Is the 44 second rule only during peak hours?

Sometimes I can post back to back without issues.  In the last 5 minutes I have gotten the 44 second rule a few times.  Is it based on how many members are posting or just during certain times of day?

haha, thought I was given "a pass" on this rule due to my ever so important contributions/posts. To then find out that shit rule still exists. Have pondered making a thread on it as well...

44 seconds for post, 44 hours for thread making should be the rules and instead of ban people should be able to get on and read but not to post for 44 days.
