Bodybuilders battle against charges of selling illegal dietary supplements, By Mario Ariza

The bodybuilders made millions selling products designed to help their clients bulk up, but the government accuses them of fraudulently peddling dietary supplements containing dangerous designer drugs and illegal steroids. Declaring the prosecution an effort by the government “to destroy the weightlifting industry,” the muscle men have promised to beat the case for the good of iron-pumpers everywhere.
If you listen to the defense, it’s a case of how Boca Raton-based Blackstone Labs and Ventech Labs turned selling dietary supplements into business success. If you listen to prosecutors, it’s a tale of South Florida salesmen making millions peddling compounds of questionable legality and safety. The government, in its 49-page, 14-count indictment, charges that Phillip Braun, Aaron Singerman, Robert DiMaggio, Anthony Ventrella, David Winsauer and James Boccuzzi conspired to sell hundreds of thousands of illegal products, including dietary supplements containing possibly dangerous designer steroids known as “prohormones."
All of the accused, with the exception of DiMaggio, are from South Florida. The indictment alleges that six men and the two companies they owned distributed the purportedly dangerous products even though they knew they might be harmful to consumers, and that they engaged in litigation to silence the complaints of people who their product sickened.
“When you sell a product that doesn’t have a label that includes ingredients, that’s a crime,” argued Assistant United States Attorney David Frank to the federal judge during the hearing. Arguing that the ingredients found in their products were either “natural,” or unregulated, Blackstone Labs CEO Phillip Braun and his four co-defendants have consistently denied the charges. In a statement released by Blackstone following the indictment, the company called the accusations “false and inaccurate” and accused the government of meddling in the nutritional supplement industry.
One defendant, Nevada-based Robert DiMaggio, pleaded guilty on Nov. 19.
On Monday and Tuesday, the weightlifters, who are out on bond, packed the courtroom of U.S. District Judge William P. Dimitrouleas as the judge held a marathon series of motion hearings to try and resolve a complicated set of legal issues that have arisen in the case. Lawyers for the bodybuilders have themselves leveled accusations of prosecutorial misconduct against the government, claiming that Assistant United States Attorneys failed to turn over key evidence in a timely fashion. In court filings, the defense attorneys claim the evidence in question shows that at least some of the performance-enhancing substances their clients are charged with selling weren’t actually illegal.
The attorneys also have moved to suppress evidence and dismiss five of the 14 charges against their clients. In one instance, court records show defense attorneys moving to exclude from possible future jury consideration a YouTube video of one of the defendants using a supplement and then copulating with an inflatable blow up doll in an attempt to show how well the product worked. Sentences for the offenses named in the indictment range from three years to 15 years for the various counts including conspiracy, according to the Department of Justice

What is meant by "grey"? Anyone who has taken Superdrol knows how powerful it is, it feels like a supercharged and supertoxic Anadrol. Even if it wasn't somehow "super illegal" any idiot knows it's risky to sell something like this to kids and that it could cause problems with the law. But these guys were like any drug dealers who plan to move illegal products for a while and then invest into legitimate businesses.

The pro-hormone designation was sort of a pseudo-scientific term to begin with. The fairly inneffective early "pro-hormones" are today classified as anabolic steroids by drug testing bodies such as WADA. Some bread and butter common anabolic steroid, which were always illegal, might exert most of their effects through their metabolites but it doesn't change anything really.
I'm sure there is some ambiguity in how the law could be interpreted but there's a reason none of the really big supplement companies messed with the pro-hormones or the pro-steroids (lol that term was even more ridiculous). Anabolic steroids work and would sell like crazy but the legal risk is just too great.
But it was nuts how you could buy M1T or Superdrol on bb.com or whatever. Many juicers refused to believe they would work at all simply because nothing on a supplement site could really work. Today people know these are some of the strongest drugs ever made.
Then they went really nuts and put 3 or 4 of these drugs in the same pill lol.

No. These supplements certainly would've been illegal and/or unapproved by the time Braun and Singerman were selling them. And they were still plotting and scheming to sell them after the FDA and others politely warned them to stop. Arguments about free choice, etc.... aside, they had plenty of chances to stop, and they probably would've been fine if they had.
Braun and Singerman got into the prohormone/designer steroid game late, and stayed in it long after near all of the major players had exited. They got addicted to the money.

Not surprisingly, all of Braun's & Singerman's legal tap-dancing efforts have been tossed by the court, according to the Pacer.gov docket info on the case, a continuance for a trial scheduled for October 20th, 2020 has been ordered, basically delaying the inevitable; fact is, they both really need to play "Let's Make A Deal" before then.

Do you recall that post where PJ Braun quit his sponsorship from IML Supplements / Robert DiMaggio, and was mean to DiMaggio, saying mean things to him, and being mean to him, generally speaking?
If someone was mean to you, would you still be there friend?
In light of the fact that Braun was mean to DiMaggio, and said mean things about him, I can understand why DiMaggio is no longer concerned about Braun, and doesn't care about his freedoms.
I honestly don't know what I would do unless I was in the exact same position - including having the knowledge that PJ Braun was mean to me. It would be hard to be kind to someone who was previously mean to me.

