‘House of Cards’ Producer Wins $31 Million in Arbitration Against Kevin Spacey

An arbitrator has ordered Kevin Spacey and his companies to pay nearly $31 million to MRC, the production company behind “House of Cards,” after finding that Spacey breached his contract by violating the company’s sexual harassment policy.

MRC severed its relationship with Spacey and scrapped a season of the show in 2017, after multiple people came forward to allege a pattern of sexually predatory conduct.

MRC filed a petition on Monday in Los Angeles Superior Court to confirm the arbitration award, after the award was upheld in a confidential appeal.

Spacey and his companies, M. Profitt Productions and Trigger Street Productions, were ordered to pay $29.5 million in damages plus $1.2 million in attorneys’ fees and $235,000 in costs.

Spacey was among the first major Hollywood figures to be accused in the wake of the Harvey Weinstein scandal in October 2017. On Nov. 2, 2017, CNN reported that Spacey — the star and an executive producer of “House of Cards” — had created a “toxic” environment by making crude comments and engaging in non-consensual touching of young male staffers, citing eight production sources. MRC said it had “no knowledge whatsoever” of Spacey’s alleged on-set misconduct prior to the CNN report.

Spacey was immediately suspended pending an internal investigation. The producers ultimately terminated Spacey’s contract, and his character, Frank Underwood, was written out of the show.

At the time of Spacey’s suspension, two episodes of the sixth season were in production, and most of the season had been written. The two episodes were shelved and the production started over, ultimately delivering an eight-episode season rather than the 13 episodes that had been planned.

MRC filed the confidential arbitration demand in January 2019, seeking to recover from Spacey the costs of scrapping the season and starting over. Spacey filed a counterclaim, accusing the production company of wrongfully terminating his contract and breaching its obligations to “pay or play” under the agreement.

Attorneys on both sides took depositions from more 20 people, leading up to an eight-day confidential arbitration hearing in February 2020. The arbitrator issued a 46-page ruling in July 2020, which remains confidential, finding in MRC’s favor.

“With one exception, the Arbitrator found the third party witnesses to be credible, and found the allegations against Spacey to be true,” the petition states. “The Arbitrator found that Spacey’s conduct constituted a material breach of his acting and executive producing agreements with MRC, and that his breaches excused MRC’s obligations to pay him any further compensation in connection with the show.”

According to the petition, the Arbitrator also found that “Spacey’s egregious breaches of contract” made him and his companies liable for MRC’s tens of millions of extra costs.

MRC issued a statement thanking its attorneys — Michael Kump and Gregory Korn of Kinsella Weitzman Iser Kump Holley LLP — for their work on the case.

“The safety of our employees, sets and work environments is of paramount importance to MRC and why we set out to push for accountability,” the company said.

Spacey’s attorney did not immediately respond to a request for comment.

Spacey’s original accuser, Anthony Rapp, sued him in federal court last year. That case is still pending, but several other cases against the actor have been dropped, including a criminal case in Massachusetts and a civil case in Los Angeles. In the Los Angeles case, a criminal investigation was also dropped after the accuser died.

I have no sympathy for the Kevin Spacey. If he did what folks say he did, he deserves to pay for the damage he causes..not just to the obvious victims, but to all those he put out of work. I also realize his accusers may not be totally innocent...which not only make's him an abuser, but also makes him incredible stupid to think he could get away with so much shit.

More folks who sexually or otherwise abuse people and think they are untouchably above retribution, need to be permanently shut down. As a person and as an actor, he isn't missed. Bye, bye Kevin.

Kevin Spacey found not liable in sex abuse suit brought by Anthony Rapp


The federal jury in Kevin Spacey's sexual abuse trial found that the Oscar-winning actor is not liable for battery against “Star Trek: Discovery star” Anthony Rapp.

The jury of five men and six women deliberated for just under 90 minutes Thursday afternoon. Rapp appeared stoic as the verdict was read, and his lawyers seemed dejected as they left the courthouse in downtown Manhattan.

Spacey dropped his head after the verdict was announced and then stood up to hug his lawyers.

“I’m very grateful to the jury for seeing through these false allegations,” Spacey's attorney Jennifer Keller said outside the courthouse. Spacey, flanked by bodyguards, did not say anything outside before hopping into a black SUV and driving off.

In a statement posted on Twitter, Rapp said he was "deeply grateful for the opportunity to have my case heard before a jury, and I thank the members of the jury for their service."

"Bringing this lawsuit was always about shining a light, as part of the larger movement to stand up against all forms of sexual violence," Rapp said, vowing to continue to advocate for "a world that is free from sexual violence of any kind."

Richard Steigman, the attorney for Rapp who delivered closing arguments Thursday, said in a statement: "Anthony told his truth in court. While we respect the jury’s verdict, nothing changes that."

In the early days of the #MeToo movement, Rapp was one of the most prominent people to level sexual misconduct allegations against Spacey, derailing his lauded career on screen and stage.

Rapp alleged that Spacey climbed on top of him at a party in New York City in 1986, when Rapp was 14 and Spacey was 26. Rapp, best known for his role in the musical “Rent,” testified that the alleged encounter was “the most traumatic single event” of his life.

Spacey flatly denied Rapp’s allegations, saying under oath that “they are not true.” His lawyers argued that Rapp “created a story” in large part because he was jealous of their client’s success in the entertainment industry.

In closing arguments earlier on Thursday, lawyers for the actors presented dramatically divergent versions of events.

Steigman suggested that Spacey put on a performance for the jury on the witness stand and insisted that his client remains traumatized because of the alleged encounter decades later.

Keller dismissed Rapp’s claims as falsehoods and argued that the younger actor was simply jealous of her client’s professional success.

Emotional testimonies
The two men delivered tearful testimonies on the witness stand.

Rapp fought back tears and spoke with a pained expression as he recalled the details of the alleged encounter he described as “incredibly frightening and very alarming.” He testified that he felt inspired to go public with his claims in the fall of 2017.

“I didn’t ask for him to do that,” he told jurors, referring to Spacey’s alleged sexual advance. “I didn’t want him to do that.”

Spacey, for his part, repeatedly broke down crying during his testimony. In a quavering voice, he told jurors about his “humiliating and terrifying” upbringing as the son of a man he described as a “white supremacist and neo-Nazi.”

“I have never talked about these things publicly, ever,” he said.

Rapp filed a lawsuit against Spacey in 2020 based on three claims: assault, battery and intentional infliction of emotional distress.

Judge Lewis A. Kaplan dismissed the assault claim before the trial started, saying it was not covered by the New York’s Child Victims Act of 2019, which temporarily allowed people to make claims that would have normally been blocked by the statute of limitations.

Kaplan tossed out Rapp’s claim of emotional distress on the sixth day of the trial, saying in part that it “repeats and re-alleges” the allegation of battery.

Rapp, who claimed he shared his experience with friends over the years, first publicly detailed his allegations in an article published by BuzzFeed News on Oct. 29, 2017.

Spacey's response to allegations
In a statement on Twitter the next day, Spacey said he did not recall the alleged incident but apologized to Rapp for “what would have been deeply inappropriate drunken behavior.” He then came out, writing in part: “I choose now to live as a gay man.”
