Will the Justice Department be held to account for arming lethal Mexican cartels?

Rumors began to fly over a week ago that a .50 BMG weapon supplied to Mexican drug cartels by the U.S. Justice Department’s Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) was used to bring down a Mexican military helicopter in May. According to CBS News, the use of that weapon can be confirmed, and it turns out the helicopter was one of two fired upon by suspected cartel members.

The raid on the cartel that the helicopters were supporting was successful, netting more than 70 weapons, including the helicopter-down .50 BMG rifle and other weapons traced back to the botched ATF Operation Fast and Furious, also know as “Gunwalker.”

To date, the ATF operation, which encouraged gun shops in the American southwest to sell weapons to suspected criminals and let them carry the weapons across the border, has resulted in an estimated 150 Mexican law enforcement officers and soldiers shot with ATF-supplied weapons. While the theory behind the plot was different, the end result is no more deplorable than Iran’s arming of Iraqi terrorists.


At least two American law enforcement officers have been murdered with ATF weapons as well. Border Patrol Agent Brian Terry was killed with “Gunwalker” firearms in Arizona, while ICE Special Agent Jaime Zapata was killed in an ambush in Mexico with a gun the ATF allowed to be sold to a cartel gun smuggler in Dallas.

The damning evidence that the U.S. Department of Justice agency is a major supplier of cartel weapons will go in front of a House Oversight and Government Reform Committee this week, in what could be a damning indictment of the ATF’s senior leadership and Eric Holder’s leadership of the Department of Justice.

Attorney General Holder has apparently ordered the DOJ to fight Congressional oversight, with the DOJ and ATF ignoring seven letters and a subpoena from the committee. Neither Holder nor ATF Director Ken Melson will answer questions — which may lead to them being held in contempt of Congress.


Holder and Melson have little reason to tell the truth about what happened with Operation Fast and Furious, which may be the most incompetent ATF operation since the agency’s ill-advised 1993 raid of the Branch Davidian compound left four agents dead and 16 wounded. (After the raid failed, the Justice Department then had the FBI take over a siege which ended in the deaths of 74 men, women, and children.) In responding to the subpoena and the letters directed to the agencies by Congress, they may reveal not just glaring incompetence, but perhaps open a door to political motives for the gun-running that point higher in the Obama administration.

President Barack Obama has long pushed the 90 percent lie, a bit of fiction in which he claims that 90 percent of cartel weapons in Mexico originate in U.S. gun shops along the border.

The fact of the matter is that of the 100,000 weapons that had been recovered by Mexican authorities at that time, only 18,000 were determined to have been manufactured, sold, or imported from the United States, and of those 18,000, just 7,900 came from sales by licensed gun dealers. He was only fabricating the truth by 81 percent.

Now that we know that the ATF directed U.S. gun dealers to allow more than 2000 — and as maybe as many as 2,500 — of those 7,900 guns, it now seems that something approaching a third of the guns sold by dealers to the cartels were conveyed at the order of Barack Obama’s Justice Department. Not only was the president lying about the percentage of guns coming from the U.S. in order to drum up support for gun control measures, his executive branch agencies were responsible for padding the numbers almost another 50 percent.

In addition to the civilian guns, the U.S. government is indirectly responsible for many of the cartels’ heavy weapons as well, though there is no indication that the Justice Department or ATF had any hand in what appears to be greed, graft, corruption, and theft south of the border.


So what do we have before us?

We have a rogue federal agency in the ATF that has been rudderless, without a permanent director since 2006, and with little hope of getting one anytime soon. (The president chose to nominate Andrew Traver for the post; he was immediately blocked by Republicans because of his anti-gun views and association with the Joyce Foundation.) We have a Justice Department that intends to deeply encroach upon individual liberties, emulating by deed, if not name, the same sort of lawless power King George gave to the redcoats. And we have a president that promised the most “unprecedented level of openness” in government, who has the power and responsibility to order the ATF and DOJ to respond to Congressional requests for information and subpoenas, and who refuses to do so.

Our executive branch has armed narco-terrorists as violent as any of the jihadis we’ve faced in Iraq or Afghanistan, and they owe it to the nation to explain both how and why.

'Gunwalker' subpoena dispute escalates

WASHINGTON - Today, the House Oversight Committee held a hearing to explore whether Congress has the right to hold the Justice Department in contempt in the so-called ATF "gunwalker" investigation.


Experts indicated the Justice Department should probably be more forthcoming when responding to the document requests from Congress. They said Congress has the right to resort to contempt proceedings, but that the document tug-of-war between the co-equal branches of government is not unusual.

