He's good enough, he's smart enough, but doggone it — he just can't keep his eyes open for Senate confirmation hearings.

Al Franken, the onetime comedian and current Democratic senator from Minnesota, used his position on the vaunted Judiciary Committee on Tuesday to doodle a lifelike bust of Sen. Jeff Sessions, the committee's ranking Republican, as Sessions raked Supreme Court nominee Elena Kagan over the coals.

But it wasn't all fun and games for the former "Saturday Night Live" star — Franken also found time to get in a good nap during the first day of hearings Monday.

Live video from Senate chambers shows a woozy Franken getting some much-needed shuteye as Kagan explains her intellectual approach to life and teachings in her opening statement to the Senate.

But Franken, the most junior member of the Judiciary Committee, had already been forced to sit through an endless round of statements from his senior colleagues on the 19-member panel as they droned on and on and on in the crowded Washington chamber.

When it finally came time for Kagan herself to speak, Franken had apparently had enough.

"I've learned that we make progress by listening to each other," said Kagan hopefully, as Franken slowly closed his eyes and appeared to doze off.

"I've learned that we come closest to getting things right when we approach every person and every issue with an open mind," she said, Franken now apparently lost to the living.

Kagan herself has expressed a profound scorn for Senate confirmation hearings, which she described as empty "lessons of cynicism" — a "vapid and hollow charade" that replace important legal discussions with repetitive platitudes.

It is unclear whether Franken shares that sentiment about the hearings or was simply bored by the proceedings. Sen. Franken's office did not return calls or e-mails seeking comment.

Kagan's questioning will continue for a third day on Thursday morning.

Agreed - i trained a girl once when I was a PT who was an actress.  Then one day she breaks out in song and I am like WWTTFF? ? ?

Another time, she showed me some dance moves she had, etc.

Franken Apologizes for Irritating GOP Leader

Sen. Al Franken has apologized for being rude to Sen. Mitch McConnell as the Senate's top Republican was winding up a solemn debate on the nomination of Elena Kagan to the Supreme Court.

Franken was presiding over the Senate as McConnell explained his opposition to the nominee. A Senate GOP aide said Franken made theatrical gestures and whispered under his breath as McConnell spoke. It was distracting enough that McConnell went up to the former comedian afterward and said, "This isn't 'Saturday Night Live', Al."

The aide spoke on condition of anonymity because of the sensitivity of the situation.

Franken later went to McConnell's office to try to apologize. McConnell wasn't there, so Franken delivered a handwritten apology.

(CNN) -- Sen. Al Franken apologized Thursday after Senate Republican Leader Mitch McConnell complained he mocked him while the latter was delivering a speech opposing Supreme Court nominee Elena Kagan.

Franken, a Minnesota Democrat, was presiding over the Senate at the time of the speech, a McConnell aide confirmed to CNN.
"This isn't 'Saturday Night Live,' Al," McConnell warned the former star of the comedy program moments later, according to the McConnell aide who asked not to be identified.

Franken was clearly moved by the confrontation, which occurred in the Senate chamber.

Moments after the vote, he approached a group of CNN reporters standing in a Senate hallway and asked for directions to McConnell's office.
Shortly after, Franken delivered a note to McConnell apologizing for any disrespect, the aide said.

"The leader thought I was disrespectful while he was giving his speech on General Kagan," Franken said in a statement provided to CNN.
"He is entitled to give his speech with the presiding officer just listening respectfully. I went directly to his office after I was done presiding to apologize in person. He wasn't there, so I've sent him a handwritten note."