(He was cheating on her with numerous prostitutes and eventually she tried to kill him which ended inner unfortunate arrest and then long stint in rehab... for the record I think Gena is a sweetheart and I think any women would have wanted to kill him for what he was doing to her too)
At the time Gena had to enter Rehab we had tripled the companies sales because of our aggressive online marketing strategy (the same strategy that made BSL the hottest company in supps trumping anything IML ever did) all the companies sanity went to rehab with her and Aaron and I were ready to do our own thing which Robert said he would like to be a part of and promised us lots of financial help if we agreed to let him be a part. Aaron and I gave Robert 30% of the company in exchange for some units of starting Super DMZ 2.0 (that we sold in a total of 5 weeks). This was the worst decision of my life, from a business standpoint because after that, not only did Robert never help with anything ever again, but would actually try to cannibalize our sales by posting bad articles about our products. Meanwhile this idiot was getting checks for $70k a month or more sometimes from us. We finally bought him out and it was the best day ever getting rid of that moron.
I actually tried hard to be friends with him, but after he went on a rant about how Jason Genova was a retard and that we shouldn't support retarded people that look like shit, I couldn't take him. Jason is not retarded and as annoying as he can be, we really wanted to help him and still do... so this fucking loser has problems with mentally challenged people, is a notorious adulterer, and obsessive drug addict (to this day i have never seen anyone do more coke then Robert) and was a pure cancer to BSL... Good riddance to him...

Aaron has always had my back for years and even when I was the most hated person in the bodybuilding industry because of my trolling tactics however honestly don't want Aaron, PJ, or even Rob going to jail over this. The FDA are nothing more than shills for the pharmacutical industries and always shut down companies that sell products that actually work. Ephedra for example helped many people lose weight but it got banned placing the blame on some fat overweight baseball player who wore layers of clothes in 90 degree weather to lose weight and Korey Stringer who basically was trained to death by reckless coaches.
However, they will all do prison time in my opinion...not much, prob the same amount that Palumbo did but I would have liked them to stick together and watch each other's backs. If I had moved to Boca Ration in 2014 after my divorce, they wouldn't be in so much trouble because I would have showed them how to limit their exposure....the same that I do for "certain IFBB pro bodybuildiners" who happen to be friends with Dorothy.....

I own a wholesale dispensary supply company, so I have a bit of insight. Edibles are made from different strains ( by and large ) so you may adapt to the strain. I’d suggest trying a different product at the same dose. Bumping it up too early ( prior to physical tolerances developing ) might not be the path forward.

The bodybuilders made millions selling products designed to help their clients bulk up, but the government accuses them of fraudulently peddling dietary supplements containing dangerous designer drugs and illegal steroids.
Declaring the prosecution an effort by the government “to destroy the weightlifting industry,” the muscle men have promised to beat the case for the good of iron-pumpers everywhere.
If you listen to the defense, it’s a case of how Boca Raton-based Blackstone Labs and Ventech Labs turned selling dietary supplements into business success. If you listen to prosecutors, it’s a tale of South Florida salesmen making millions peddling compounds of questionable legality and safety.

The government, in its 49-page, 14-count indictment, charges that Phillip Braun, Aaron Singerman, Robert DiMaggio, Anthony Ventrella, David Winsauer and James Boccuzzi conspired to sell hundreds of thousands of illegal products, including dietary supplements containing possibly dangerous designer steroids known as “prohormones."
All of the accused, with the exception of DiMaggio, are from South Florida.
The indictment alleges that six men and the two companies they owned distributed the purportedly dangerous products even though they knew they might be harmful to consumers, and that they engaged in litigation to silence the complaints of people who their product sickened.
“When you sell a product that doesn’t have a label that includes ingredients, that’s a crime,” argued Assistant United States Attorney David Frank to the federal judge during the hearing.
Arguing that the ingredients found in their products were either “natural,” or unregulated, Blackstone Labs CEO Phillip Braun and his four co-defendants have consistently denied the charges. In a statement released by Blackstone following the indictment, the company called the accusations “false and inaccurate” and accused the government of meddling in the nutritional supplement industry.
One defendant, Nevada-based Robert DiMaggio, pleaded guilty on Nov. 19.
On Monday and Tuesday, the weightlifters, who are out on bond, packed the courtroom of U.S. District Judge William P. Dimitrouleas as the judge held a marathon series of motion hearings to try and resolve a complicated set of legal issues that have arisen in the case.
Lawyers for the bodybuilders have themselves leveled accusations of prosecutorial misconduct against the government, claiming that Assistant United States Attorneys failed to turn over key evidence in a timely fashion.
In court filings, the defense attorneys claim the evidence in question shows that at least some of the performance-enhancing substances their clients are charged with selling weren’t actually illegal.
The attorneys also have moved to suppress evidence and dismiss five of the 14 charges against their clients. Wow so according to this recent article two schmoes named Shemtob and Smith, who bought the drugs ahem supplements from blackstone labs are facing 10 years in prison for federal drug distribution offences. Both have entered guilty pleas since.
No doubt their co-operation which includes under-cover work apparently :D... should help in reducing their sentences.
Also both of them have agreed to forfeit more than $64,00 and $558,000 respectively as part of their plea agreement. :o

