Pg. 1 : Right so an addiction is not a criminal act. And therefore addicts shouldnt be criminalized. And if a person can support themselves and their addiction, then why does the government get to criminalize them.
Pg. 2 : Lohan didnt fuck up her probation at all. She didnt get caught for a 2nd dui while on probation for dui, she simply failed a drug test. If Lohan wants to drink and do coke, theres really no crime there. The crime is when she gets behind the wheel high.
And I'd guarantee you if the courts handled it differently the punishment would be taken much more seriously ie 'you can do all the drugs and alcohol you want, but if you get caught dwi again its one year in prison end of story'. I guarantee she wouldnt be driving. But instead we treat addiction as a part of the crime, so we offer rehab as opposed to jail so none of it is taken seriously.
It what people do to fuel their addiction...and what they do when they are addicted---and hell, what happens to their home life. I know of several "functioning" crack addicts, you wouldn't know unless they or their family pointed it out. But it effs with the family.
If Linsay's probation terms included the drug test and she effs that up...then she effed up...Period. Depending on how that Judicial system works, the Porbation officer can file a report to the judge and request a warrant, which I think the Judge did issue a warrant...Thus her effing up, cause a warrant to issue for her arrest.
Some states have Drug Courts, like Maryland, for habitual drug users. I don't know how well this helps the situation.
Basically, if people want to do coke and waht not, in essence there is no crime...but when a person is high, and get behind the wheel...well it's the fact they got high in the first place. Not getting high and not getting behind the wheel=not commiting a crime. Basically it comes down to being responsible, and let's face it. Americans are not responsible people. Just go to a 4 way stop and just watch the people. Just try teaching at any public school, just look around you, there are more irresponsible people than responsible...and these people NEED to be told what to do, they NEED structure, because the sad truth is if they didn't have it: They would Eff it all up.
I always wonder why is it that a society like like america has such a drug addiction, yet poor countries, don't have it as bad as we do?