Al Franken isn’t a punch line in the Sen­ate any­more. He’s emerged as one of the Demo­crats’ most ag­gress­ive and ef­fect­ive ques­tion­ers of Pres­id­ent Trump’s Cab­in­et nom­in­ees. He’s gen­er­ated nu­mer­ous made-for-TV clips as one of the few Demo­crats will­ing to go full-bore against his party’s top tar­gets—Jeff Ses­sions, Tom Price, and Betsy De­Vos. He’s fi­nally show­ing some per­son­al­ity in the Sen­ate, punc­tu­ated by his laugh-out-loud ex­change with En­ergy Sec­ret­ary-des­ig­nate Rick Perry. And he’ll be one of nine Demo­crats on the Ju­di­ciary Com­mit­tee ques­tion­ing Trump’s Su­preme Court nom­in­ee, Neil Gor­such. This is Al Franken’s mo­ment in the spot­light, and if he chooses, he could par­lay his good for­tune in­to a bid for the pres­id­ency in 2020.

To be sure, Franken, 65, may not be the Demo­crats’ strongest can­did­ate in the gen­er­al elec­tion. His deeply lib­er­al polit­ics and long-stand­ing dis­missive­ness of Re­pub­lic­ans turn off many voters in the middle. But with Demo­crats look­ing for strident op­pos­i­tion to Trump in the early days of his pres­id­ency, they’re prob­ably not go­ing to be in a prag­mat­ic mood in the primar­ies. So far, much of the lib­er­al ex­cite­ment has centered around Sens. Eliza­beth War­ren and Bernie Sanders, but they will be 71 and 79, re­spect­ively, dur­ing the gen­er­al elec­tion. Neither has shown any abil­ity to win sup­port out­side the most pro­gress­ive pre­cincts. Franken, at least, can point to a re­cord of elect­ab­il­ity with groups that Demo­crats will need to win over.

I ex­per­i­enced Franken’s polit­ic­al po­ten­tial firsthand after trav­el­ing to Min­nesota to cov­er his reelec­tion bid in 2014. That year, Re­pub­lic­ans swept nearly every com­pet­it­ive Sen­ate race—even giv­ing Sen. Mark Warner a run for his money in Vir­gin­ia. But Franken com­fort­ably pre­vailed against a well-fun­ded GOP busi­ness­man, one of the few tar­geted Demo­crats to run against the tide. He ac­com­plished that by win­ning the rur­al, work­ing-class Iron Range, an area that swung dra­mat­ic­ally to Trump last Novem­ber. Like Trump, he cham­pioned buy-Amer­ic­an le­gis­la­tion for iron and steel com­pan­ies, and helped se­cure new trade pro­tec­tions and tar­iffs against Chinese steel. A Franken ad­viser told Na­tion­al Journ­al he’s likely to find “some com­mon ground” with Trump on trade is­sues. He’s akin to Sen. Sher­rod Brown of Ohio, with more star power to ex­cite the mil­len­ni­als and non­whites who make up so much of the Demo­crat­ic Party’s base.

Franken’s biggest vul­ner­ab­il­ity was that he was bet­ter known for his com­ic turns on Sat­urday Night Live than for his le­gis­lat­ive re­cord. But he’s no or­din­ary comedi­an: He went to the pres­ti­gi­ous Blake School in Min­nesota and gradu­ated from Har­vard. And in the age of Trump, be­ing a tele­vi­sion celebrity isn’t nearly the vul­ner­ab­il­ity that it once seemed. His hand­lers took great pains to avoid the me­dia dur­ing his first term, avoid­ing in­ter­views with Wash­ing­ton-based re­port­ers. But these days, Franken is act­ing a lot more au­then­tic­ally, with his propensity to light­en the mood dur­ing tense hear­ings as com­mon as his hair-trig­ger tem­per.

Franken is com­ing out with a mem­oir this year on Me­mori­al Day, an­oth­er sign he’ll be get­ting more at­ten­tion in the months to come. A Franken spokes­man said the sen­at­or re­mains fo­cused on Min­nesota, and brushed off any spec­u­la­tion about a fu­ture pres­id­en­tial cam­paign. But with many Demo­crats ar­guing that they need their own fam­ous face to chal­lenge Trump, Franken fits the bill as well as any­one.

