Damn, it's a busy Friday.  This is the third 'turd sentenced today.  What's up with these idiots?  They are never sorry and crying when bragging on Facebook, but in the courtroom it's a different story.   ::)

A Donald Trump supporter who brought two guns to the Capitol on Jan. 6, and dropped one of them on Capitol grounds, was sentenced to five years in federal prison on Friday.

Mark Mazza was sentenced to 60 months behind bars by Judge James E. Boasberg. Before he was sentenced, Mazza told the court he got "caught up in a mob mentality that I never anticipated" and that he was "not quite the monster that the prosecution has described me as."

Federal prosecutors said that Mazza, "while armed with [a] .40 caliber loaded firearm, engaged in multiple efforts to break through the police line: he repeatedly pushed against officers using the combined physical exertion of the mob; he armed himself with a stolen police baton and assaulted officers with the baton; he yelled at officers telling them to get out the mob’s way and to 'Get out of our house!'; he held open the door to the tunnel entrance against the resistance of officers, and after being rebuffed, he gathered additional rioters into the tunnel area to continue 'heave-ho' pushes against officers in the doorway."

Mazza told the judge he brought the weapons to D.C. because he brings weapons everywhere and had thought he and the person he was traveling with were staying in a dangerous location in the nation's capital. Although Mazza now admits he lost one of his guns at the U.S. Capitol, he filed a false police report claiming it was stolen back in his home state of Indiana.

Mazza said he regretted coming to the Capitol on Jan. 6.

“I wish I could erase it. I wish I could go back and take that hour back" and maybe go to a museum and grab some dinner, he said. He said he felt bad for his children and hoped that his parents won't die before he gets out of federal prison.

“I’m treating this kind of like another military step, like it’s something I’ve got to do,” Mazza, a veteran, said.

Judge Boasberg credited Mazza with helping the officers after participating in the assault but said his conduct was deserving of a significant period of incarceration.

"I don’t know what on earth you were thinking about in that tunnel that day," Boasberg says, calling the videos of his conduct inside the western tunnel "incredibly alarming."

“You weren’t one of the worst, I can see that," Boasberg said. "But the mob doesn’t accomplish what it accomplished that day without numbers."

The FBI on Thursday arrested a New York lawyer who is accused of trying to disarm an officer protecting the U.S. Capitol during the Jan. 6 riot, law enforcement sources told NBC News.

John O’Kelly of East Williston, New York, faces two felony charges — assaulting, resisting or impeding officers, and civil disorder — along with four misdemeanor charges, according to court documents.

WNBC in New York observed law enforcement activity at O'Kelly's home on Thursday morning.

Authorities say O'Kelly tried to "disarm" a D.C. Metropolitan Police Department officer on Jan. 6 by grabbing an officer's baton and "attempting to wrestle it from the officer’s hands." Body camera footage cited in court documents showed the man identified as O'Kelly pushing metal bike rack fencing that was being used to secure the Capitol perimeter.

O’Kelly, known to online sleuths investigating the Jan. 6 attack as “MidWhiteCrisis,” was No. 294 on the FBI’s Capitol Violence page, which features images of more than 500 people wanted in connection with the Jan. 6 attack.

O'Kelly was previously an attorney for the Lawyers’ Committee for 9/11 Inquiry, which believes that the Twin Towers were brought down by pre-planted explosives. In a 2019 lawsuit, the group sought to force the Justice Department to present their claims to a grand jury. A judge dismissed the lawsuit in March 2021, and an appeals court upheld the lower court ruling in August 2022.

When reached for comment on O'Kelly's arrest, the group's litigation director, Mick Harrison, told NBC News: "John is no longer with us and we’re unfamiliar with the circumstances of the matter you’re inquiring about."

An FBI affidavit says that the bureau received a tip about O'Kelly on July 8, 2021, in connection with Jan. 6 from someone who used "open source photo ID software" and identified O'Kelly as a likely match.

"Following this tip, the FBI reviewed New York Department of Motor Vehicles (DMV) photos of John O’Kelly, and used facial recognition software to compare O’Kelly’s DMV photos to footage taken at the U.S. Capitol on January 6, 2021. Facial recognition software indicated that O’Kelly’s DMV photo matched a second video taken at the U.S. Capitol on January 6, 2021 by an unknown individual filming with what appears to be a cellular telephone," the FBI affidavit said.

The FBI also said it reviewed a photo of O'Kelly on the Lawyers’ Committee for 9/11 Inquiry website, and confirmed his identification by interviewing a "longtime friend of the O’Kelly family who knows John O’Kelly personally." FBI special agents further said they found a hotel reservation for O'Kelly outside of Washington, D.C., used phone records to confirm his identification, and went to O'Kelly's home to surveil him to confirm identification.

More than 870 people have been arrested by the FBI in connection with the Jan. 6 attack. On Thursday, a 20-year-old North Carolina man who had been enlisted in the Air Force pleaded guilty to assaulting law enforcement and was ordered jailed until his sentencing.

As for being held without bail, over 70% of people charged in the Capitol riot were granted pretrial release. Folks are not granted a pretrial release for a few different reasons, including not being able to make bail and being a flight risk.  About 7 in 10 defendants secured release when bail was set at less than $5,000, but this proportion dropped to 1 in 10 when bail was set at $100,000 or more.

The right to a pretrial release varies from state to state. In Washington D.C., Virginia, West Virginia, and Maryland folks have no constitutional right to bail. The proceedings are being held in U.S. District Court for the District of Columbia, so there you have it. Had there been enough jail beds it is possible none of those charged may have been released. Maybe those who were held in solitary were done so because that was the only space available or maybe it was for their own protection. If a bunch of Yahoos on a Getbig discussion board post threats of violence against those folks, they don't know. Who knows what might happen in a jail or prisons. Surely not all prisoners are far left or far right politically, but some may be, and many prisoners have a reputation for excessive violence. Did you actually read what you posted?  He was charged with "assaulting a police officer using a deadly weapon," which was stolen police baton, and "carrying a firearm without a license."  So no, he was neither charged with nor convicted of using his firearm to try and overthrow the U.S. government as part of an insurrection. 

I'm sure the stolen police baton was part of his plan to overthrow the government.  ::)

The reason no one was charged with insurrection is because it wasn't an insurrection.