In this case, it's getting heated. Chairman of the House Oversight Committee, Rep. Darrell Issa, R-CA, has said more subpoenas are forthcoming. He accuses the Justice Department of withholding documents after a subpoena he issued to the Bureau of Alcohol, Tobacco and Firearms (ATF); which is under the Justice Department's jurisdiction.

Issa subpoenas ATF over gunwalking allegations

Morton Rosenberg, a specialist in American public law, formerly with the Congressional Research Service, told Congress, "the Department of Justice has the power to string out your investigation, refuse to obey it, and then when it's time for contempt...say all you can do is bring a civil action which will extend and delay your constitutional ability to enforce your" legislative powers.

Democrats on the Oversight Committee defended the Justice Department saying it has provided some documents to Congress. "The Department in fact had produced to the committee or made available to the committee staff for review approximately 1,336 pages of subpoenaed documents to date," said Rep. Elijah Cummings, D-MD. Cummings added that turning over more could jeopardize the ongoing investigation into potential crimes at issue in the gunwalker case. Chairman Issa argued that all of the documents turned over were already publicly available on the Internet, or too highly redacted to be of use in the investigation.

ATF Agent: I was ordered to let guns go into Mexico

In the gunwalker case, ATF agents say they were ordered to allow thousands of weapons to be sold to suspected suppliers for Mexico's drug cartels. The idea of letting so many guns "walk" onto the street was apparently to see where they would turn up and go after the major cartel kingpins instead of the smalltime weapons traffickers.

Today's hearing was a precursor to Wednesday's gunwalker hearing, which will feature the family of murdered border patrol agent Brian Terry and a Justice Department official. Members of Congress will also hear from three ATF agents, including whistleblower John Dodson who first spoke to CBS News in March.

I’ve been keeping you abreast of all the Obama administration’s Project Gunrunner stonewalling since March (links/chronology below). Today, vigilant GOP House Oversight and Reform Committee chairman Darrell Issa is holding another hearing to pressure Team Obama for the whole truth. Moments ago in his opening statement at today’s hearing, Operation Fast and Furious: Reckless Decisions, Tragic Outcomes, Oversight and Government Reform Committee Chairman Darrell Issa (R-CA) released three e-mails detailing the intimate involvement of ATF Acting Director Kenneth Melson and Acting Deputy Director Bill Hoover in Operation Fast and Furious:

* The first e-mail from March 10, 2010, to Operation Fast and Furious Group VII Leader David Voth indicates that the two most senior leaders in ATF, Acting Director Kenneth Melson, and Deputy Director Billy Hoover, were “being briefed weekly on” Operation Fast and Furious. The document shows that both Melson and Hoover were “keenly interested in case updates.” * A second e-mail from March 12, 2010, shows that Deputy Assistant Director for Field Operations William McMahon was so excited about Fast and Furious that he received a special briefing on the program in Phoenix – scheduled for a mere 45 minutes after his plane landed.

The chairman of the House Oversight and Government Reform Committee released copies of redacted emails on Wednesday that detail the involvement of the head of the ATF in a controversial gun-tracking program as early as March of 2010.

The emails strike a stark contrast to letters the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) have sent to lawmakers in which they denied selling assault weapons to known and suspected straw purchasers for drug cartels and claimed that they made every effort to prevent weapons from going to Mexico.

In one of the emails, released by Rep. Darrell Issa (R-Calif.), with the subject heading, “Director’s questions,” the supervisor of the “Fast and Furious” operation wrote to the assistant special agent in charge of Phoenix field operations with an Internet Protocol address for one of the video monitoring units in a gun store which was authorized to sell guns to the suspects.

The emails seem to indicate that ATF acting-director Kenneth Melson had asked for this information.

“With this information, acting Director Melson was able to sit at his desk in Washington and – himself – watch a live feed of the straw buyers entering the gun stores to purchase dozens of AK-47 variants,” said a Republican committee statement.

Earlier this year, in response to a letter from Sen. Chuck Grassley (R-Iowa) to Melson asking him about his knowledge of the gun-tracking operation, the Justice Department wrote the senator and denied knowingly selling assault weapons to straw purchasers and stated that it made every effort to prevent weapons from going to Mexico.

In another email on March 10, 2010, the assistant special agent in charge of Phoenix field operations wrote to the supervisor of the “Fast and Furious” operation and said, “Not sure if you know, but Mr. Melson and Mr. Hoover are being briefed weekly on this investigation and the recent success with [redacted] so they are both keenly interested in case updates.”

