"The View" co-host Joy Behar said Thursday that she didn't know a luckier person than former President Donald Trump and said President Biden's classified documents appeared just as "we were this close" to getting Trump.
"I've never seen a luckier person than Donald Trump," Behar declared. "Just as we're this close to getting him, somehow these documents appear," appearing to suggest they were planted.
Co-host Alyssa Farah Griffin argued that Biden was "building" Trump's defense for him and added that he was "wrong to have done this."
"He is wrong," co-host Sunny Hostin agreed.
Co-host Whoopi Goldberg emphasized waiting to find out "what this is" first.

Between Trump's absconding and initially refusing to turn over at least 300 classified documents and the recent discovery of and reporting of several classified documents in two separate locations by Biden's own lawyers, it is obvious that some changes are needed to better protect the handling of these classified government documents. My suggestion is that in the future, no classified documents of this type be allowed to be removed from government secured locations, including the Whitehouse. I can think of no-good reason for former presidents and vice-presidents having possession of these and other government documents after leaving office.

I agree to some extent. But classified can mean many different things. For expedience some classified documents are sent via secured lines to various individuals. Confidential is considered classified but may not rise to the level of the security measures of Secret and Top Secret. But for petes sake, NONE of these documents should be left in closets or garages. Ive been seeing on news channels on both sides of the spectrum that mishandling is not uncommon. Every president probably stashes away classified documents. The chances of any president being successfully prosecuted for pilfering them are infinitesimal. Nevertheless, now that we’ve learned Joe Biden has engaged in the same behavior as Donald Trump — perhaps worse, considering vice presidents are afforded less leeway on classified documents — precedent and transparency, our very democracy, demand Attorney General Merrick Garland name a special counsel to investigate (I get results!)
Right now, none of the rationalizations offered by the media for Biden’s actions over the past few days are operational. When the story first broke, outlets stressed that one of the vital “distinctions” between the two incidents was that Biden was in possession of fewer documents than Trump. Biden aides, we learned, had been utterly shocked to discover only a “small number” of classified documents “locked” in the personal offices of the president’s “think tank” — as if the location or the number of documents, or the alleged lock, rather than the contents, were the most newsworthy aspect of the story.
Today, we learned that a second “batch” of classified documents was uncovered at an “undisclosed” location. Suddenly, everything got incredibly vague. Biden aides, we are told, began diligently rummaging through boxes to ensure they were in complete compliance with the law. A completely independent source told collusion-hoaxer Ken Dilanian that the “search was described as exhaustive, with the goal of getting a full accounting of all classified documents that may have inadvertently been packed in boxes when Biden cleared out of the vice president’s office space in January 2017.” It’s heartening to know that the Bidens are such diligent, law-abiding folk.
Yesterday, we were told that classified documents that are found in a serious office setting, rather than just “lying around” in a home, was an important difference between the two cases. Today, Biden’s lawyer says that “small number” of classified documents was also found “locked” in Biden’s garage and an “adjacent” room of his Wilmington home. (Don’t worry, the president assures us it was safely stored next to his beloved Corvette.) You know, if we find another “small number” of documents, we might just have ourselves a full cache.
No doubt, journalists are super curious to know how those classified documents got into Joe’s garage. I mean, the guy had a think tank office at his disposal in D.C. Moreover, the initial documents were alleged to have been discovered before midterms, and yet we’re only hearing about new ones months later — and in convenient dribs and drabs.
Soon after CBS’s initial story, a four-byline puff piece from CNN reported that the documents found in the think tank were related to Ukraine, Iran, and the U.K., so not just keepsakes and letters and such. This week we also learned, in another soft-peddled report by The New York Times, that Biden, despite his insistence that he knew nothing about his son Hunter’s foreign entanglements, had met with a liaison from the Ukrainian energy interest Burisma, among many other revelations. Recall, Obama officials had also raised concerns about the Biden family business. Is there any chance those Ukrainian documents would have been embarrassing to the president? Seems a reasonable question.
What’s important now, we’re going to be instructed, is that Biden “immediately” contacted the authorities and is fully “cooperating.” Is it possible, and I’m just theorizing here, that Biden and his aides are lying? For one thing, cooperating is fine, but it’s not everything. Trump has every right to hire a lawyer and fight the Archives over documents. Maybe he’s got a case, maybe he doesn’t. But perhaps Biden also simply picked an opportune time to cooperate with his own administration in an effort to avoid any transparency. Far from “immediately” handing over this material, the president’s been in possession of classified documents for nearly seven years. How does the DOJ know there aren’t more documents stashed away? How does it know Biden, like Trump, didn’t put them in his garage on purpose? Because he says so?
Don’t get me wrong, it’s entertaining watching the comically obvious attempts to mitigate the damage. But if Biden hasn’t done anything wrong, he has absolutely nothing to fear.