If that were the case, then they’d have pled out by now and offered a big money fine to avoid prison. Feds don’t play around and they have the witnesses they need and an unlimited amount of resources - the odds of not being broken by them are slim.
They’re fighting for their freedom and also the Feds in this case are going after a company and have the power to prevent the company and any individual linked or doing business under the company name or otherwise from ever selling any type of supplement again. In fact, you can be ordered never to have any involvement in the industry for the rest of your life or a time negotiated upon.
Same goes with people linked to stock scams, etc.

If they were knowingly selling steroids, and I thought at one time they had forged documents or had impersonated a FDA official, they will get what is coming to them. The fact that they still in business and Singerman immediately started a new company without repercussions (if what I insinuated is correct) is interesting.
I was friends with a CPA who forged federal documents, he was skimming money from payroll systems he oversaw, who was convicted, did time and lost his license but was able to sell/transfer his business to a family member. He owed a little over $1.5 million in restitution, that I think he payed a fraction of (and I could be completely wrong) and now owns recycling business.
I have an old neighbor under federal investigation for mortgage fraud, the FBI shut down the whole block, used concussion or flash grenades to enter the home and escorted the whole family out of the house, along with a bunch of possessions. The agents on the scene were telling the neighbors he was going away for a long time, this was 2 years ago and nothing has come from it yet.
The government isnt going to pursue cases they dont think are slam dunks. As I said I would not want to be in Aaron and PJ's shoes.
But I say all this to point out these guys will try to hide as much money (if there is any) as they can and probably have a backup plan ready.

Blackstone Labs Founder Sentenced for Conspiracy to Sell Anabolic Steroids and Unlawful Dietary Supplements
A South Florida man who founded a sports and dietary supplements retailer was sentenced today to 54 months in prison for conspiring to sell illegal anabolic steroids and other products marketed as dietary supplements that were unlawful under federal law.
According to court documents, Aaron Singerman, 41, of Delray Beach, Florida, founded and operated Blackstone Labs LLC, a Boca Raton-based sports and dietary supplements retailer. Singerman is the former CEO of Blackstone. U.S. District Court Judge William P. Dimitrouleas of the Southern District of Florida sentenced Singerman to 54 months in prison and ordered him to forfeit $2.9 million.
In pleading guilty, Singerman admitted to leading a conspiracy to sell products through Blackstone labeled as dietary supplements that were illegal under federal law because they were not approved by the FDA and were controlled substances. According to court documents, Blackstone defrauded the FDA as part of the scheme.
“Selling products labelled as dietary supplements that actually contain controlled substances and unapproved drugs is illegal and potentially dangerous,” said Acting Assistant Attorney General Brian M. Boynton of the Justice Department’s Civil Division. “The Department of Justice will work with its law enforcement partners to prosecute dietary supplement makers who ignore the law and disregard public safety for monetary gain.”
“Drug products that are disguised as dietary supplements can pose a risk to the health of U.S. consumers,” said Special Agent in Charge Justin C. Fielder of the U.S. Food and Drug Administration Office of Criminal Investigations (FDA OCI) Miami Field Office. “We will continue to investigate and bring to justice those who jeopardize the public health.”
Singerman specifically admitted that he conspired with others from 2012 through 2017 to sell products that were unapproved new drugs and/or illegal controlled substances under the Designer Anabolic Steroid Control Act. The defendant admitted that he and his co-conspirators lied to consumers by characterizing Blackstone products as safe and legal dietary supplements. In addition, he falsely represented that the products were made in “FDA approved” registered facilities that followed all required regulations, when in fact they were not. Singerman also admitted to controlling a supplement manufacturer that fraudulently imported raw ingredients for their products from China. Singerman admitted to selling other products in violation of the Food, Drug & Cosmetic Act, including the synthetic stimulants DMAA and DMBA, and the chemical picamilon. Singerman and his co-conspirators ignored injury reports from consumers and did not notify the FDA of such complaints, even when required by law.
Six additional individual defendants and three other corporations previously pleaded guilty to charges related to the conspiracy. One additional defendant, James Boccuzzi, was convicted of conspiracy to distribute controlled substances and conspiracy to defraud the FDA following a jury trial in December 2021. All 10 of these additional defendants are scheduled to be sentenced by Judge Dimitrouleas in February.
