They use songs from well known bands/rappers like eminem etc. and then Sell the DVDs where the bodybuilders are posing to those copyrighted musics.
Isn't that copyright infringement to use somone elses music on your dvd? or even in your contest live.... Even bodybuilding.com is breaking copyright by having archived video footage with the music in it.
-
everyone plays copyrighted music...
whos going to tell ronnie to stop playing DMX?

DMX.
This is a live event run by an organisation using music that they do not own then recording the event and selling it on DVD and putting up archived video footage of it, that breaks copyright laws.
Playing a CD in your car does not break copyright law, recording yourself playing a cd in your car then putting it onto a public forum like youtube for example DOES break copyright law.

yeah profit is being made out of these events so ur right.

The only way they could avoid breaking copyright is by using classical music which was created before copyright protection was ever put into place. LoL.

If they do it right, they get a license for public playing at the show.
It's more complicated for DVDs, if you use music on a film, video, DVD, TV show, you have to get a "synchronization license". This term means you have gotten rights to use the music coordinated with images to relate a story.

how many bodybuilding dvd's actually get sold? anyone have figures?

You would still be infringing the copyright of the performer because although the music is in the public domain, the performance is not.
So the only way to avoid infringement of a Beethoven symphony would be to perform it yourself.

Thats sometime i think.
Logicaly, bber(especialy pro) should pay royality.
I hope that day wont come.
-
playing by the rules? that would assume there are standards and ethics enforced.
-
First they have to be aware that the IFBB exists, then that such event are taking place.

Word. The Purple One is obsessed to the point where ALL Prince videos on Youtube have NO AUDIO or have been taken down.
That's a little extreme and it's pissed off a lot of his former fans.
Don't think he cares though. Use his music, meet his lawyers

Busted. Better delete my account. :(
Maybe the songs are somehow in the public domain. More likely the IFBB has every competitor sign a waiver of some sort absolving the IFBB of everything from sprained ankles to suit for stuff like this being undertaken wholly on the part of the individual and without the prior knowledge or consent of the IFBB etc etc... Just a guess.

Haven't had time to read all these posts, but when a promoter pays the NPC or IFBB sanction fee, it includes payment to ASCAP and possibly one other organization which allows all recorded songs to be used during the event.
ASCAP = The American Society of Composers, Authors, and Publishers
When this problem first arose the participating bodybuilders were concerned that they would have to pay any fee imposed for the use of the music/song that they were intending to use during their posing routines, but the sanctioning bodies (NPC/IFBB) releaved them of that responsibility by paying that fee on behalf of the production itself. Back then it was included in the sanction fees so actually the promoter paid it.
I believe it still works the same today.
In fact I recently heard that ASCAP now wants to collect a fee everytime your cell phone rings if it plays a tune. Someone should have registered "ring-ring" a long time ago.

Very good. Same thing when you own a gym. You have to pay ASCAP if you plan to play music in the gym too. But I know not everyone does this.

Excellent post. This is true for the NPC.
I would assume the same applies to the IFBB Pro League, but I don't know that for certain.

Covered BY organization Thru BMI and ASCAP
Its a Membership to use pre recorded music at an event and including Television and Film.
Like NCAA , NFL , NBA, the NPC and IFBB are similar
Hope it helps also NPC Fees cover it on the National and Local level.

Adipo, why two (2) organizations? BMI and ASCAP?
Any idea?