There is no doubt in my mind that the mishandling of government documents has been a common occurrence. This is the only explanation for the sloppy and careless handling of them. It needs to stop, and strict guidelines put in place for all government documents regardless of the degree of classification.
I remember this also being true with the use of private cell phones for government business. Hilary used a Blackberry. The excuse offered was that she was familiar with its operation. Learning how to use new technology is not rocket science. If she learned how to operate a Blackberry, she could learn how to do the same with government issued equipment. Same with her misuse of email and having a personal server in her home.
I worked in public employment for 30 years. There are different guidelines for how various things are handled verses in the private sector, such as not accepting gifts from venders. The folks who ignored these things, ran the risk of being terminated and yet some broke the rules anyway.

Okay, technically what you said in your post is he cannot remove toilet paper, and this is correct. What toilet paper has to do with classified documents, I don’t know. But, since it is likely government owned, the President cannot remove it either. When former Presidents and their families vacate the white house at some point prior to the next President moving in, they take their personal property with them, anything else is government property and remains in the Whitehouse. Same as with the VP and the government property they occupied during their term in office.

The usual saying is, "the sins of the father" in this case it is the sins of the son... and there appears to be quite a goodly number of them. Your post pretty much covers every sin Hunter perpetuated whether they are relative to the discovery of these classified government documents or not. What is noteworthy is that from what the public has been told, Hunter Biden was likely not the most trustworthy person around.
There is a good possibility that Joe Biden didn't remember or know that he had six of these documents at his Wilmington home, (some say he is senile and senile people often forget these kinds of things). At this point we have no idea what information those six classified government documents contained. Whatever is in them could make a huge difference as to the possibility of a breach of security.
Again, Trump hoarded over 300 classified government documents at his Mar-a-Lago club and residence. The club members hail from all over the world... pretty much anyone who is willing to pay the fees. This is an environment where all manner of national security breaches might have occurred.
Lastly, I repeat, neither of these men should have been able to keep these documents because they technically do not belong to them. It would be interesting to know what each man hoped to do with them... write a book, sell them to a foreign country or flush them down their toilets.

Doesn't matter. Joe was the VP, not the president. He knew it was illegal to keep classified documents, but he did it anyway. He kept them for six years in a very insecure location. After the classified documents were found, the WH delayed disclosing that fact, and lied about the number of pages found.

Doesn't matter. Joe was the VP, not the president. He knew it was illegal to keep classified documents, but he did it anyway. He kept them for six years in a very insecure location. After the classified documents were found, the WH delayed disclosing that fact, and lied about the number of pages found.
Please explain why Joe being VP and not the President has any bearing on the retention of classified government documents. Keep in mind that once Joe Biden became president on January 20th, Trump became an ordinary citizen. Also consider that it is likely Joe Biden removed these documents when Obama was President. So, if he needed the Presidents authority to move them Obama would have been who gave it to Joe.

Any former president, vice president and a few others, by law, have access to all and any classified information in perpetuity by the nature of the position they held. But no one may remove classified information without proper authorization, including the president.

He held ultimate authority over classification issues until noon on January 20, 2021. In the wake of accusations that Joe Biden may have failed to report thousands of dollars in rental income on his taxes, it has been discovered that Joe Biden’s campaign surreptitiously removed some of his tax returns from its website.
As PJ Media previously reported, Hunter Biden claimed on a background check form to have paid his dad $49,910 a month in rent — a suspiciously high figure given the value of the home — while he was living at Joe’s Wilmington, Del., home from March 2017 to February 2018 following his divorce — the same house where Biden stashed classified documents in his garage next to his prized Corvette.
However, according to the Schedule E portion of his 2017 tax forms, Joe Biden reported $19,800 in “rents received” and none in 2018. This discrepancy could mean that Joe Biden failed to report more than half a million in income on his taxes.

Curiously, those documents are no longer available on his campaign website — while it appears that his tax returns are still posted to the website for public viewing, most of the files previously made available to the public have been removed. But Joe Biden made transparency a key issue of his campaign and presidency, never missing the opportunity to contrast his disclosing of his tax returns with Trump’s refusal to do so. The missing tax returns certainly raise significant questions. Most importantly, is this related to Hunter Biden? Let’s not forget that Hunter Biden has been under federal investigation for tax fraud, among other things. Did Hunter Biden report over half a million in rental payments to his father, but his father did not report that income? Or, if Hunter Biden’s rent claim was filed in error, as some are postulating, were the elder Biden’s tax documents removed
because of the investigation?