OBSERVATIONS ON THE GORSUCH HEARING, PART TWO — AL FRANKEN STRIKES OUT

Sen. Al Franken has become something of a hero to the left because it was in response to one of his questions that Attorney General Sessions said he “did not have communications with the Russians.” Franken never asked Sessions whether he had. Instead, Sessions volunteered this information.

So this wasn’t Al Franken getting Sessions to misstate something in response to withering questions; this was dumb luck. (It is also lucky for Franken that his admirers in the mainstream media aren’t pointing out the context of Sessions’ answer; he was talking about conversations in his capacity as a “surrogate” for Trump.)

Today, Franken didn’t get lucky. He came up empty. His questioning of Neil Gorsuch was farcical.

Franken began by asking Judge Gorsuch about his dissent in TransAm Trucking v. Administrative Review Board (discussed by Ed Whelan here). This is the one case the Democrats have found out of the nearly 3,000 Gorsuch has decided that they think they can hammer him on. Because Gorsuch resisted allowing hard facts to make bad law, it’s easy to attack him by emphasizing the hard facts.

This is what Franken did. But two other Democratic Senators had already pursued the same line of questioning. By rehashing the case, Franken was just wasting everyone’s time.

After that, things got weird. Franken wanted to talk about the treatment of Judge Merrick Garland by Senate Republicans. He mentioned that when he asked Gorsuch, during the office visit, whether he thought Garland had been treated fairly, Gorsuch declined to answer because this is a political type question, and he tries to avoid politics.

Franken said he accepted this answer at the time, only to learn that Gorsuch has been involved in politics. He cited Gorsuch’s work for the Bush campaign in 2004, and noted that Gorsuch touted this work when he later sought a position in the Bush Justice Department. He also said that Gorsuch is knowledgeable about past confirmation battles.

Having taken pains, and a fair amount of time, to show that Gorsuch isn’t a stranger to politics, Franken returned to Judge Garland. Why, given his past involvement in politics, couldn’t Gorsuch opine on the treatment of Garland?

Gorsuch exploded that balloon with a simple answer: he’s a judge now, and judge’s shouldn’t opine on political questions.

Strike one.

Franken’s next line of questioning was ridiculous. Returning to the 2004 election, Franken noted that Gorsuch worked on the team of lawyers that assisted the Bush campaign in Ohio. He noted that in Ohio that year, Republicans arranged for the issue of gay marriage to be on the ballot. Franken said (correctly, I think) that they did this in the hope of maximizing turnout by social conservatives.

Franken views this as an outrage — as if there’s something immoral about letting Ohioans vote on gay marriage. But Gorsuch was just part of a team of lawyers helping in Ohio towards the end of the campaign. He had nothing to do with the strategy of putting gay marriage on the ballot.

Franken tried to get around this problem by noting that Gorsuch was a law school friend of Ken Mehlman, who, apparently was behind the Ohio gambit. So what? Friend or not, Gorsuch isn’t responsible for strategic campaign decisions made by Mehlman.

Getting nowhere slowly, and seeking an exit, Franken asked Gorsuch about his view on gay marriage. As he had in response to this sort of question all day — and as the last six Supreme Court nominees (at least) have done — Gorsuch declined to answer a question that has implications for how he might vote in a future case.

Strike Two.

Franken’s last line of questioning was about statements made by Reince Priebus at C-PAC last month. Priebus apparently made some comment about how having Judge Gorsuch on the Supreme Court will enable conservatives to win cases for the next 40 years, or maybe reverse 40 years of bad law — it wasn’t clear which, at least in Franken’s telling.

Franken then asked Gorsuch what Priebus meant by his statement.

We all know that Franken isn’t a lawyer. But you don’t need to be one to understand the foolishness of asking a witness what another person’s statement means.

Straining, or so it seemed, not to laugh at Franken, Gorsuch delivered the obvious answer: Franken should ask Priebus.

