Judge jailed for exposing himself during trials

BRISTOW, Oklahoma (AP) -- A former judge convicted of exposing himself while presiding over jury trials by using a sexual device under his robe was sentenced Friday to four years in prison.
Donald Thompson had spent almost 23 years on the bench and had served as a state legislator before retiring from the court in 2004. He showed no reaction when he was sentenced.
At his trial this summer, his former court reporter, Lisa Foster, testified that she saw Thompson expose himself at least 15 times during trial between 2001 and 2003. Prosecutors said he also used a device known as a penis pump during at least four trials in the same period.
Thompson, 59, was convicted last month of four felony courts of indecent exposure for incidents that took place in his Creek County courtroom.
Judge C. Allen McCall denied a defense motion asking that Thompson be allowed to remain free pending an appeal. Thompson also was ordered to pay a $40,000 fine.
Thompson, a married father of three grown children, testified that the pump was given to him as a joke by a longtime hunting and fishing buddy.
"It wasn't something I was hiding," he said.
He said he may have absentmindedly squeezed the pump's handle during court cases but never used it to masturbate.
Foster told authorities that she saw Thompson use the device almost daily during the August 2003 murder trial of a man accused of shaking a toddler to death. A whooshing sound could be heard on Foster's audiotape of the trial. When jurors asked the judge about the sound, Thompson said he hadn't heard it but would listen for it.
Police built a case against the judge after a police officer testifying in a 2003 murder trial saw a piece of plastic tubing disappear under Thompson's robe. During a lunch break, officers took photographs of the pump under the desk.
Investigators later checked the carpet, Thompson's robes and the chair behind the bench and found semen, according to court records.
Carmelia Brossett, a senior probation officer for the state Department of Corrections, said in a presentencing report that Thompson refused to undergo psychosexual testing.
"Thompson's denial of the offense would likely present difficulty, if not inability for treatment providers to provide meaningful and beneficial sex-offender treatment," she said.
The jury recommended a sentence of one year in prison and a $10,000 fine on each count. The jury foreman has said it was the jury's intent that Thompson serve the full sentence.

Agreed. It's gross, but it's not criminal. This is grounds for him being fired, not jailed, and certainly not for 4 years.

I wonder what every civil litigant and criminal defendant whose trial this judge presided over is thinking?
Prison time is well deserved. He was a public servant placed in charge of people's livelihoods and freedom.
Now he'll have plenty of time to work on the size of his member.

Child molesters should be one and done IMO. I have no trouble at all putting them away for life. First offense. They simply cannot be rehabilitated.
A judge who abuses his office needs to be severely punished too. They have too much power to permit any kind of abuse. There are a lot of people who appeared before this guy who probably feel pretty violated. Wouldn't you?

The big thing for me on this one is his mental state.Anyone who would do something like that can't possibly be right upstairs,therefore,how rational was his thinking when he made important decisions on the bench.I think that would be my main concern if I had been before him.

What good does it do to have him in prison at all?
He will not be able to pay taxes during those years, and I doubt he'll ever become a fully working capacity unit of the society again.

Which is ridiculous. "Jail time" seems to be our answer to everything we don't like in America these days.
I agree with locking up violent offenders for life to protect the rest of us, but jail sentances, especially long ones, for white collar crimes, other non-violent offenses, and petty crap like this is just one more step towards the "Big Brother"-style police state America is becoming. "Corrections" and "Law Enforcement" have become huge industries, and we're now on a path where to protect their jobs or profits, people won't rest until half our population is in jail, despite the fact that fewer than 5% of them are violent offenders who are dangerous to the rest of us. :(

The guy on the train isn't deciding whether someone will spend the rest of their life in prison, whether a mother will have her parental rights terminated, or whether a person will lose hundreds, thousands, or millions in a civil lawsuit.

Yes, it's quite revolting, on every level. I was just also pointing out that the pedophile who masturbates across from a school yard, and the man who, excuse me, takes it out on a train or wherever, would get a long sentence, so why shouldn't a judge?

My friend was wrongfully charged with murder and aquitted at trial in NY...I couldn't imagine if he was convicted and the judge missed some important things in the trial that should not have been allowed because he was JERKING OFF> Not criminal? Think about that a little more, man.

Like I said... it's disgusting, and it's grounds for him being fired, no question about it... but Jail? Here in America, it seems we try to criminalize everything we don't like. It's the sheep who buy into this philosophy that aren't doing the thinking, not me.

How about the fact that he was in public.....presiding over a murder trial....murder, it's someones life either way...yeah it's a lot different when someone not only does that in public, but while they are in CONTROL of a trial that determines if someone committed murder. BIG DIFFERENCE.