The White House and Justice Department (DOJ) reportedly agreed to hide President Joe Biden’s classified document scandal from the American people until it leaked to the press, despite their repeated claims of transparency.
Not only did the White House and DOJ try to obscure the scandal from public view, but they also refused to divulge that the second trove of classified documents were already unearthed at Biden’s home in Wilmington when CBS News first contacted the White House about the initial leak of classified documents apparently illegally stored at the Biden Penn Center, according to the Washington Post: “Early on, Biden’s attorneys and Justice Department investigators both thought they had a shared understanding about keeping the matter quiet,” the Post admitted, noting the Biden administration’s attempt to conceal revelations of the second trove of stashed documents.
“CBS News was the first news organization to learn of the matter, contacting the White House on Jan. 6 to ask about the Penn Biden Center documents,” the report continued. “White House officials confirmed the scoop, but since the investigation was ongoing, they decided not to offer any additional details — including the critical information that a second batch of documents had been discovered at Biden’s home.”
That the Biden administration tried to conceal the scandal contradicts their claims of transparency.
“There was transparency in doing what you’re supposed to do when these items were discovered,” White House press secretary Karine Jean-Pierre falsely claimed on January 12.
Since the Justice Department appointed a special prosecutor, the White House has provided little transparency. “I’m just going to continue to be prudent here. I’m going to let this ongoing review that is happening — this legal process that is happening — let that process continue under the special counsel. We’re not — I’m not — going to comment from here,” Jean-Pierre said Tuesday.
“Look, guys, you guys can ask me this 100 times, 200 times, if you wish. I’m going to keep saying the same thing,” she added. “I hear your question. It’s been asked. It’s been answered. It’s been noted.”
Critics have questioned why Biden’s personal attorneys were initially searching for Biden’s illegally stashed documents. The White House has failed to provide the initial reason or cause for the search.

The Justice Department has searched President Joe Biden’s home in Delaware and located six documents containing classification markings and also took possession of some of his notes, the president’s lawyer said Saturday.
Bob Bauer, a lawyer for the president, said the Justice Department conducted the search at Biden’s Wilmington residence on Friday. He said it lasted about 13 hours.
The Justice Department “took possession of materials it deemed within the scope of its inquiry, including six items consisting of documents with classification markings and surrounding materials, some of which were from the President’s service in the Senate and some of which were from his tenure as Vice President,” Bauer said in a statement.
The prosecutors also “took for further review personally handwritten notes from the vice-presidential years,” he said.

If you mean you have nothing to add, this makes sense because the part of the last line in this excerpt where it reads, "...the document discoveries, which have become a political headache for the president and complicated the Justice Department's probe into former President Donald Trump's retention of classified documents and official records after he left office" says it all.
If you want comments from the peanut gallery, these are my current thoughts on this; There is no doubt they are a political headache. Whoever advised Biden to keep mum about the documents previously discovered gave him bad advice. Furthermore, as soon as the documents were discovered in his home and the garage, he should have insisted on a thorough search of his property, which he obviously couldn't do himself as it would add suspicion of foul play. Although, since he is President, he has a security clearance at a level which would allow him to handle classified documents. It would have been better for the whole mess to have come out at one time rather that trickle out allowing the media a new news story each time more documents were found.
I posted this a couple of times already. Neither Biden nor Trump should have had classified documents in their personal possession at a time when neither of them was in office. It is clear that the handling and security of government classified documents needs to be seriously tightened.
My one other thought has to do with the FBI taking Biden's personal notes which I cannot imagine were classified. But then, the FBI took more than classified government documents from Mar-a-Lago according to the media and Trump. At least they are being consistent.

