Yea but he would never be charged with murder.   He was attacked with a baseball bat and regardless of the beating he received, it will be self defense all the way.   Prob get a strong arm robbery charge but that would be the end of it

No, but he didn't just flick his nose.   He was chased with a baseball bat and he was struck.   An attorney would argue that his life was in danger.   Would end up being a plea bargain but def not a murder charge
