Yesterday, the most modest of gun control proposals died in the Senate. It would have expanded background checks to people purchasing weapons at gun shows and online sales, enjoyed 90 per cent support among the public and came on the back of the tragedy at Newtown. Yet, despite all that it had going for it, the Toomey-Manchin bill raised just 54 votes – six short of the number necessary for passage. “This is a pretty shameful day for Washington,” said Obama afterwards. It wasn’t exactly a red letter day for him, either.
 
Why did the no-brainer bill fail? Four reasons:
 
1. It wasn’t the political priority that its supporters presumed it was. Yes, Newtown shocked the nation – but the top priority for the public remains the economy. According to Gallup, only 4 per cent of Americans think that gun control is the “most important problem facing the country today”.
 
2. The National Rifle Association is smarter than we all thought. In the wake of Newtown it scored a number of own goals, including a disastrous press conference and floating the idea of armed guards in schools. But Blake Zeff argues that its extremism was calculated, that its goal was to shift the gravity of debate away from the centre ground and towards the Right – compelling Democrats to talk seriously about armed guards and stop talking about banning whole classes of weapons. The NRA, even by farce, transformed the discussion to its advantage.
 
3. The Democrats are dumber that we all thought. Blake Zeff, again, makes a compelling case that the Dems screwed up when they declined to rally behind a more comprehensive gun control bill – conceding leadership of the debate to the Right within their party. This is a familiar story: liberals tend to be less ambitious and tenacious than their conservative rivals.
 
4. Barack Obama is a lame-duck president. Nobody listens to what he says anymore, nobody is interested in winning his approval and nobody much cares if he thinks they have “let the country down”. This is typical for a second-term president who has lost all their leverage because they’re no longer running for office and everybody is patiently waiting for the day when he quits the White House. But Obama's difficult personality has doubled the size of the challenge. Gloating in victory, adolescent in defeat – the Prez doesn’t make it easy to work with him. Why should conservative senators give him a legislative victory after he has spent four years painting them as knuckle-dragging rednecks who hate women and the poor?
 
Whatever your position on gun control, yesterday’s events are a damning indictment of Obama’s presidency – a flash of style, lots of soaring rhetoric and, when the votes are actually counted, little show for any of it. America has four more years of this lame-duck president telling them that it has let him down. If only he could tear up the Constitution and rule by diktat he might save himself a little disappointment. Alas, American democracy is a stickler for rules.

Barack Obama’s rage — whether it’s real or playacting, I’m undecided — continues. Today Organizing for Action’s Jon Carson sent an email to the group’s vast mailing list. It begins with a lie, saying “Yesterday, 45 senators chose to ignore their constituents and stand with the gun lobby.”‘

Obama is allowing for no possibility that any of the senators who opposed the background check amendment were acting in accord with their constituents. None.

The email continues: “And because of Senate rules, this minority was able to stand in the way of a bipartisan measure to expand background checks for gun sales.”

That line is probably a set-up for one of two following moves. One, Democrats will push to jettison the Senate filibuster, aka the so-called “nuclear option.” Or two, Obama will implement some form of background check expansion via executive order and dare anyone to stop him. Or, of course, he may try both. He will certainly make gun control a centerpiece of the Democrats’ campaign to re-take the House in 2014, which the “gun control lobby” surely welcomes. If he could not get this legislation through four months after Newtown, it will not be a resonant issue nearly two years after the tragedy. Unless, that is, Obama has another tragedy to exploit between now and then.

From that set-up line, the email moves on to exploiting the families grieving their loss.

“A lot of people are reading the headlines today and wondering how these senators had the nerve to get up there — right in front of victims’ families from Newtown — and cast that vote against something that more than 90 percent of Americans support. I’m one of them,” his email authors write.

Obama’s own hand-picked Newtown father admits that the background check expansion would not have saved his son. A lot of people are wondering how the president could so callously use vulnerable people at the worst moment in their lives, to push his pet cause.

In the email, OFA vows that “Yesterday was round one. We will keep fighting.”

The question is, is that a threat, or a scream borne of impotent rage?

Vice President Biden told White House allies in the gun control fight Thursday that President Obama will be announcing new executive actions on gun violence in the days after the Senate voted down a gun violence bill.
 
On a conference call with "stakeholders," Biden told gun control advocates that the fight is not over and that eventual action on gun control will come. Press were not invited to the conference call; a participant provided BuzzFeed with access.
 