Trump made every effort early on to hide the fact he had documents. I think the boxes found in his bathroom and on a stage as well as information that he ordered his subordinates to hide them lie about them etc even after the documents were requested indicates a high level of culpability.
Bidens team initially reached out to the FBI about documents they had. This indicates cooperation. However, months down the road documents are still being found indicate a lack of competency in making sure all documents were returned. At some point consequences are in order.
I get that in the past Presidents and VP's had an apparent unspoken exception to the handling of classified documents f(Which I don't agree with). But at this point, Biden SHOULD have had a team sweep his offices and homes, or as Prime suggested, invited the FBI to search his properties to make sure. So let's let the chips fall where they may. The blockbuster article in The Washington Post saying President Donald Trump had "revealed highly classified information to the Russian foreign minister and ambassador in a White House meeting" didn’t just put the White House on the defensive. It also put Republican lawmakers in a tight spot.
One of the members of Congress who commented after the newspaper’s revelations was Sen. James Risch, R-Idaho. According to CNN, he told reporters, "The minute the president speaks about it to someone, he has the ability to declassify anything at any time without any process."
Is that accurate? Independent experts said Risch is on target concerning the legal powers of the president. Some experts added, however, that the senator’s formulation left out some context that is relevant for assessing Trump’s alleged actions.
The president’s classification and declassification powers are broad
Experts agreed that the president, as commander in chief, is ultimately responsible for classification and declassification. When people lower in the chain of command handle classification and declassification duties — which is usually how it’s done — it’s because they have been delegated to do so by the president directly, or by an appointee chosen by the president.
The majority ruling in the 1988 Supreme Court case Department of Navy vs. Egan — which addressed the legal recourse of a Navy employee who had been denied a security clearance — addresses this line of authority.
"The President, after all, is the ‘Commander in Chief of the Army and Navy of the United States’" according to Article II of the Constitution, the court’s majority wrote. "His authority to classify and control access to information bearing on national security ... flows primarily from this constitutional investment of power in the President, and exists quite apart from any explicit congressional grant."
Steven Aftergood, director of the Federation of American Scientists Project on Government Secrecy, said that such authority gives the president the authority to "classify and declassify at will."
In fact, Robert F. Turner, associate director of the University of Virginia's Center for National Security Law, said that "if Congress were to enact a statute seeking to limit the president’s authority to classify or declassify national security information, or to prohibit him from sharing certain kinds of information with Russia, it would raise serious separation of powers constitutional issues."
The official documents governing classification and declassification stem from executive orders. But even these executive orders aren’t necessarily binding on the president. The president is not "obliged to follow any procedures other than those that he himself has prescribed," Aftergood said. "And he can change those."
Indeed, the controlling executive order has been rewritten by multiple presidents. The current version of the order was issued by President Barack Obama in 2009.
The national-security experts at the blog Lawfare wrote in the wake of the Post’s revelation that the "infamous comment" by President Richard Nixon — that "when the president does it, that means that it is not illegal" — "is actually true about some things. Classified information is one of them. The nature of the system is that the president gets to disclose what he wants."

Setting aside ethics, doing what Trump is alleged to have done could have negative practical consequences for the United States. "It could wreck the underlying intelligence-sharing agreement and place the U.S. at a disadvantage," Aftergood said.
That said, the line between wise and unwise is a judgment call.
On the one hand, Turner agreed that alienating an ally by not following their orders "could have very serious consequences."
On the other hand, he said, it’s not outlandish to argue that sharing closely held information with Russia could advance, rather than hurt, national interests.
Turner said it may be "in America’s interest to cooperate with Russia in the struggle against ISIS, including sharing intelligence information that may help save Russian lives and seeking information that may save American lives and those of other potential victims of ISIS attacks. Obviously, in the process we will want to safeguard sources and methods that might weaken our ability to keep track of what President Putin is up to--as he is potentially a greater threat to our security than is ISIS. But the struggle against ISIS is an area where the United States and Russia have a shared interest."
In a statement to PolitiFact, Risch’s office said that criticism of the wisdom of Trump's action would be a personal opinion, but such sentiments would not speak to "the letter of the law."
"Sen. Risch can tell you that all former presidents of the United States spoke regularly with heads of states and discussed classified matter, if they determined it to be in the best interest of the American people," the statement said.

It is not clear to me why you included Trump’s comments on November 8, 2023, in a rally in Hialeah. Was this an error?
Though out your response you’ve relied on comments from people who have no legal authority but rather just opinions. I kind of get it though. Just as is most often the case with how government is run there is a large margin of error. Too many cooks spoil the soup kind of thing. The use of the word murky is apt when it comes to constitutional law.
All this is likely for nothing. Whether Trump had absolute authority to declassify the stolen documents, is not what will sink him. What is more likely is his constant shooting off his mouth both vocally and in his posts that will get him in the end. He is his own worst enemy.

