A teenage hunter in Montana is facing a school hearing in a few days that could derail her college plans, career hopes and even risk her identification as a "domestic terrorist" after she inadvertently parked in a school parking lot with a hunting rifle locked in a case inside her car trunk.
The report on the situation is coming from Gary Marbut of the Montana Shooting Sports Association, who told World Net Daily he was contacted by the student's mother.
The student and her mother were not available for immediate comment because of job and school schedules, and multiple WND calls to the Columbia Falls school district did not generate a response. In fact, the district office and the high school both told WND to call the other office for comment.
But Marbut told WND that the student, Demarie DeReu, will be facing a hearing on Monday at which the local school board could expel her.
"She will possibly have her life derailed because a bunch of school idiots insist that she must be subject to an irrational, 'zero tolerance' policy about guns in schools that does not countenance lack of bad intent. The theory that people with malice will be intimidated into good conduct if people without malice are punished in lieu of them is idiocy at its finest," he said in his written documentation of the situation.
He said DeReu, 16, is an honor roll student, a member of the Columbia Falls High School student council and a varsity cheerleader.
She's also a hunter.
"Although she had no intent to break any rules or laws, or harm anyone, Demarie is at risk of having her college education derailed and maybe even being identified forever as a domestic terrorist," Marbut reported.

Obviously this girl wasn't going to shoot the place up - but if you legally let her, you have to legally let everyone. And really, was she hunting at 5 am before school that day? take the damn gun in the house. If another student knows it's there, breaks into her car, and shoots the place up, then what?
i'd exercise some discretion and suspend, but not expell. If you say "it's cool, baby girl", then you'd better be ready for a shitload of lawsuits, or her car getting robbed next week, or 200 other kids packing heat in their cars.

This one-sided article failed to mention who she told about it, who then ran their mouth to ten other people, at which point teachers heard about it. If one of those 10 people had a crazy itch, then it could have been a car getting broken into, and a nice shooting incident.
How did they even know she had the gun? Incidents like this probably happen all the time - forgotten hunting weapons - why did they search her trunk on this one time it happened? Did she leave the rifle in there all 180 school days?

If I was in school and inadvertently left a pound of weed in my trunk, I'd get the book thrown at me as well. Just because I had no intention of selling it to anyone doesn't mean I should get a slap on the wrist and am told "don't do that again". It's unfortunate but in our society today, especially gun crime on school grounds, we have rules because of this.

sorry I agree with the punishment, thats not something you mess around with these days. First off you dont leave a gun unattended in a car unless your going somewhere with the intent of taking it with you, at least not how I was raised. Especially a hunting rifle, the only time you have a hunting rifle with you is if youre going to the range to site it in or going hunting.

::) Nonsense. Even in NYC where pot has been decrimiminalized, it's still an offense punishable by arrest to posess marajuana in any quantity. Also, federal law supersedes state law and local law. So in essence it's still illegal no matter what.

It's decriminalized in California up to 1oz on the person. If you don't have your medical card, you get a ticket, if you do, nothing happens.

A drug raid? Did they have a search warrant for her vehicle? ...or was it a routine violation of 4th amendment rights? And at 16, questioning her without her parents present would be another violation of her rights no? ...or have I just been watching too many episodes of Law & Order? :-\

They should start arresting teachers for having tire irons in their trunks. Zero tolerance for weapons.

has happend to me believe it or not...not for guns but for my car being hit on by dogs for drugs, nothing was found but a small stem in the back seat so they let me go but the drug dogs they use are also trained to smell gun power, cleaning agents etc...so they could have picked up on it and then the girl remembered and told them...LOL youve been watching to many episodes of law and order...I believe after they are read their miranda rights it may be that way but if they needed parental supervision anytime a police officer asked them a question, what would they do when they pulled them over for a traffic violation?

the dog hitting on the car or locker of the student is probable cause, ever go through a check point at the border up there? dont know if its like it is down here on this border but they have a dog go around your car and if it hits on something they search your vehicle.

as someone who attended a high school in which gangs where a slight problem. Guns on school grounds arent necissarily for shooting up randomn ppl. A number of kids bring guns to school for "protection" and thats what this is geared towards if you ask me.
There are probably a lot of guns on school grounds that arent there with the intent of killing random ppl. Just brought with the student "just in case" something happens to happen: a fight, they get jumped, someone hits on their girlfriend etc...

