Appeals Court Upholds FDA Ephedra Ban
A federal appeals court has upheld the FDA ban on products containing the weight-loss supplement ephedra, reversing a Utah judge's ruling that prohibited enforcement of the prohibition against Park City-based Nutraceutical Corp.
A three-judge panel of the 10th U.S. Circuit Court of Appeals in Denver ruled Thursday that the U.S. Food and Drug Administration correctly followed a mandate from Congress to conduct a risk-benefit analysis to determine if a product presents an "unreasonable risk of illness or injury," The Salt Lake Tribune reported.
Ephedra, which was linked to dozens of deaths and thousands of reports of health problems such as heart attack or increased blood pressure, was banned by in 2004 by the FDA, which held that no dosage of the substance was safe.
However, U.S. District Judge Tena Campbell in Salt Lake City said last year that the FDA had not proved that ephedra was unsafe even at low doses and she ruled that the ban could not be enforced against supplements containing doses of ephedra up to 10 milligrams.
Jonathan Emord, attorney for Nutraceutical Corp., said Thursday the Utah company will seek a rehearing in front of the entire 10th Circuit.
The natural supplement industry fears the ruling could give the FDA broader power to yank products where it believes risks outweigh benefits, said Loren Israelsen, executive director of the Utah Natural Products Alliance.
"The worry is that the FDA can say to anyone, 'We don't like you, you're out of here,' " he said.
Elisa Odabashian, senior policy analyst at Consumers Union, publisher of Consumer Reports magazine, said the ban will save lives.
"This is just great news because the evidence is everywhere - ephedra is a killer," she said. "It revs you up, you feel great, you have no appetite. ... But with some people it causes heart palpitations, heart attacks and strokes."
The ban stemmed from studies which showed an increased risk of heart attacks, stroke and death, especially in users who have high blood pressure, heart disease or engage in strenuous exercise.
Since 1997, the amphetamine-like herb has been linked to 19,000 "adverse events" and dozens of deaths, including that of 23-year-old Baltimore Orioles pitcher Steve Bechler, who collapsed during a spring training workout.
In challenging the ban, Nutraceutical and its subsidiary Solaray Inc., argued that dried whole-herb ephedra sinica had been safely used for thousands of years.
Campbell held that in banning ephedra, even at low doses, the FDA was improperly shifted the burden of proving product safety from the government to supplement manufacturers.

the truth is... its not being banned due to killing people. its being banned becuase its the main chemical used to make cystal meth. with those supplements its very easy to make meth. thats why they now ask for id when buying otc those allergy pills or whatever contains it.

I'm sure that's exactly it. How can any legislature be so retarded as to think "hmmm, if we ban ephedra then all the meth heads will just disappear and become fine upstanding citizens." I can't believe we elect (and appoint) such anus holes.

ephedra isn't band because it kills a couple people... sure that raises public concern, but one of the real reasons is that it can easily (I use the phrase easily loosely) be converted to methaphetamine (crystal meth)...

psuedoephedrine has very different effects on your body than ephedrine... even the meth made from the psuedo form is much less potentant

Either way, you can still buy the herbal form online for a few more days I think - until the official pull date comes (probably early next week I would guess).

A friend of mine bought a bottle of ephedra and even though he hadn't used it yet he stiil had a heart attack.

most of us use synthetic ephedrine hcl...so I doubt this will affect that.

It just got banned and sales will end in a week or so. You can still get herbal in 10 mg doses (essentially the supp. companies made exactly 1/2 dose per pill - so take two pills and you have the original formula). I personally didn't buy any more - but just letting anybody know that they have a few days more to get in on it.

just got 1000 of these in the mail for 120 bucks.....came from the UK, white plastic screw top container with the pills hand packed in a plastic bag. no labels, no markings on pills....they're slightly smaller than the vasopro, however they're not purported to contain the guafenesen so....... :-\ we'll see i guess

ahh you should have gotten the smaller bottle till you knew how they work for you. I found they are under-dosed.
i'm not worried so much about the money, i'll at least make back what i paid for them off of my fat friends who are always clamoring for a "magic pill"
i'm probably gonna do a crush/taste test with my vasopro and see if i can tell a difference, i have no other real way of testing....maybe do it by dipping my pinky in it like i'm a cop on a cocaine bust

They are real. They are Pakistani Unexo ephedrines (unexo printed on the tab right?). I think they are actually 30mg. They work well for me and I think dosage is spot on. And I have used thousands and thousands of ephedrines so I know how I react.
yes, at first glance i looked through the powder-coated paper and didnt see any writing, but then i untied the bag and sure enough Unexo is printed on there. gonna try em tomorrow and see if i feel a difference. the only ephedrine i've used yet is vasopro