"Look I know you're going to say that I'm just being an optimist and I'm trying to put a good face on this. But you know I've been around here a long time and we've already done, because of you, some really good things," Biden said. "Number one, the president is already lining up some additional executive actions he's going to be taking later this week."
 
After the Newtown shootings, Obama took a number of executive actions to expand research into gun violence and other areas favored by the gun control community. He took the actions without Congressional approval, leading to outrage by some conservatives.
 
Gun control measures failed in the Democratic-controlled Senate earlier this week.

When media throw the 90% figure out they are being disingenuous.   It doesn't mean that 90% support the recent bill, it just means that most people think there should be some form of gun control.  I support gun rights and I find certain forms of gun control advocated, like not letting emotionally disturbed people buy weapons, completely appropriate.  I would bet that even the most die-hard righties on getbig support some kind of gun control.

just look at the public support for increasing taxes on the wealthy and then explain how 90% of the public is suddenly going to be in favor of removing all taxes completely

As 333386 said, it's by being a leader. Guess what! Reagan NEVER had the Senate or the House under his party's control. Yet, he got things done. Clinton only had Congress for two of his eight years. Yet, most of his legislative accomplishments and the legacy of his presidency were done the other six years when the GOP ran Congress.

Both men were LEADERS. They were able to persuade people to vote for certain issues, from time to time.

Obama can't do that. He's demonizing Republicans every chance he gets. Yet, he knows he needs GOP votes to pass that bill: Not the smartest of tactics.

But, let's tell it like it is: This bill was never going to get to Obama's desk, anyway. Obama's just mad, because his plan to have this die in the House in order to demonize the GOP congressmen BACKFIRED!!

Support for a process providing legal status to undocumented immigrants reached a new high in the latest ABC News/Washington Post poll, while vast public backing for expanded background checks on gun sales held strong – two prominent issues coming to the fore in Congress.
 
With a vote on gun control measures pending, 86 percent support extending background checks to gun sales at gun shows and online. Ask a cop on the beat how criminals get guns and you're likely to hear this hard boiled response: "They steal them." But this street wisdom is wrong, according to one frustrated Bureau of Alcohol, Tobacco and Firearms (ATF) agent who is tired of battling this popular misconception. An expert on crime gun patterns, ATF agent Jay Wachtel says that most guns used in crimes are not stolen out of private gun owners' homes and cars. "Stolen guns account for only about 10% to 15% of guns used in crimes," Wachtel said. Because when they want guns they want them immediately the wait is usually too long for a weapon to be stolen and find its way to a criminal.


In fact, there are a number of sources that allow guns to fall into the wrong hands, with gun thefts at the bottom of the list. Wachtel says one of the most common ways criminals get guns is through straw purchase sales. A straw purchase occurs when someone who may not legally acquire a firearm, or who wants to do so anonymously, has a companion buy it on their behalf. According to a 1994 ATF study on "Sources of Crime Guns in Southern California," many straw purchases are conducted in an openly "suggestive" manner where two people walk into a gun store, one selects a firearm, and then the other uses identification for the purchase and pays for the gun. Or, several underage people walk into a store and an adult with them makes the purchases. Both of these are illegal activities.


The next biggest source of illegal gun transactions where criminals get guns are sales made by legally licensed but corrupt at-home and commercial gun dealers. Several recent reports back up Wachtel's own studies about this, and make the case that illegal activity by those licensed to sell guns, known as Federal Firearms Licensees (FFLs), is a huge source of crime guns and greatly surpasses the sale of guns stolen from John Q. Citizen. Like bank robbers, who are interested in banks, gun traffickers are interested in FFLs because that's where the guns are. This is why FFLs are a large source of illegal guns for traffickers, who ultimately wind up selling the guns on the street.


According to a recent ATF report, there is a significant diversion to the illegal gun market from FFLs. The report states that "of the 120,370 crime guns that were traced to purchases from the FFLs then in business, 27.7 % of these firearms were seized by law enforcement in connection with a crime within two years of the original sale. This rapid `time to crime' of a gun purchased from an FFL is a strong indicator that the initial seller or purchaser may have been engaged in unlawful activity."


The report goes on to state that "over-the-counter purchases are not the only means by which guns reach the illegal market from FFLs" and reveals that 23,775 guns have been reported lost, missing or stolen from FFLs since September 13, 1994, when a new law took effect requiring dealers to report gun thefts within 48 hours. This makes the theft of 6,000 guns reported in the CIR/Frontline show "Hot Guns" only 25% of all cases reported to ATF in the past two and one-half years.