Strike three.

Franken gave it the old junior high school try today. Maybe that will be enough to keep his base happy. If so, his base has very low standards.

Ok, I get he won back win the Dems were stomping on Republicans because of GWB, but sheesh, how is he STILL in office?

The guy is a complete MORON.

The idea he thinks he could run for President is so laughable.



Yep.  Electing someone like him is bad enough, but reelecting him might be worse.  The problem is once one of these duds gets in office, the power of the incumbency helps propel them to reelection.  That's partly why we need term limits.

Good point, but I think he's actually quite a smart guy despite being a bit of a doofus.
I think he got a perfect  score on the math part of the SAT back in high school.

Regardless, name recognition is a huge part of political success.
I know plenty of obscure, decent, smart people that would be great in office.
Sadly, those who get the money and media coverage get elected.

Embattled Democratic senator from Minnesota says while some of the sexual misconduct allegations against him are not true, he cannot be an effective voice for his constituents while under ethics investigation.

Calling it “the worst day of his political life,” Minnesota Democratic Sen. Al Franken said Thursday he will resign from the U.S. Senate following a wave of sexual misconduct allegations against him that ranged from groping to forcibly trying to kiss women.

Franken, who said that some of the complaints against him were “simply not true” and that he remembers others “differently,” also took a parting shot at President Trump.

“There is some irony in the fact that I am leaving office while a man who has bragged on tape about his history of sexual assault sits in the Oval Office,” he said during his 11-minute speech from the Senate floor.

About 18 Democratic senators, staff and family members were on hand for the announcement. Some sat stone-faced while others cried. His staff were lined up in the back of the chamber.

Alaska Sen. Dan Sullivan was the only Republican senator present.

New York Sen. Kirsten Gillibrand and Minnesota Sen. Amy Klobuchar were also in attendance. They were among the lengthy list of Democrats pressuring Franken to resign.

“As he and I discussed yesterday, this is the right decision,” Klobuchar said in a statement.

It will be up to Minnesota Democratic Gov. Mark Dayton to appoint a successor. 

Multiple sources reported that the likely candidate could be Democratic Lt. Gov. Tina Smith, a close ally of Franken. The successor would serve until a special election is held in 2018 to determine who would fill the final two years of Franken’s term.

On Wednesday, Franken faced a tidal wave of resignation calls by members of his own party.

By mid-afternoon, 23 of them wanted him gone. By Thursday, the number had grown to 36.

“Enough is enough,” Gillibrand said Wednesday.

Her sentiment was echoed by Sens. Kamala Harris of California, Marie Hirono of Hawaii, Claire McCaskill of Missouri, Tammy Baldwin of Wisconsin, Maria Cantwell of Washington, Debbie Stabenow of Michigan, Maggie Hassan of New Hampshire, Tammy Duckworth of Illinois and Heidi Heitkamp of North Dakota.

“Sexual harassment and misconduct should not be allowed by anyone and should not occur anywhere. I believe the best thing for Senator Franken to do is step down,” Harris, D-Calif., said.

Hassan, D-N.H., tweeted, “It is clear that Al Franken has engaged in a pattern of egregious and unacceptable behavior toward women. He should resign."

Senate Majority Leader Mitch McConnell, a Republican, weighed in.

At least 10 Democratic senators are now calling on the lawmaker to resign.
“It now appears Senator Franken has lost the support of his colleagues, and most importantly, his constituents,” McConnell said.

“I do not believe he can effectively serve the people of Minnesota in the U.S. Senate any longer,” he added.

The Minneapolis Star Tribune, the largest newspaper in Franken’s home state, called for his immediate resignation late Wednesday. They questioned his ability to “function effectively” after “losing the confidence of so many colleagues.

“If this is to be an actual turning point in our culture, there must be real and lasting consequences to behaviors that never should have been accepted,” the editorial board wrote. “That these incidents came so late in Franken’s life should make him all the more accountable. Instead, he has mostly offered hollow apologies that failed to acknowledge what happened.”

