Obama USDA offering women, Hispanic farmers over $1.3 billion in discrimination payouts

As part of “a new era of civil rights” at the Department of Agriculture, Secretary of Agriculture Tom Vilsack announced Monday that Hispanic and women farmers and ranchers who believe USDA discriminated against them can file claims to get a piece of at least $1.33 billion in cash awards and tax relief payments and up to $160 million in farm debt relief, beginning this week.
 
Women and Hispanic ranchers and farmers who feel the agency denied their loan or loan servicing applications because of their race or gender at various periods from 1981 to 2000 can file claims alleging discrimination from Sept. 24, 2012, to March 25, 2013, for a slice of the payout.
 
“Hispanic and women farmers who believe they have faced discriminatory practices from the USDA must file a claim by March 25, 2013 in order to have a chance to receive a cash payment or loan forgiveness,” Vilsack explained in a statement Monday. “The opening of this claims process is part of USDA’s ongoing efforts to correct the wrongs of the past and ensure fair treatment to all current and future customers.”
 
In February 2011, Vilsack announced the historic “path to justice for Hispanic and women farmers” to offer them an outlet to receive compensation for past wrongs without having to go to federal court.
 
This is the third settlement to interest groups the USDA is believed to have discriminated against during the Obama administration.
 
“When I was sworn in as secretary of Agriculture two years ago, President [Barack] Obama and I made a commitment to mend USDA’s troubled civil rights record,” Vilsack said in 2011 statement. “Since then, we have taken comprehensive action to turn the page on past discrimination. Last year we entered into a settlement with black farmers in Pigford II to address pending claims, and finalized a historic settlement agreement with Native American farmers under Keepseagle that faced discrimination by USDA.”
 
The $1.25 billion Pigford II settlement — which covered black farmers who charged that the USDA had discriminated against them when applying for loans from 1981 to 1996 but missed the filing deadline in the original 1999 Pigford settlement (named for the lead plaintiff, Timothy Pigford, in a class action lawsuit against the government) — made headlines in 2011 for the allegations of fraud in the program.
 
The Keepseagle settlement made $760 million available to Native American farmers and ranchers who believe they did not receive the same farm loan opportunities as whites between 1981 and 1999.
 
The USDA plans to engaged in outreach through mail, media, and community advocacy groups to ensure that those eligible are aware of the claims process. The agency has print, video and audio outreach messages in English and Spanish on its website.

I think you would be pissed too if the USDA was not only not giving loans but also taking property illegally from farmers by taxing them for a higher rate than its worth, giving premature foreclosures without due process and then selling it off to their cronie friends for profit.

It ridiculous to argue this matter.  Just about everyone in the House and Senate agreed on this being done....very rare.  Fact is that there were a lot of corruption in that dept and it has to be taken care of.....period.  Otherwise, it cripples the free enterprise system of fair play in business.

I doubt the budget would hardly cover it.  The amount is high because the timeline of corruption was from 1981-1996 when it was discovered.  Can't even punish anyone as most of the people behind it retired or left before the shit hit the fan.

The New York Times reported Friday that the U.S. Department of Agriculture (USDA) has likely enabled massive fraud in the Pigford series of legal settlements, in which black, Hispanic, female and Native American farmers have claimed to be victims of past discrimination.
 
The cost of the settlements, which could exceed $4.4 billion, is the result of a process that "became a runaway train, driven by racial politics, pressure from influential members of Congress and law firms that stand to gain more than $130 million in fees," the Times notes.
 
Among those influential members of Congress was then-Senator Barack Obama, who made Pigford payouts a priority in exchange for political support for his 2008 presidential campaign among a coveted group of black voters in the rural South, the Times reports.
 
As president, Obama continued to support payouts for new groups of claimants while abandoning a review process that had been used to fight fraud. The aim was "buying the support" of minorities, according to the Times, while middlemen created a "cottage industry" in defrauding the government.
 