Another large source of guns used in crimes are unlicensed street dealers who either get their guns through illegal transactions with licensed dealers, straw purchases, or from gun thefts. These illegal dealers turn around and sell these illegally on the street. An additional way criminals gain access to guns is family and friends, either through sales, theft or as gifts.


While many guns are taken off the street when people are arrested and any firearms in their possession are confiscated, a new study shows how easily arrestees believe they could illegally acquire another firearm. Supported by the National Institute of Justice and based on interviews with those recently arrested, the study acknowledges gun theft is common, with 13 percent of all arrestees interviewed admitting that they had stolen a gun. However a key finding is that "the illegal market is the most likely source" for these people to obtain a gun. "In fact, more than half the arrestees say it is easy to obtain guns illegally," the report states. Responding to a question of how they obtained their most recent handgun, the arrestees answered as follows: 56% said they paid cash; 15% said it was a gift; 10% said they borrowed it; 8% said they traded for it; while 5% only said that they stole it.


ATF officials say that only about 8% of the nation's 124,000 retail gun dealers sell the majority of handguns that are used in crimes. They conclude that these licensed retailers are part of a block of rogue entrepreneurs tempted by the big profits of gun trafficking. Cracking down on these dealers continues to be a priority for the ATF. What's needed, according to Wachtel, is better monitoring of the activities of legally licensed gun dealers. This means examining FFL paperwork to see where their guns are coming from, and making sure that those guns are being sold legally. But he says, "Let's be honest. If someone wants a gun, it's obvious the person will not have difficulty buying a gun, either legally or through the extensive United States black market."

That seems EXTREMELY unlikely.

I wrote last week about the fact that the Newtown incident is a defining moment that requires reflection, action, and sacrifice. Just yesterday, the Senate rejected the very mild Manchin-Toomey compromise that would have add background checks to gun shows and internet sales, but not to private and family transfers. This is a very mild reform and no one has really been able to show how it infringes upon anyone's rights. The only arguments actually revolve around a sort of domino theory: i.e. this step will lead to a national gun registry, which will lead to… which will lead to…

When I renew my driver's license I have to take an eye exam and pass it. My success or failure to see is recorded somewhere. A document that states that I am legally blind or that I need corrective lenses in order to operate a motor vehicle is certainly a violation of my rights - though I am not sure which amendment - but beneficial to my community. It is a tradeoff we make for the community good. So too is the statement I need to sign that I have been treated for heart ailments. I don't necessarily want people to know that but I guess they should be aware that if I have a massive coronary attack and jump a highway median, that it wasn't the open container of Chavas Regal in the brown paper bag next to me. Talk of a denial of rights. You mean I can't drink and drive after a hard day annoying people with my polls? I can't drive a motorcycle at 90 miles an hour without a helmet? What else do we pay public works employees to do except pick up pieces of bloody brains and craniums?

Gun owners have rights. Not too long ago, smokers did, too. There is a higher calling, a public good. Automobiles can kill people. Motorcycles can kill people. Driving too fast on a motorcycle (and without a helmet) can cause insurance and taxes to go up. Littering is an expression of free speech. Dumping my trash on an open field at midnight is a convenience and saves me money.

This is absurd. Have your guns and have your fun. But guns can kill people. Some actually do. Call me old-fashioned, but I want to help law enforcement find a perpetrator as quickly as possible. This appears to me to help law abiding gun owners, not hurt them.

What about the politics of this vote in the Senate? A very good editor in Washington in DC asked me this morning if the failure to pass background checks represents a failure for Barack Obama and a permanent loss of his political mojo. I think not. With Congress' rating at 14%, with 90% of likely voters supporting background checks, with the images of the Newtown families and the intensity of support for gun control now matching that of guns rights advocates, a more popular President now has a solid wedge issue to carry him into the 2014 congressional elections. Not only does the President have 90% support on this, he also has solid and intense sentiment for background checks and action among his key base constituencies. I have used this metaphor before: the GOP can "win" in the short term by playing defense, but when the public demands action, as they do now, they are going to have to figure out to put the ball into the hoop.

The problem is the numbers can change the more specific the questions become. You ask people a broad question like whether they support back ground checks on all gun purchases and they are likely to answer yes.  Start giving them specifics on what such a measure entail and they begin to change their opinion.  This happens all the time with polls.

I do not have data that pertains to the topic.  I will do some research into this particular poll such as who conducted it and what it entailed.  I'm surprised that 90% of Americans can agree on anything.
