US attorney investigating Weiner sexting allegations

Washington (CNN) Prosecutors in the office of US Attorney Preet Bharara have issued a subpoena for Anthony Weiner's cell phone and other records, according to law enforcement officials.

The FBI and the New York Police Department have opened preliminary investigations of allegations that the former New York Democratic congressman exchanged sexually explicit text messages with a purportedly underage girl.

Spokespersons for the US Attorney's Office in Manhattan and the FBI declined to comment.

The online sexting relationship allegedly went on for months between Weiner and a girl claiming to be just 15. The Daily Mail reported she said he sent her numerous photos, one of him in a pool and at least one bare-chested.

The outlet reported that the girl said she reached out to Weiner in January on Twitter.

In a statement to CNN, Weiner neither confirmed or denied sending the texts.

"I have repeatedly demonstrated terrible judgment about the people I have communicated with online and the things I have sent. I am filled with regret and heartbroken for those I have hurt," he said.

Weiner continued: "While I have provided the Daily Mail with information showing that I have likely been the subject of a hoax, I have no one to blame but me for putting myself in this position. I am sorry."

CNN has not been able to confirm this was a hoax.

In a statement, a spokeswoman for Republican presidential nominee Donald Trump noted that Weiner donated $550 to Hillary Clinton's presidential campaign last year.

"The announcement by the FBI and New York Police Department that they are investigating close Clinton ally Anthony Weiner's inappropriate relationship with an underaged female is extremely disturbing," Jessica Ditto said. "The Clinton campaign should immediately return all campaign contributions from Weiner. America has had enough of the sleaze that is Clinton, Inc."

Huma Abedin, one of Clinton's closest aides, announced last month that she was separating from Weiner after photos emerged of him allegedly sexting with another woman while their son was in bed with him. That woman was described in the New York Post as a 40-something divorced woman from the West.

Weiner left Congress in June 2011 when sexually-charged, sometimes explicit, texts with women other than his wife first emerged. His social media habits continued after leaving Congress and contributed to his poor showing in the 2013 New York City mayoral race, a contest in which he had once been a leading contender

The father of the teen at the center of Anthony Weiner’s latest sexting scandal isn’t pressing charges, according to a family source, but that may not be enough to keep local and federal authorities off the disgraced former congressman’s case, legal experts told FoxNews.com.

The fallen former New York Democrat politician is being investigated by the FBI and the NYPD over allegations that he exchanged sexually charged messages with a high school student who was 15 at the time. Neither the girl, whose identity in known to FoxNews.com, nor her father intend to file a complaint, the sourced told FoxNews.com.

“The FBI can absolutely pursue charges against Weiner regardless of the wishes of the minor’s father,” said Benjamin Cheeks, a former Manhattan assistant district attorney and assistant U.S. attorney now in private practice.

The FBI, which is the investigative arm for the U.S. Department of Justice, is reportedly probing the case. In addition, an NYPD source told FoxNews.com that “detectives are looking into the incident.”

Cheeks was careful to note that revelations that have been reported so far may not amount to a crime, but said Weiner's alleged actions "are so viscerally repulsive" that it could lead to new legislation criminalizing his behavior in the future.

In an interview with the Daily Mail, the minor detailed lurid alleged exchanges with Weiner, including claims Weiner indulged in "rape fantasies" and asked "strange questions.”

It was not the first time Weiner had been accused of extramarital dalliances via text.

In 2011, he resigned from Congress after he admitted to sending sexual messages to a 21-year-old Seattle woman. Two years later, he was caught up in another sexting scandal with a Princeton, Ind., woman named Sydney Leathers. That scandal derailed his bid for New York mayor, and was followed by another online tryst earlier this year with a 40-something unidentified woman.

A photo Weiner shared of himself clad in underwear near his son led his wife, top Hillary Clinton aide Huma Abedin, to file for divorce in August.

In the latest case, Weiner claimed that he was a victim of a hoax and issued a statement to Fox News.com when the story broke of his new alleged sexting scandal.

“I have repeatedly demonstrated terrible judgment about the people I have communicated with online and the things I have sent," Weiner said. "I am filled with regret and heartbroken for those I have hurt."

Weiner's claim that he has "been the subject of a hoax" was not dismissed out of hand by a source close to the victim's family.

“This is something she would do," the source said. "It sounds like her. It's crazy to me. She wants to be a writer. She's 16 and super smart. If she wants something, she'll find a way to get it."

In order to determine if Weiner’s claims of a “hoax” are correct, federal prosecutors could subpoena his and the minor’s cell phone records, according to New York criminal defense attorney, Lance Fletcher.

“It would make it very clear what message was sent from and to his phone," Fletcher said. "This subpoena could also reveal the date, time and location of his device during the conversations. If the most explicit statements came from her, he will probably be okay. He can't be charged if the sexually explicit material was written by her and if he did not send or receive any photos.”

Weiner could also wriggle out of trouble if he can show he did not know his sexting partner was just a kid, said Cheeks.

“If Weiner did not know that the female was a minor, it could be helpful," Cheeks said. "Oftentimes, a crime involving a minor requires that the suspect knows that victim is indeed a minor.”

Weiner did not respond to requests for comment.

“His family wanted him to stay 90 days, but he had to leave because he ran out of money,” a source told the Page Six gossip reporter.

It was also reported that Weiner’s own parents took out a mortgage on their home to pay for his sex addiction rehab.

Weiner has far more problems than combating sex addiction, though, as various agencies are still investigating him for sexual misconduct with an underage girl.

Weiner’s troubles were compounded this month after he was hit with a $65,000 fine for improper use of campaign funds, according to DNAInfo.com.

On December 2, the New York City Campaign Finance Board announced its decision to fine Weiner for improper use of campaign funds from his failed 2013 run for New York Mayor.

The board announced that Weiner accepted campaign donations that exceeded limits, failed to prove that spending of funds was related to his campaign, and even kept spending campaign funds for personal use after he lost the election.

Some of the findings the board made included that Weiner improperly spent funds on personal cell phone bills, paying for extra-campaign consultants, dry cleaning bills, the purchase of a TV, payments to people who didn’t seem to be part of his campaign, and other expenses.

On the one hand I think he should kill himself, but on the other hand I think this whole story is GOLD, Jerry, GOLD!!

Maybe if Huma wasn't too busy cow-towing to Killary, she could have been a better wife and kept her husband faithful.  Of course, since she is a filthy Muzzie, she should be grateful that he hasn't had her beaten for disobedience.