The Times investigation, led by reporter Sharon LaFraniere, vindicates the late Andrew Breitbart, for whom Pigford became a crucial issue in demonstrating the cynical use of racial politics by the institutional left to hurt the very people they claimed to be helping. Breitbart directed investigations of the Pigford fraud and championed the cause of the original black farmers in the lawsuit, arguing that many of them had been left behind while opportunistic lawyers and fraudulent claimants looted the federal treasury in exchange for votes and support.
 
The left, led by the George Soros-funded Media Matters for America, attempted for years to dismiss claims of fraud in Pigford, calling it Breitbart's "stupidest conspiracy theory." When Fox News picked up the story, Media Matters called it an attempt to attack "anti-discrimination efforts."
 
In fact, the 5,529-word report by LaFraniere shows that Pigford and subsequent settlements had little to do with redressing discrimination and everything to do with politics and greed, while the true victims of discrimination continued to suffer in obscurity.
 
In 2010, Breitbart was accused by the left of using a dispute with the NAACP to disrupt Pigford funding. That motivated him to investigate.
 
"I had never heard of Pigford, so for the last four and half months, all I’ve been doing is eating, breathing, sleeping Pigford, researching Pigford, finding whistleblowers who are hiding in plain sight who have been wanting to tell the story of how this was rigged," he told the Daily Caller in December 2010.
 
The Times story credits Breitbart News and Rep. Steve King (R-IA) for drawing attention to the issue.
 
LaFraniere and colleagues conducted their own, independent investigation, "based on thousands of pages of court and confidential government documents, as well as interviews with dozens of claimants, lawyers, former and current government officials and others involved in the cases over the past 14 years."
 
Secretary of Agriculture Tom Vilsack told the Times that the settlements opened "'a new chapter of civil rights at U.S.D.A," claiming that critics of Pigford and other payouts were motivated by a "Pandora's box" of hidden racial agendas.
 
Yet the Times documents how Pigford became a "magnet for fraud" across the South. "In 16 ZIP codes in Alabama, Arkansas, Mississippi and North Carolina," LaFraniere writes, "the number of successful claimants exceeded the total number of farms operated by people of any race in 1997, the year the lawsuit was filed. Those applicants received nearly $100 million." The government let many of the fraudulent claims slip by unpunished because "the bar for a successful claim was so low that it was almost impossible to show criminality."
 
Much of the fraud was enabled by the Clinton and Obama administrations, and by members of Congress seeking to reward special interests. Then-Sen. Obama sponsored new Pigford legislation in 2007, while Sen. Bob Menendez (D-NJ) threatened in 2009 to lead protests against the administration if it did not bend to the wishes of Hispanic claimants.
 
Meanwhile, whole families, including young children, filed claims for past discrimination to reap $50,000 each in cash payouts. As yet, Congress has failed to investigate Pigford.
 
That may finally change.

“I wish to God that Andrew Breitbart were alive to see this,” Stranahan wrote. “He fought this fight for years, was totally right and never got credit for it.”

The Times’ A1, above-the-fold story — which involved Freedom of Information Act requests, interviews with former administration officials and database work — shows how political appointees in the Obama administration’s Justice and Agriculture Departments turned a potential government court victory into $1.3 billion settlement for Hispanic and female farmers — some of whom never even claimed discrimination in court. The story also detailed how the feds relied on a flawed payout system for black farmers that was ripe with fraud and revealed that career officials in the Agriculture Department had opposed the program.
 
The original black farmers’ case, called Pigford v. Glickman, and the unfair treatment of many of the original plaintiffs in the lawsuit became a personal cause for Breitbart, who died in 2012 of a heart attack. The conservative provocateur published a December 2010 report about the case, entitled “The Pigford Shakedown,” and also spoke about the program at CPAC and other events.

Agriculture Secretary Tom Vilsack, who the Times portrays as a driving force behind the settlement, said the payments were justified and fraud was minimal. “We weren’t just writing checks for the heck of it,” Vilsack told the paper. “People were not treated fairly and, in fact, even today there are damages as a result of folks who weren’t treated fairly.”
 
Hot Air’s Ed Morrissey noted the ultimate vindication is still out of reach.
 
“Perhaps now that The New York Times has exposed this, a few lawmakers might get shamed into doing something about it,” he wrote. “That would really put a smile on Andrew’s face.”
