Title: Could Titus recieve the ultimate penalty?

has anyone considered the fact that Craig has two prior felony convictions and that this case involves an aggravating circumstance, arson, i think it's very possible that he could be put to death for this.

The death penalty will not be on the table.

Besides, you're presuming that the prosecution will even be able to get a murder one conviction.  I don't see that happening. 

The prosecution will REACH for murder two, arguing depraved indifference, but the defense will stick with the truth and prove that this was just a terrible accident.

Look for Craig to be sentenced on the events surrounding the attempted cover-up and both he and Kelly will be found guilty of attempting to flee prosecution (even though their efforts were half-hearted, at best).

but if this is true

if she died by accident
then a charge negligence(abusing a corpse w/tape & setting it afire) is a possibility.
i'm sure the defense will attempt to be plea bargin that one

I guess none of you have seen Law and Order?
How she died, whether it was due to OD'ing or at the hands of Craig/Kelly/Anthony Gross, remains to be seen. But, in order for someone to die from strangulation- and having a white curtain as the device used during the strangulation- that means that you had time to think about the events as they developed.
It's not like she was the one that jumped into the curtain and killed herself...though anything at this point in time remains to be seen.
There is also rumor (last "update" I heard anyhow) that she could have possibly still been alive when the car was lit on fire. In that instance, it would certainly lead to Murder One.
Then again, I'm no lawyer, just watch Law and Order with McCoy Inc... ;D  ;D

Actually, if anyone here remembers the Preppie Murder Case, Robert Chambers' defense was that accidentally choked Jennifer Levin to death during "Rough Sex."

It didn't work.

how do you figure it was an accident?

Two of the (many) possible scenarios:

1) drug overdose

or

2) kinky sex act that went too far

Either of those (among others) could explain how Ms. James died.  It's also entirely possible that Craig & Kelly were in a drug-induced "fog" and have no clue what happened before her body  was discovered.

1) She could've choked to death on her own vomit

2) She could've choked to death while engaging in sexual asphyxiation for pleasure

3) She could've passed out in a position that compromised her breathing

There are any number of possibilities here.

I'm an L&O junkie, but TBJ was horrible on so many levels, starting with the cast.  If the writing had been better, it might've survived, but the premise of the show was too far outside of the formula that's made L&O such a successful franchise.

Nevada gives about 20% of convicted murdered the death penalty -- so statistically speaking I would say those are his chances.... the big "if" being is if he is convicted of 1st degree murder.

I do not see a 1st degree conviction happening.

We barely survived the loss of Adam Schiff, but you're right, losing Jack McCoy would pretty much kill the show. 

CI is one of those shows that 'coulda been' great.  The problem is that the criminals almost always have the same affliction - they're often wannabe social climbers and they are always ashamed of where they came from.  I don't think that bringing back Chris Noth improved the show at all.  Nice try by them, though.