My guess and hope is Dos understands much more than he is willing to admit to. I am unsure as to why I respond and comment on their posts. Interchanges with Dos are both challenging and a waste of time because he will never concede anything. The similarity between him and Coach is they've dug their feet so far into the mud nothing can get them out. They will take these arguments to their deathbed. More and more I see Dos as parroting Trump's comments. This is not a good sign that he can still think independently and with an open mind. I've moved past the hope of getting most of them to concede the most basic facts regarding politics. I rarely converse with most as it is a waste of time, like I said, Coach is entertainment. It's fun to see just how far he will go down the rabbit hole of ignorance.
I enjoy writing, always have. When I was in college, I took a theater arts class. I wrote weekly reviews for the little theater plays we saw. Attending local theatrical performances was the focus of the class. I also took business writing and creative writing, which was taught by a notable Oregon author, Craig Leslie. Oh and when not busy cleaning toilets, I wrote the specs for custodial equipment and supplies. I also wrote custodial training manuals which I believe the district still uses.
Now that I am retired, I probably have too much time to waste. Communicating with the folks on Getbig can be frustrating, but also entertaining and challenging. Over the many years I've been a member here, I've met some very interesting folks and made a few friends. To be fair, I have also made some enemies.
When posting on Getbig ceases to amuse me, I will stop. Periodically, I take a break if the tone of the posts become too negative because that is a real downer. Some folks might find it interesting that I am not particularly political in my offline life. As is often advised, it is better to not talk about politics and religion with people.
I believe the Trump years have changed this. He managed to completely change the political landscape… even though he didn’t ‘drain the swamp’ or erect a massive wall between the U.S. and Mexico plus make them pay for it. In this respect he is not dissimilar than most other politicians who make enormous promises to their constituents when campaigning and then not follow through with them.

My oldest and closest friend is a lifelong staunch Republican. She is a retired successful business owner, and a member and officer of the City Club of Portland which is primarily an organization of business owners. Although they describe themselves as a non-partisan organization, they tend to lean right. Today, she is an anti-Trump Republican and has been since he ran for office in 2016.
She, her partner, and I had only a few political discussions over the years, although they were never adversarial. One discussion I remember was about President Clinton. She was adamantly negative towards Clinton and strongly supported his being impeached following the Monica Lewinski affair. I maintained his personal life (the affair) was a matter to be resolved between Hilary and him and did not have bearing on his performance as President. She strongly supported President George W. Bush during that time.
I mention this to example Nancy’s strong moral and political views and how some lifelong Republicans feel about Donald Trump. My friend voted for Hilary Clinton in 2016 and President Biden in 2020 rather than elect someone like Trump into office. Without a doubt, she will not be voting for him as President in 2024 should he get that far.
Politics has greatly changed since Donald Trump came on the scene. He plays to and thus appeals to the far right and politically malcontent. He is a destructive influence on U.S. politics who surrounded himself with the worst of the worst and the weak who require someone to worship and who they feel best represent their negative viewpoints.
The U.S. is not currently in a good place, socially or politically. Thankfully everything cycles. I look forward to the time when most people 'woke up and smelled the coffee' and in doing so absolutely reject the likes of Donald Trump and his radical MAGA cult. When Trump falls, and he eventually will, he will fall hard as folks like him are apt to do.

Sam Harris is right on with regards to certain people. Debating these folks is a total waste of time. If I were to debate Alex Jones, would I end up buying 'The My Pillow?' Is he that persuasive? Use your common sense. If the POTUS is the only person in the country who can declassify any document (a fact), then he does not have to follow "procedures" imposed by some other person or entity. That would mean he is not the ultimate declassification authority. What you are reading refers to everyone except the POTUS.

WASHINGTON — Lawyers for former President Donald Trump said in a filing Tuesday night that they plan to file multiple motions to dismiss the criminal charges against him in the Mar-a-Lago classified documents case.
“Defendants currently plan to file on February 22, at minimum, a series of motions to dismiss the Superseding Indictment and certain of the charges therein,” Todd Blanche and Christopher Kise wrote in the newly filed motion, which seeks to extend certain deadlines in the case. The superseding indictment alleges Trump was involved in a scheme to delete security video at Mar-a-Lago, his estate in Palm Beach, Florida.
Trump's legal team added that the defense is "still evaluating potential motions" and that they could relate to presidential immunity, the Presidential Records Act, Trump's security clearances and "selective and vindictive prosecution," among other issues.
Trump’s defense team and prosecutors from special counsel Jack Smith's office have until Feb. 22 to file pretrial motions.
Trump’s lawyers argue in Wednesday’s filing that they should be allowed to file additional motions beyond the deadline based on any additional evidence they receive from the prosecution.
Trump’s team has filed several motions with U.S. District Judge Aileen Cannon, who's overseeing the case in Florida, seeking orders to compel evidence it claims is in the government’s possession.
