San Francisco Couple Threatened With $1,500 Fine For Parking On Their Own Driveway

A San Francisco couple in the Noe Valley neighborhood of San Francisco are facing a heavy fine after being told that their parking pad actually breaks code.
ABC 7 News reports that Judy and Ed Craine are being forced to park on the city’s steep streets now that they have been told by the city to stop parking on their driveway after 36 years using the pad. The city says, though, that the spot violates a code section banning vehicles in a setback in front of a house.
The code was enacted for aesthetic reasons, according to Dan Sider, the chief of the San Francisco Planning Department. Although it’s okay to park in front of a garage, it’s a violation to park in front of a house even if the car doesn’t block a driveway so that “front yards don’t turn into parking lots,” Sider told ABC 7 News.
Sider said the city sent the Craines and two of their neighbors an email about the violation following an anonymous tip. Unfortunately for the couple, if they’re found to be using the spot again, they will be fined $1,542 plus another $250 a day for every additional day their car is on the car pad, much to their chagrin.
“Why are you taking away something that has great utility?” said Ed Craine. “To all of a sudden to be told you can’t use something that we could use for years. It’s, it’s startling. Inexplicable.”
Fortunately, there is a glimmer of hope. The Craines were told that their car pad could be grandfathered in if they could find a photo of the spot being used historically. The couple were happy to oblige and sent the Planning Department a photo of theirs from 34 years ago with their car in the lot. Frustratingly, though, this was deemed not to be old enough.

What’s even more astounding, is that they’ll do nothing about it, and even worse, continue to live in a place that treats them like that all while letting people shit on the streets. They should be grateful that the city doesn’t make them put up a tent for the homeless on the driveway.

Or if you actually want to stick it to the council, get everyone to plonk down a garden gnome holding a note of support. "Let my people park!" Etc. 10s of thousands of grim visaged gnomes standing in solidarity on the front lawn. Gnome Army would trend. Politicians and bureaucrats would fear the Gnome Army.

typical bullshit. a woman in my town had stage 4 cancer and couldn't afford to get her roof fixed. so she asked the town if they could help her out. their solution was, they said that they would fine her 500 dollars a day after a certain date if it wasn't fixed because they considered it a blighted property. luckily some woman in another state heard the story and arranged for everything to be taken care of for free. now the woman can live her few remaining days in her childhood home.

Anyways, I think it’s great ... cars & garages should be kept in the back of the lot, as they are in other civilized cities. If you got a problem with that, move to the suburbs

I've done some.charity.roofing. I might do some more if another little old lady is in the shit but:
1, wtf you been doing for the last 80 years that I have to buy the materials for you and install them for free?
2, You're dead real soon, so I'm basically giving your heirs my money because you're in a dire circumstance. And where are those heirs of yours while the rain is coming in on their mom's head?

Apparently the person that owned the house before him never used their own driveway and allowed the neighbor to use it for years even though it's not her property. So when my brother took ownership of the home she refused to stop parking on his driveway. She even hired a lawyer and went to court and won. WTF! He buys a house and can't park on his own driveway when the neighbor has rights to it?

Even if the courts allowed you to park on your neighbor's driveway daily I can't imagine it would be a good idea to do so. Having a neighbor pissed off at you just leads to needless headaches and agitations. I'm sure your brother found a way to get back at them. Most people would.

The city is a machine not a person, it cares not.
When the social credit score comes out people like this will be fined and shamed and those who speak out will be shamed. If a govt fines 2 people it doesn’t want 1,000,000 other people being outraged over shit that doesn’t concern them so it’ll hit the lot of you with a nasty point reduction.
The lesson learned behaviour wise is people will mind their own business and looking at China it works in that regard.

I’d look into suing my Title company who helped close the loan. That should have been caught prior if it was really a thing. Fuck that bitch.

I've worked in residential land development for a long time in 17 different states.
The majority of development codes have the setback for the garage further forward than the house setback by 10-feet. It all depends on the zoning. Even the multi-million dollar houses are like this.
Some older parts of town will grandfather the garage setbacks just to keep consistency, but newly developed areas have changed.
So, the days of building garages in the back of the lot have gone the way of the dodo a very long time ago.

Property rights are weird.
My younger brother bought an old house in a rural area.
When they were rebuilding the fence around the property, they noticed the fence was built 7-feet inside their property. When they tried to move the fence to the original property line, the neighbor hired a lawyer and went to court.
My brother lost and they re-titled his lot to exclude that 7-foot strip.
It's a weird situation.

It happens all the time.
Just wait until you get into a situation where squatters move into your home/property. There is a time period you have to formally evict them before they have a right to be there. Happens with rental properties all the time.
Squatters' rights vary state to state, but when someone is using your property for a certain amount of time, they do have rights to it.
I've seen a case where a person had to pay a maintenance fee to his neighbor because the fence was 1-foot on his property. His neighbors had maintained and improved the landscaping to that 1-foot strip over a period of 15 years.
Another case an old man allowed a couple to setup a trailer on his property for like 20 years and when he went to try and remove them, the County granted the people rights to stay on that section of land. So, he couldn't sell it because that section of land became a shared access easement, and there was no way to access his tract anymore.
This is why you never let anyone use your property for any reason.
