apartment door and then someone retrieves the package before the apartment owner has a chance to see it. Everything coming to us was probably ordered at the same time.

My Animal hoodies usually come on the weekends, though.  And the box is too big for my Beats by Dre headphones. I don't order them  by the 4-pack anymore.

It is ok to keep the packages, IF they are addressed to YOU.  Then it is a case of unsolicited goods.  This is not the case because they are not addressed to you.

UPS has a tracking number on the package.  Easy enough to use the UPS website.

Ok I get it... BUT - had you taken the packages there is no chance of loss on YOUR part - correct??  Seems risky as hell for those that do the "scamming".. Except I guess they weren't actually paying for it anyway...  Did you find out what the packages were??

LOL!!!

Not sure what I would do. I don't even open the mail that arrives for the bums who used to live in this place. Hard not to open it one would think. Pay a bum $20 to open them and keep your distance but not so much that if stuff of value were in it, the bum could run away and lose you guys.

But I got a "package" for you as well...

UPS left a package on my door once.
I called them and told them to pick it up.
They did.

That was pretty much the end of things, as far as I was concerned.  I had some eggs with ketchup, and didn't think about it until I read this thread.  Great memories.

The credit cards are usually either forged or stolen, so there's not much risk on their part.
Have no idea what's been in the packages, but likely electronics or mid-value consumer goods.

If you want to take a moral stand, that's fine. I'd actually agree with you. Legally, I don't think the answer is the same. I'm not under any legal obligation to  return the packages.