Franken’s political career has been in peril since California radio broadcaster Leeann Tweeden posted a blog detailing how he kissed and groped her without her consent in 2006. She also tweeted a picture showing a grinning Franken standing over her as she sleeps, his hands over her breasts.

Franken has since apologized, but other allegations from seven additional women have surfaced since Tweeden’s claims.

The latest was a woman who claimed she was groped at a Media Matters party during the first Obama inauguration.

Before that, another woman accused Franken of forcibly trying to kiss her – this time after a taping of his radio show in 2006.

The woman, who spoke to Politico, claims Franken pursued her after her boss had left and she was collecting her things. The woman was in her 20s at the time.

The accuser, who was not identified, said Franken tried to kiss her but that she ducked.

Franken, a former "Saturday Night Live" performer who was a host on the now-defunct "Air America" radio network at the time, allegedly followed up by telling her it was his “right as an entertainer.”

“He was between me and the door and he was coming at me to kiss me,” she told Politico. “It was very quick and I think my brain had to work really hard to be like ‘Wait, what is happening?’ But I knew whatever was happening was not right and I ducked.”

Franken has strongly denied those allegations.

The calls for Franken to step down came after Rep. John Conyers, D-Mich., retired following numerous allegations of sexual misconduct against him.

In Alabama, several women have accused Senate Republican candidate Roy Moore of sexual misconduct when they were in their teens, including one who said she was 14 when Moore molested her.

Moore denies the allegations.

President Trump – who had multiple allegations of sexual harassment against himself when running for president – has endorsed Moore.

The Republican National Committee is also supporting him.

Minnesota Lt. Gov. Smith named to fill Franken Senate seat

Minnesota Lt. Gov. Tina Smith was appointed Wednesday to temporarily fill the Senate seat of Democratic Sen. Al Franken, who resigned amid allegations of sexual misconduct and pressure within his party to leave office.

“It will be my great honor to serve Minnesota as United States senator,” Smith said in accepting the appointment. “I am resolved to do everything I can to move Minnesota forward. … This is a difficult moment for us. But even now, I am filled with optimism for Minnesota.” 

Smith, a Democrat, was appointed by Democratic Gov. Mark Dayton and will serve until a special election next year to complete Franken’s term, ending in 2020.

“I want to appoint the person whom I believe will best represent the people of Minnesota in the Senate,” Dayton said in making the announcement. “She has impeccable integrity and the highest personal and professional standards. She will be a senator of whom all Minnesotans will be proud.”

Dayton was under pressure from Washington Democrats to appoint a replacement who would run in 2018. And Smith said Tuesday that she indeed would run next year to keep the seat.

The 59-year-old Smith is a former General Mills executive who in the 1990s started her own marketing and political consulting firm. She eventually managed Walter Mondale's unsuccessful 2002 Senate run and the failed 1998 bid for governor of Mondale's son, Ted.

She also served in the early 2000s as a vice president of external affairs for Planned Parenthood Minnesota, North Dakota and South Dakota. Smith later served as chief of staff to Minneapolis Mayor R.T. Rybak before taking the same job with Dayton.

The special election for Franken's seat is expected to be an expensive race and a hotly contested race for a swing seat.

Republicans have already floated the possibility that former two-term Gov. Tim Pawlenty will run, giving them a widely known candidate who can raise plenty of money.

In a sign of Pawlenty's potential political strength, a top Democratic-allied interest group, Alliance for a Better Minnesota, last month paid for a poll attacking him at a time when he was said to be considering a run for governor.

Franken has not said exactly when he will leave the Senate; he announced last week he will resign after another allegation and calls from several female Democratic senators for him to step down.

Some Democrats questioned why he was forced out without a full investigation.

Zephyr Teachout, a Democrat who ran for governor of New York, said in an op-ed in the New York Times that she was left with a sense of that "something went wrong" when Franken announced he was stepping down.