The release of the emails come as Issa was holding a hearing on the gun-tracking program with ATF agents.

Agents say DOJ still being untruthful about efforts to let guns 'walk' into hands of drug cartels

WASHINGTON, D.C. – Oversight and Government Reform Committee Chairman Darrell Issa (R-CA) and Senate Judiciary Committee Ranking Member Senator Chuck Grassley (R-IA) today released a report, "The Department of Justice's Operation Fast and Furious: Accounts of ATF Agents."  The report includes testimony from four Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) agents offering firsthand accounts about the controversial Operation Fast and Furious that allowed suspects to walk away with illegally purchased guns.  Two of the approximately 2,000 guns that ATF let criminals walk away with were found at the murder scene of U.S. Border Patrol Agent Brian Terry in December 2010.


"ATF agents have shared chilling accounts of being ordered to stand down as criminals in Arizona walked away with guns headed for Mexican drug cartels," said Rep. Issa.  "With the clinical precision of a lab experiment, the Justice Department kept records of weapons they let walk and the crime scenes where they next appeared.  To agents' shock, preventing loss of life was not the primary concern."


"These agents have risked their lives working for the ATF and they've risked their careers by coming forward to speak the truth about a dangerous strategy that was doomed from the start," Sen. Grassley said.  "The report shows the street agents' perspective on this risky policy to let guns walk.  It should help people who are wondering what really happened during Operation Fast and Furious understand why we are continuing to investigate."


Highlights of the report include:





The supervisor of Operation Fast and Furious was "jovial, if not, not giddy but just delighted about" walked guns showing up at crime scenes in Mexico according to an ATF agent. (p. 37)
Another ATF agent told the committee about a prediction he made a year ago that "someone was going to die" and that the gunwalking operation would be the subject of a Congressional investigation. (p. 24)
The shooting of Congresswoman Gabrielle Giffords created a "state of panic" within the group conducting the operation as they initially feared a "walked" gun might have been used. (p. 38)
One  Operation Fast and Furious Agent:  "I cannot see anyone who has one iota of concern for human life being okay with this ..."  (p. 27)

An ATF agent predicted to committee investigators that more deaths will occur as a result of Operation Fast and Furious. (p.39)
Multiple agents told the committee that continued assertions by Department of Justice Officials that guns were not knowingly "walked" and that DOJ tried to stop their transport to Mexico are clearly untruthful.  (p. 45-50)

Federal gun agents, concerned about weapons sales to Mexican drug suspects, begged to make arrests but were rebuffed, according to a congressional report on a controversial investigation.

Federal gun agents in Arizona -- convinced that "someone was going to die" when their agency allowed weapons sales to suspected Mexican drug traffickers -- made anguished pleas to be permitted to make arrests but were rebuffed, according to a new congressional report on the controversial law enforcement probe.

Agents from the federal Bureau of Alcohol, Tobacco, Firearms and Explosives told congressional investigators that there was "a state of panic" that the guns used in the shooting of U.S. Rep. Gabrielle Giffords in Tucson in January and two U.S. agents in Mexico a month later might have been sold under the U.S. surveillance operation.

"I used the word anxiety. The term I used amongst my peers is pucker factor," Larry Alt, special agent with ATF's Phoenix field division, told investigators preparing a joint staff report for Rep. Darrell Issa (R-Vista), chairman of the House Committee on Oversight and Government Reform, and Sen. Charles E. Grassley (R-Iowa), ranking member of the Senate Judiciary Committee. The report will be released Wednesday in Washington, D.C.

Neither of those shootings was ultimately linked to the "Fast and Furious" probe, though two weapons sold to a suspect under surveillance were found at the scene of the fatal shooting of Border Patrol Agent Brian Terry near Nogales, Ariz., in December.

Terry's family will be among the key witnesses at an oversight committee hearing Wednesday on the ATF operation, under which the bureau allowed purchases of high-powered weapons in an attempt to track their progress into the hands of Mexican drug cartels. WASHINGTON — In a report issued Tuesday by two powerful Republicans in Congress, the Justice Department was accused of conducting an operation that allowed nearly 1,000 guns to flow illegally into Mexico, including two that were eventually found at the scene of the murder of an American Border Patrol agent.

The report, by Senator Charles E. Grassley of Iowa and Representative Darrell Issa of California, said the 2009 operation in Arizona by the Bureau of Alcohol, Tobacco, Firearms and Explosives, called Fast and Furious, was intended to shift the focus of enforcement efforts toward criminal organizations south of the border and away from straw purchasers who knowingly buy guns for others.

