I assume you recall that Trump was POTUS at the time that a large portion of the US shut down due to Covid

Former President Donald Trump’s effort to keep key evidence out of his civil rape trial next month was rejected by a federal judge Monday.

Judge Lewis A. Kaplan in Manhattan ruled that key witnesses will be allowed to testify and misogynistic remarks Trump made about women in 2005 when he apparently didn’t realize he was being recorded can be played for a jury that will hear quarter-century-old rape allegations made by a former magazine columnist.

A trial in the case filed by E. Jean Carroll is scheduled to start April 25. Carroll and Trump are expected to testify.

Carroll said in a 2019 memoir that she was raped by Trump in the mid-1990s in a dressing room at Bergdorf Goodman, an upscale Manhattan department store. She said a chance encounter filled with lighthearted banter turned violent when they entered a small room while teasing one another about who would try on a piece of lingerie.

I think ol Trumpy sort of knew it wasn't looking good, hence the appeal.  Corcoran drafted the document, but wouldn't sign it. Why not? I wonder. Instead He and Duhnold pushed TV lawyer Bobb to sign it instead.  That worked out real well.

Court orders Trump lawyer to provide docs in Mar-a-Lago case

A federal appeals court in a sealed order Wednesday directed a lawyer for Donald Trump to turn over to prosecutors documents in the investigation into the former president's retention of classified records at his Florida estate.

The ruling is a significant win for the Justice Department, which has focused for months not only on the hoarding of classified documents at Mar-a-Lago but also on why Trump and his representatives resisted demands to return them to the government. It suggests the court has sided with prosecutors who have argued behind closed doors that Trump was using his legal representation to further a crime.

The order was reflected in a brief online notice by a three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit. The case is sealed, and none of the parties in the dispute is mentioned by name.

But the details appear to correspond with a secret fight before a lower court judge over whether Corcoran could be forced to provide documents or give grand jury testimony in the Justice Department special counsel probe into whether Trump mishandled top-secret information at Mar-a-Lago.

Corcoran is regarded as relevant to the investigation in part because last year he drafted a statement to the Justice Department asserting that a “diligent search” for classified documents had been conducted at Mar-a-Lago in response to a subpoena. That claim proved untrue as FBI agents weeks later searched the home with a warrant and found roughly 100 additional documents with classified markings.

Another Trump lawyer, Christina Bobb, told investigators last fall that Corcoran had drafted the letter and asked her to sign it in her role as a designated custodian of Trump’s records.

A Justice Department investigation led by special counsel Jack Smith and his team of prosecutors is examining whether Trump or anyone in his orbit obstructed its efforts to recover all the classified documents, which included top-secret material, from his home. No charges have yet been filed. The inquiry is one of multiple legal threats Trump faces, including probes in Atlanta and Washington over his efforts to undo the election result and a grand jury investigation in New York over hush money payments. The New York case appears to be nearing completion and building toward an indictment.

Last week, Beryl Howell, the outgoing chief judge of the U.S. District Court, directed Corcoran to answer additional questions before the grand jury. He had appeared weeks earlier before the federal grand jury investigating the Mar-a-Lago matter, but had invoked attorney-client privilege to avoid answering certain questions.

Though attorney-client privilege shields lawyers from being forced to share details of their conversations with clients before prosecutors, the Justice Department can get around that if it can convince a judge that a lawyer’s services were used in furtherance of a crime — a principle known in the law as the “crime-fraud" exception.

Howell ruled in the Justice Department's favor shortly before stepping aside as chief judge Friday, according to a person familiar with the matter, who was not authorized to discuss a sealed proceeding and spoke to The Associated Press on the condition of anonymity. That ruling was subsequently appealed, and the court records show the dispute before the federal appeals panel concerned an order that was issued last Friday by Howell.

The three-judge panel that issued the decision include Cornelia Pillard, an appointee of former President Barack Obama, and J. Michelle Childs and Florence Pan, both appointees of President Joe Biden. The order came just hours after the court imposed tight deadlines on both sides to file written briefs making their case.

"This case is not that complicated. It's complex, but it's not complicated," the judge said of the lawsuit, which also seeks a $250 million penalty.

The suit alleges that Trump repeatedly deceived banks, insurers, and tax authorities by lying about the value of his assets in annual statements of worth called "Statements of Financial Condition."

"Essentially, it all boils down to whether the Statements of Financial Condition are true or false," Engoron told the parties in sticking to his trial date.

"The rest, as Hillel has said, is all commentary," the judge added, referring to a Talmudic story.