"Zero tolerance (of sexual misconduct) should go hand in hand with two other things: due process and proportionality," Teachout wrote. "Both were missing in the hasty call for Senator Franken's resignation."

Numerous women accused Franken of groping and kissing them without their consent, before he eventually announced his resignation.

Franken, in his resignation speech, said he was "aware that there is some irony in the fact that I am leaving" while President Trump remains in office amid past sexual misconduct allegations being brought up against him.

At least four senators want Sen. Al Franken (D-MN) to rethink his resignation from Congress, including two senators who issued statements calling for Franken to step down two weeks ago, according to a report.

Sen. Joe Manchin (D-WV), one of the senators who did not call for Franken to resign from Congress until he went through an Ethics Committee investigation, said what the Democrats did to Franken was “atrocious” and “hypocritical.”

“What they did to Al was atrocious, the Democrats,” Manchin told Politico. “The most hypocritical thing I’ve ever seen done to a human being — and then have enough guts to sit on the floor, watch him give his speech and go over and hug him? That’s hypocrisy at the highest level I’ve ever seen in my life. Made me sick.”

Other senators privately said that they think calling for Franken’s resignation was premature.

Sen. Patrick Leahy (D-VT), who publicly called for the Minnesota Democrat to step down, told Franken privately that he regrets his statement.

A third senator, who declined to be identified because of how politically sensitive the issue is among Democrats, also regretted calling for Franken’s ouster.

“I think we acted prematurely, before we had all the facts,” said a third senator who has also called for the resignation, and has since expressed regret directly to Franken. “In retrospect, I think we acted too fast.”

Two of the senators who called for Franken to step aside told Politico that they felt rushed to comment on the issue as other meetings and hearings distracted them from giving their full attention to the situation while more Democrats piled on Franken.

Franken, along with several other senators, called for an ethics investigation into his behavior as allegations of sexual misconduct surfaced.

The first allegation of sexual misconduct emerged after veteran radio journalist Leeann Tweeden accused Franken of groping her breasts while she slept and shoving his tongue down her throat without permission in 2006.

At least two other accusers who came forward accused the Minnesota Democrat of groping them while posing for photos when he was in office.

Democrats stopped calling for the ethics investigation and immediately called for his resignation after the eighth accuser came forward. Franken obliged and announced that he would resign “in the coming weeks.”

It appears that despite some Democrats calling for Franken to reconsider his resignation, the Minnesota senator has not changed his mind about resigning from his position.

Minnesota Gov. Mark Dayton announced that Lt. Gov. Tina Smith would be appointed to Franken’s seat, and Franken said he was working with Smith on the transition.

The allegations against Franken prompted numerous Democrats in the Senate to call for his resignation. The Senate Ethics Committee launched a probe into the allegations last month.

In a defiant speech on the Senate floor earlier this month, Franken said he was confident that the ethics investigation would clear his name. But he said that he could not adequately represent his constituents while going through the Ethics Committee process, and announced that he would resign "in the coming weeks."

“I may be resigning my seat, but I am not giving up my voice. I will continue to stand up for the things I believe in as a citizen and as an activist,” he said. “The Minnesotans deserve a senator who can focus with all her energy on addressing the challenges they face every day.”

A number of prominent men in politics, business, media and beyond have faced allegations of sexual misconduct in recent months. In the days surrounding Franken's resignation announcement, two other lawmakers, Reps. John Conyers Jr. (D-Mich.) and Trent Franks (R-Ariz.), said they would step down from Congress in the face of allegations.

Franken said earlier Wednesday that he would deliver a series of speeches on the Senate floor before he leaves the chamber.

Minnesota Gov. Mark Dayton, a Democrat, has tapped the state’s Democratic lieutenant governor, Tina Smith, to temporarily fill Franken’s Senate seat once he leaves the chamber.