The legislators criticized the effort as using what they described as a “reckless investigative technique that street agents call ‘gun-walking.’ ” The technique involved long periods of surveillance in which agents watched loads of legally bought weapons move from straw purchasers to third parties, hoping that the transactions would lead them to bigger criminal targets.

Instead, the legislators said, guns were routinely lost, and fewer than two dozen people were ultimately arrested — all of them accused of being straw purchasers. The legislators say A.T.F. agents were routinely ordered to stand down rather than interdict guns from people they suspected of trafficking weapons.

Some of those agents blew the whistle to Congress this year after two such guns were found at the scene of the murder of the Border Patrol agent, Brian A. Terry. An official with knowledge of the investigation said that neither the bullet that killed Mr. Terry in December nor the casings found at the scene had been linked to the weapons that were recovered there.

The official emphasized that “the murder weapon has not been discovered.”...

Damning new evidence from Capitol Hill shows that ATF Directors and Justice Department Officials knew about and encouraged the purposeful trafficking of thousands of weapons across the southern border, despite strong objections from ATF agents. Thousands of innocent lives were taken as the result, including those of Border Patrol Agent Brian Terry and ICE Agent Jamie Zapata.

New emails released by House Oversight Chairman Darrell Issa show that ATF Director Kenneth Melson was briefed weekly about Operation Fast and Furious and watched a live feed of straw purchasers (who serve as middle men, purchasing guns and giving them to cartel members) in Arizona gun shops from his cozy Washington D.C. office. Emails also show that Deputy Assistant Director for Field Operations William McMahon was enthusiastic about the operation.

“An e-mail from April 12, 2010, indicates that Acting Director Melson was very much in the weeds with Operation Fast and Furious. After a detailed briefing of the program by the ATF Phoenix Field Division, Acting Director Melson had a plethora of follow-up questions that required additional research to answer. As the document indicates, Mr. Melson was interested in the IP Address for hidden cameras located inside cooperating gun shops. With this information, Acting Director Melson was able to sit at his desk in Washington and – himself – watch a live feed of the straw buyers entering the gun stores to purchase dozens of AK-47 variants,” Chairman Issa said in his opening statement.


Senator Charles Grassley, who has been working closely with Rep. Issa, pointed out that officials from the Justice Department have been stonewalling the investigation for months. Attorney General Eric Holder has said he is unaware of who ordered the operation.


“On October 26, 2009, emails indicate that there was a meeting of senior law enforcement officials at the Justice Department. It appears to have included the heads every law enforcement component of the Department, including directors of the FBI, the DEA and the ATF. It also included the U.S. Attorneys for all the Southwest border states, the Director of the Organized Crime Drug Enforcement Task Force and the Chair of the Attorney General’s Advisory Committee,” Grassley testified.


Emails also show that ATF encouraged gun dealers to sell to straw buyers, in spite of their own hesitance to do so.


"ATF encouraged gun dealers to sell to straw buyers. Emails prove that at least one dealer worried prophetically about the risk. He [a dealer] wrote to ATF about his concern that a border patrol agent might end up facing the wrong end of one of these guns. ATF supervisors told the dealer not to worry. So, the agents said it was a bad idea. And, the gun dealers said it was a bad idea, but ATF supervisors continued anyway", Grassley said.


Border Patrol Agent Brian Terry was that agent. He was killed by cartel member 18 miles north of the U.S.-Mexico border near Rio Rico, Ariz. Agent Terry was a fighter-a former Marine who was willing to put everything he had, including his life, on the line for his country. He was dedicated to his job, his family and the United States.


“It was just ten days before Christmas last year, when our family received the devastating news; Brian had been shot and killed while engaged in a firefight with a group of individuals seeking to do harm to Americans citizens and others,” said Robert Heyer, the cousin of Terry, testifying on behalf of the entire Terry family. “Brian did ultimately come home that Christmas; we buried him not far from the house that he was raised in just prior to Christmas day. The gifts that Brian had picked out with such thought and care began to arrive in the mail that same week. With each delivery, we felt the indescribable pain of Brian’s death, but at the same time also remembered his amazing love and spirit.”


ICE Agent Jamie Zapata was killed in Mexico in February 2011 while on assignment. He was killed by a gun traced back to Operation Fast and Furious, however, Zapata’s family will never see justice. Once guns flow back into Mexico, they are no longer within the jurisdiction of the United States, leaving the government without any authority to prosecute anyone for any crime.


