Breitbart has uncovered then Senator Obama claiming while discussing that the Military Commissions Act of 2006 that 9-11 mastermind KSM will get a MILITARY trial, not a CIVIL trial and that such was good enough and KSM would get his opportunity to defend himself.

What's the problem with putting someone on trial? War criminals are on trial all the time - Pol Pot, Hess, Eichmann to name a few.

Hedge the issue is a civilian trial vs a military tribunal.  The two are grossly different.  On this video, Obama is advocating a military tribunal for KSM.

This whole thing is a bad idea.  Convictions are far from a certainty, and these guys are going to have tons of savvy attorneys representing them just so that they can make a big name for themselves.  A lot of evidence won't be admissible and even more will never be presented in order to protect our intelligence gathering methodology.

At this point, I just hope that the judges adjudicating these cases aren't too interested in helping these people when making their decisions on motions, etc.