Engoron also repeated on Tuesday the phrase that he uttered after first setting the firm date, when he warned attorneys for Trump and the lawsuit's 15 co-defendants — including his three eldest children, some of its top executives, and multiple separate corporate entities — that the case will go on trial on October 2 "come hell or high water."

Trump Attorneys Tell Him to Prepare to Lose to Alvin Bragg

Trump is about to be a loser, several of his attorneys say.

Since last month, according to two sources familiar with the matter, some of Trump’s lawyers have told him that if he is criminally charged in New York City, he should be prepared to lose. There’s a widespread belief in Trumplandia — including within the ex-president’s legal orbit — that it would be difficult for the former president to get an impartial jury in the Democratic stronghold of Manhattan. Instead, these Trump attorneys are telling him his best chance is to win on appeal.

“The [former] president is more confident in his chances [than others are], but when some of us have brought this [idea of counting on an appeal] up to him … it seemed like he believed we had a good point,” one of the sources says.

A Trump spokesperson and a Trump attorney did not immediately provide comment for this story.

Manhattan District Attorney Alvin Bragg empaneled a grand jury to investigate whether the former president broke New York state business records laws by reimbursing his former personal attorney and fixer, Michael Cohen, for a hush money payment to cover up an alleged affair with porn star Stormy Daniels.

The Trump grand jury had been scheduled to meet again on Wednesday to hear from an unnamed witness, but the district attorney’s office abruptly canceled the meeting, according to CNN, leaving the timing of a potential indictment uncertain. (Days ago, Trump claimed on his social media network that he expected to be arrested on Tuesday, March 21.)

But if the case indeed goes to trial, Trump’s allies have already telegraphed that their plans to assail the prosecution as politically motivated, and even to allege that the city of New York itself is out to put the screws to Trump. The former president is also prone to hurling wild allegations at Bragg, such as bizarrely calling the DA “racist” for investigating him.

Prosecutors with experience in New York don’t find the argument persuasive.

“I don’t see a change of venue motion having success in this case,” says Jennifer Beidel, a former federal prosecutor in Manhattan who’s now a partner at Saul Ewing LLP. “A lot of high-profile cases — political cases, terrorism cases, massive fraud cases — occurred in New York. Bernie Madoff stayed in New York. ​​One would think that having committed that massive fraud in New York, if anything said that wasn’t the right jurisdiction for you, that would be it.”

New York City has already successfully prosecuted both Allen Weisselberg, the Trump Organization’s former chief financial officer, and two Trump companies, the Trump Payroll Corporation and Trump Corporation, on tax charges last year.

The strategizing in the New York grand jury investigation comes as Trump’s legal team has already moved to throw out the report from a separate grand jury investigation into potential election interference by Trump in Georgia. Trump’s attorneys filed a motion to quash a grand jury report because the jury foreperson allegedly “failed to protect the most basic procedural and substantive constitutional rights of all individuals discussed by this investigative body” by “engag[ing] in a media tour” where she discussed the case.

In Manhattan, Team Trump is looking at claiming victimhood as well.

“The former president deserves a jury that is unaffected by politics, and as a case of first impression, they need to make sure he has every ability to defend himself and that those participating in the process have clean hands. Skilled prosecutors can achieve this, but it’s a real challenge, given social media, news reporting, and because of how deeply politically charged this situation is,” says Michael Wildes, a former federal prosecutor and current Democratic mayor of Englewood, New Jersey. In the past, Wildes has worked for Trump, and continues to represent Melania Trump and her family on immigration matters. “That is not going to be easy, but it has to be achieved, otherwise the process will be tainted and appeals will be had,” he continues.

However, across the wide network of former Trump officials, there’s a dim view of his chances, as many believe a jury drawn from heavily Democratic Manhattan would easily vote to convict the former president. “It might be very difficult for Donald Trump to get a fair hearing in the county of Manhattan given it’s so overwhelmingly blue and anti-Trump,” lawyer and former Trump presidential transition team member Mark Smith said during a NewsNation appearance Tuesday. “It would be difficult. I’m not saying it would be impossible.”

The intense media scrutiny on the Trump case and his global notoriety also make it unlikely that other venues would make jury selection any easier, says Beidel. “Where can he go that’s not media-saturated? Where is the place where no one knows about this case or investigation at this point?”

Trump calls for removal of every top official investigating him

President Trump on Thursday called for the removal of every law enforcement official currently leading investigations into him.

A busy morning on social media for Trump was capped with a post suggesting the leads of four different investigations into his conduct be removed from their post.

Trump’s comments follow significant advances in each investigation.

