A Nebraska widower is suing Wal-Mart (WMT +0.68%) and the company that makes its plastic bags, claiming one bag that couldn't do the job set off a tragic series of events that ultimately led to his wife's death.

The Wal-Mart cashier put all the items into one plastic bag, which broke as Freis was walking to her car. According to the lawsuit, one can of La Choy fell on Freis' foot, broke her toe and made a deep gash.

That break in the skin led to a serious infection that could not be banished even after two surgeries and many treatments of antibiotics, the lawsuit said, according to The Journal Star. Freis died in March 2011.

Her widower, William Freis, is now suing for about $650,000, saying Wal-Mart didn't properly train its workers to fill bags. He is also suing the maker and distributor of the bags.

First off I have never sued anyone in my life. I am not sure why you think they should not sue. Both parties are to blame, Walmart and the bag company. If the lady had overloaded the bag herself that is a different story. And if she just received a minor bruise that left no lasting effect on her body. But there was definitely neglegance involved here. I find it hard to believe you wouldn't go after them if it happened to your wife.

I don't want to speak ill of the dead but she accepted the bag and the manner in which it was packed when she chose to carry it to the car.  She also selected footwear unfit for the potentially lethal task of carrying groceries. 

Ultimately, it's up to the individual to protect him/herself.

I think it has merit.  I have been given bags that have had holes in them and items fall out and break.  I could easily see someone getting hurt over this.   They should not have such problems with their bags.  I support this lawsuit.

Damn at first I shrigged it off as a simple tort claim.

This could go somewhere. Product liability claim, respondenent supuerior claim. If these bags are not made properly (some standard...trade usage) this attorney has a shitty case that he turned into something with legs.

WM only settles 5% of slip and falls....product liability is a much bigger and wealthier fish.

They're going to fight this one off. Or else there's going to be a dramatic increase of plastic bag failures and law suits. Ridiculous.

Top lawyers, lots of lawyers, and lawyers that put in regular 80hr work weeks.

Most important....lots of money to drag the lawsuit out, appeal a decision, etc.

Lawyers are looking for a quick settlement, which even when you have direct evidence (man slips on oil in car dept. because no employee cleaned it up or put a sign out) you're rarely going to get.

I do.  I actually like black people.  Just because I despise some of the culture they have created and some that choose to adhere to it, does not mean I dislike all of them.

For instance, I bet you don`t buy into the ALL of the black culture thing and I am willing to bet you don`t like a lot of it either.