Three Special ATF Agents gave additional incriminating testimony. ATF Agent Dodson, one of the first whistleblowers to come out publicly against Operation Fast and Furious, provided details about the failed operation.


“I was involved in this operation, we monitored as they purchased hand guns, AK-47 variants, and .50 caliber rifles almost daily. Rather than contradict any enforcement actions, we took notes, we recorded observations, we tracked movements of these individuals for a short time after their purchases, but nothing more. Knowing all the while, just days after these purchases, the guns that we saw these individuals buy would begin turning up at crime scenes in the United States and Mexico, we still did nothing,” Dodson said. “Allowing loads of weapons that we knew to be destined for criminals, this was the plan. It was so mandated.”


And there still isn’t an explanation as to why.


“Allowing firearms to be trafficked to criminals is a dangerous and deadly strategy. The thought that the techniques used in the “Fast and Furious” investigation would result in “taking down a cartel” given the toothless nature of the “straw purchasing law” and the lack of a “firearms trafficking statute” is, in my opinion, delusional,” Special Agent Peter Forcelli said. “This operation, which in my opinion endangered the American public, was orchestrated in conjunction with Assistant U.S. Attorney Emory Hurley. [Emory Hurley is the same Assistant U.S. Attorney who previously prevented agents from using some of the common and accepted law enforcement techniques that are employed elsewhere in the United States to investigate and prosecute gun crimes.] I have read documents that indicate that his boss, U.S. Attorney Dennis Burke, also agreed with the direction of the case.”


There is no way to prosecute drug cartels in Mexico even if firearms trafficking had been successful in locating them. They are not within United States jurisdiction.


“I can’t think of a single, logical strategy as to why this would have worked,” Forcelli said. “This was a catastrophic disaster.”


According to testimony, it has become common practice for retaliation to occur against ATF Agents who spoke out against their supervisor's corruption, even when operations had no logical backing.


Forcelli also added that while the ATF was ordering gun dealers to sell to straw buyers under surveillance, gun dealers were taking the heat for it, and being held responsible for violence in Mexico. He stressed gun dealers were not the problem. In fact gun dealers were helpful in pursuing cases against cartel members, making it blatantly clear law abiding gun owners are not at fault, but the government is.


Issa said he will continue to investigate in order to find the truth and get to the bottom of the operatation. The government owes the truth to the American people and to the family of Brian Terry and Jamie Zapata, he explained. “There has now become a focus on getting the truth out.”

TUCSON, Ariz. - Federal agents were worried that the gun used to shoot Rep. Gabrielle Giffords (D-Ariz.) in the head could have been part of the controversial “Fast and Furious” gun-tracking operation. They learned eventually that it had not, sources said.

The “Fast and Furious” operation was a program run by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) that authorized and monitored the sale of weapons to known and suspected straw purchasers for Mexican drug cartels with the stated goal of exposing and dismantling gun trafficking routes.

House Oversight and Government Reform Committee Chairman Darrell Issa (R-Calif.) held a hearing on the mired program on Wednesday, during which ATF agents testified that they had been ordered to let guns “walk” into the hands of suspected and known criminals with little hope of ever seeing them again or being able to successfully track them to their final owners.

WASHINGTON — Knowledge of Operation Fast and Furious, a controversial border security strategy that allowed guns to be shipped illegally into Mexico in an effort to track them to drug cartels, went to the top of the Bureau of Alcohol, Tobacco and Firearms, according to evidence released on Wednesday at a House Oversight Committee hearing.

Witnesses at the House hearing included three relatives of a Border Patrol agent killed in Arizona and three A.T.F. agents, right.

The operation, which began in 2009, came under fire after two guns linked to it were found at the scene of the killing of an American Border Patrol agent, Brian A. Terry, in Arizona in 2010. Members of Mr. Terry’s family testified at the hearing.

The acting director of A.T.F., Kenneth E. Melson, and his acting deputy, William J. Hoover, were “keenly interested” in the operation and received weekly updates on its progress, according to internal e-mails released for the first time by the Oversight Committee’s chairman, Darrell Issa, Republican of California.

At the hearing, Republicans pressed a Justice Department witness as to who else in Washington authorized the operation or was aware of it.

The witness, Assistant Attorney General Ronald Weich, said releasing some of the documents that the committee sought would jeopardize continuing prosecutions.

At one point, Mr. Issa held up an entirely redacted page from evidence submitted by the department and chided Mr. Weich for the department’s response to a subpoena.

“How dare you make an opening statement of cooperation!” Mr. Issa shouted at Mr. Weich. “You’ve given us black paper.”