“District Attorney Bragg is a danger to our Country, and should be removed immediately, along with Radical Lunatic Bombthrower Jack Smith, who is harassing and intimidating innocent people at levels not seen before, ‘Get Trump’ Letitia James, the worst Attorney General in the United States, and Atlanta D.A. Manhattan District Attorney Alvin Bragg (D) is set to meet Monday with a grand jury assembled to hear evidence in a case reviewing whether Trump broke the law in organizing and concealing a $130,000 hush money payment to adult film star Stormy Daniels.

Trump last weekend predicted he would be arrested Tuesday in connection with the probe — a date that has come and gone as the grand jury continues their closed-door meetings.

Special counsel Jack Smith, who is overseeing an investigation into the mishandling of records at Mar-a-Lago as well as the effort to stop the transition of power after the 2020 election, also just scored a major court victory. An appeals court backed a lower court ruling ordering Trump’s attorney in the Mar-a-Lago probe, Evan Corcoran, to turn over documents and transcripts of calls to prosecutors.

The ruling pierces the attorney-client privilege between Corcoran and Trump, with the lower court judge determining the communications are not privileged since they may have occurred in furtherance of a crime.

New York Attorney General Letitia James (D) has brought a civil fraud suit against Trump. Efforts by Trump’s team to delay the case for six months do not appear likely to succeed.

Court documents filed earlier this month indicate that Judge Arthur Engoron, who is overseeing the case, told the parties during a recent proceeding that the trial would start as scheduled on Oct. 2 “come hell or high water.”

And Trump’s Georgia-based legal team on Monday sought to quash an investigation led by Fulton County District Attorney Fani Willis (D) into his efforts to influence the 2020 election.

It’s not clear if Trump will be charged in connection with the probe, but the move comes after jurors who served on the grand jury there said this month its final report suggested charges for numerous people connected with Trump’s scheme.

Willis also said in January that charging decisions for multiple defendants are “imminent.”

A federal judge has rejected former President Donald Trump's claims of executive privilege and has ordered Mark Meadows and other former top aides to testify before a federal grand jury investigating Trump's efforts to overturn the election leading up to the Jan. 6 attack on the U.S. Capitol, multiple sources familiar with the matter tell ABC News.

Meadows, Trump's former chief of staff, was subpoenaed along with the other former aides by Special counsel Jack Smith for testimony and documents related to the probe.

Trump's legal team had challenged the subpoenas by asserting executive privilege, which is the right of a president to keep confidential the communications he has with advisers.

In a sealed order last week, Judge Beryl Howell rejected Trump's claim of executive privilege for Meadows and a number of others, including Trump's former Director of National Intelligence John Ratcliffe, his former national security adviser Robert O'Brien, former top aide Stephen Miller, and former deputy chief of staff and social media director Dan Scavino, according to sources familiar with the matter.

Former Trump aides Nick Luna and John McEntee, along with former top DHS official Ken Cuccinelli, were also included in the order, the sources said.

Trump is likely to appeal the ruling, according to sources briefed on the matter.

"The DOJ is continuously stepping far outside the standard norms in attempting to destroy the long accepted, long held, Constitutionally based standards of attorney-client privilege and executive privilege," a Trump spokesperson said in a statement. "There is no factual or legal basis or substance to any case against President Trump. The deranged Democrats and their comrades in the mainstream media are corrupting the legal process and weaponizing the justice system in order to manipulate public opinion, because they are clearly losing the political battle."

Meadows did not respond to ABC's request for comment and neither did an attorney representing him. Ratcliffe, O'Brien, Miller, Luna, McEntee and Cuccinelli did not respond to ABC's request for comment. An attorney representing Scavino declined to comment.

Some of the aides that have been ordered to testify have already appeared before the grand jury but did not answer some questions related to interactions with the former president, sources familiar with the matter told ABC News, and thus would now be required to return for additional testimony. The grand jury proceedings are being held under seal.

It's not clear the amount of information each of them would have, or the scope of what prosecutors want to question them on, the sources said.

ABC News previously reported that in February, prosecutors investigating Jan. 6 moved to compel testimony from a number of top Trump aides, including Meadows, Ratcliffe and O'Brien.

Previously, Judge Howell had rejected Trump's claim of executive privilege to block the testimony of two top aides to Vice President Pence, Greg Jacob and Marc Short. In rejecting Trump's motion to block the testimony of Jacob and Short, the judge ruled that it is up to the current president to assert executive privilege, not a former president, according to sources familiar with the proceedings.

The judge also previously ruled that former White House counsel Pat Cipollone, along with his deputy Pat Philbin, also had to return to the grand jury to answer additional questions after Trump previously argued they were protected by privilege.