Laws like these are designed for those that actually follow the law, not criminals because they don't give a shit about the law. I have lived in Illinois my whole life and we have some of the most stringent firearms laws, hell you have to get a license to even hold a gun in a shop let alone buy one. But I can turn on the news any night and here about at least one person being shot or killed. Wow those laws are working wonders ::)

LOL I live in cypress, which is a suburb of Houston...pretty southern Id say and its not as prevelant as youd expect and while yes gun racks are carrying guns with is not...again you dont carry a hunting rifle unless youre going to the range or going hunting...
I own several guns and I can tell you exactly where each and everyone of those guns are right now...not a single one is being left unattended in my truck...

Kazan, I think theft is probably the bigger issue. When I was in HS, you could leave your gun in your car and not worry. These days, I have little doubt that thing would be stolen. But, I think you're right about it not having anything to do with preventing a shooting spree.

I understand that part, ...but why wouldn't having the K-9 (for all intents & purposes; a police officer) go around your vehicle to begin with, not be considered a 4th amendment violation? ahhh ok sorry i misunderstood, well I think it has something to do with the car being a school property. They to my knowledge cannot go off school property and search cars driven by students but if youre parked on school grounds or your locker then it is searchable(at least that is the way it was at my HS). Nobody is forcing them to drive to school it is a priviledge and in fact most schools you have to pay for a parking pass. By doing this you may give up certain rights like the right to not have your ish searched at will just like when you work for a company.

No, a car is not the same as a school locker. The locker belongs to the school and is made available to students for their use, therefore no warrant is needed to search a school locker, only permission of a school administrator, ...however, a private vehicle remains a private vehicle regardless of where it is parked. The purchase of a parking pass is not the voluntary relinquishing of one's constitutional rights, any more than the purchase of an airline ticket.

No, a car is not the same as a school locker. The locker belongs to the school and is made available to students for their use, therefore no warrant is needed to search a school locker, only permission of a school administrator, ...however, a private vehicle remains a private vehicle regardless of where it is parked. I would think that in a free country, an employer has no right to tell you what you can or cannot do while off duty in the privacy of your own home, ...especially when it does not contravene any laws.

You don't give up that right, ...you've simply potentially given police & prosecutors ammunition they may use against you. But you don't give up the right. It's not like they'll stretch you on a rack if you all of a sudden clam up.

EASTON, Md. (WJZ)— Outrage is growing after two high school students are suspended– one taken away in handcuffs– over items found in their lacrosse equipment bags. Those items are banned from school property.
Mike Hellgren explains the zero-tolerance controversy.
The parents of those two students say the school administrators are taking this way too far.
Talbot County schools are under fire for suspending two Easton High School lacrosse players over equipment they kept in their bags to fix their sticks.
“It’s a huge overreaction for a very minor infraction, and it wasn’t handled well at all,” said Graham Dennis, suspended student.
Laura Dennis’ son Graham had a pen knife and a Leatherman that school authorities found while they searched a team bus before it headed to a game. He now faces jail time and damage to his permanent record.
“A police officer came and took him away in handcuffs and they said ‘Give us 40 minutes, we have to process him,’ Laura Dennis said. “So they did mug shots and they fingerprinted. I was able to pick him up from the police department 45 minutes later.”
Doug Edsall’s son Casey had a lighter he also used to fix his lacrosse stick. The school classified it as an explosive device.
“The school administration apparently stepped in, and I think the wheels came off at that point. I think a big mistake was made,” Doug Edsall said.
“I’m just really terrified of what could happened, and it’s just been real emotional for myself and Graham of what we’ve been through,” said Casey Edsall, suspended student.
The school refused to answer any questions. Instead they sent WJZ a statement that says the students broke state law: “The criminal law does not have an exemption for any class of students. Disciplinary decisions are often controversial.”

Need Help?“To charge him for having a deadly weapon for a two-inch pocket knife is ridiculous,” Laura Dennis said. “It’s such a waste of everyone’s time and energy.”
The Maryland state school board is already taking a look at whether zero-tolerance policies go too far.
The parents of these students say the administrators’ actions here are out of line and their sons have never been in trouble and didn’t intend to harm anyone.
“You can hide behind a zero-tolerance policy. But I do believe that common sense needs to be applied, and unfortunately was not done in this instance,” Doug Edsall said.
“It makes me feel like I can’t trust people in a position of authority like that,” Graham said. “It’s scary to think that they would do something to a kid that doesn’t have any problems.”
The students have served their suspension. It’s unclear what might happen next, though, with these charges.
The school administrators say a team of staff members evaluated the case before making a decision about the punishment.
