i've been in jail plenty of times - no prison, no convictinos but I still cant get an apartment on my own cause of my 'record' fckn assault charges ::)
anyway I was in lockup in neuvo laredo mexico prob in 99 or 2000 and we got picled up by federalies cause we ran and my friend threw money at them so tey fckd with us and locked us up
now you cant call across to us, no one speaka engles, and they dont give a FCK
one guy was passed out in the middle of the floor, would wake up every 1/2 hour and either throw up blood or scream - at one point before dawn he was screamin so loud one chicano kickd the shit outta him
one guy kept freaki out and sayin shit in spanish and lookn around all crazy, he started to bite the bars and when he got frustrated he went to a corner, pulled his pants down took a shit in his hands and rubbd it in his hair screamin all this spanish shit -
no one would ever go down and cross with me cause we were in high school but this guy went we called buck mike cause he was so crazy -- after that guy took a siht in his hands I looked at buck mike and he was cryin
I knew we would get out but I was worried Id get tuberculosis or hep C - fckn federalies ahd their fun :-\

I spent 3 month in a Mexican jail ( DF), about 20 dudes in a 20x20 cell ,no bathroom ,peeing in a bottle ,they only allowed us to take 1 shit a day ,1 shower a week ,sleep on the floor .

The Vietnamese jail I was in was brutal, just a total hellhole. I was only in there for 3 days luckily.
They don't give you shit there, even getting your meals is not guaranteed. Blankets, toilet paper, toothbrush, none of it is gauranteed. Lots of people were openly shooting up and smoking meth in there. I actually smoked weed in there a few times. It was pretty fucked up. Totally corrupt.

I'm sorry if I come across as naive with regards to legal matters, but if you had no convictions (as mentioned above), how can you still have a record?
When convicted, you are found guilty of an actual crime, if not convicted you are then released and the charges are dropped with no record to be had.
Help me out here chief, how do you have a record with no prior convictions?

I'm not half or even quarter Jew. I just have Jewish blood in my bloodline...I do have white blood (British) very close but that means nothing cause I'm the same color as a milk chocolate bar...As sal would say, I sometimes confuse my fingers for kit-kats...My 2 brothers haven't been in jail or prison either...knock on wood.

Never been remotely near going to jail or prison.. but I do watch a lot of Lockdown on MSNBC. ;D
Learned a couple of things:
- Seems like the rape things is way overplayed and over hyped in the media. From all the episodes I've seen, the guys never really talk about it being that much of an issue. But if you are gay you can easily find sex.
- But they do go on endlessly about gang affiliations/gang wars/ and associating with your own color (white/black/Hispanic). Even associating with the wrong color can get you quickly stabbed.
- Seems like as long as you mind your own business, show people respect and obey the informal laws on the inside, you'll be ok.
- A LOT of the inmates who committed horrible acts of violence and rape etc seem to do a lot of endless bitching and whining all the time over tiny shit, like getting their mail a day late etc.

It's funny, but you're right. I was on the MAC (Mens Advisory Counsel) for a while. I was a rep for the Whites. All we ever did was try and mediate BS inmate -vs- inmate problems. If prison was inmates -vs- the guards it would have been fun. Instead it was Black v. White, or Black v. Mexican, or North v. South.

Jail and prison are totally different environments. Most of you all know about prison from TV, but you don't know what jail is like. In jail you can just do whatever the fuck you want and if you don't bother anyone they don't care.

Never been in prison, thank god! I did spend the night in the Santa Monica City jail a very long time ago when I was just eighteen years old. It was memorable in a bad way, so much so that I'd never want to go back.
My friend and I were arrested on suspicion of grand theft auto. We were so naive that we asked for a cell together. The police laughed at us. I was put in with a fellow they said had stabbed someone. My friend's cellmate was an old drunk. I wore a large silver ring at that time. The damned thing was stuck on my finger. The cop said, "Better keep that thing hidden or your cellmate will cut your finger off to get it." I still have all my fingers. When I told them I wanted to call my lawyer, they laughed at me.
In the next cell the fellow was coming down off heroin. He alternated between being physically sick and freaking out all night. Off in another part of the jail, some ass-wipe kept calling for the jailer all night long. Needless to say my usual tactic of sleeping to avoid unpleasant experiences didn't work this night. Incidentally, the fellow yelling for the jailer was my friend who was a bit drunk himself.
The next morning the FBI showed up to talk to me. I was the one driving the supposedly stolen car. Apparently, the fellow who loaned me the car for the night had driven his girlfriend’s car out from the east and across several state borders making the theft a Federal offense. Needless to say, I took the FBI to the apartment where the fellow had asked me to drop him off the night before (he had picked up this gal and was spending the night with her).
My friend and I were released by 10:00 a.m. Feeling a little guilty about ratting out the guy who’d let me drive his girlfriend’s brand new T-Bird home, I took him some reading material. His girlfriend dropped the charges, flew out to California and got her car back. I’m not sure she wanted her boyfriend back although he was released.
Maybe every eighteen year old should spend one night in jail, if only to learn that it is no picnic and to never do anything to get them sent back. Once was all it took for me.

cable tv all day, ping pong table, cards, dominoes, cofee maker, commisary, they give you new clothes ever couple days, free soap, razors every morning, free paper to write letters, except for sleeping in a bunk bed in a room with 60 other dudes, its pretty much like vacation
except the part where you cant leave

If your sentence is over a year then off to prison you go. Under and you stay in Jail. The Jail I was at sucked bad and the guys in transfer to different Prisons wanted to go back to Prison because they said they had it easier. They have more freedom and softer beds, their own radios, TV, etc..In jail you get the bare minimum because it is short term.

that's the opposite of what is true that I have seen
county jails are more open and less restrictive .. they have open cells most of the day and can wander around and go outside and talk on the phones ( calling out collect ) anytime they are available .. prisons are more regimented in that prisoners have schedules for everything and can get canteen or phone time with limits ... the prisons are not maintained or updated as much or as well as county buildings are .. so there's rats , leaking pipes , broken windows behinds wired barriers , and more that are just not a priority .. whereas in jails .. the communities they are in has specific funds assigned to take care of all that and most are close by Sheriffs or State police stations so appearances are more important ... the food is better in jails also .. unless you get canteen in prison you get the bare minimum and some days it's a dry cheese sandwich for lunch with some carrot sticks and applesauce
tv's and radios in jails are free to use in common areas but never in a cell .. in prison if you have one you had to buy it or barter for it from another prisoner ... sometimes not in a very good way ... you're safer in a jail than a prison

A person can be in jail and await the courdate or sentencing, and still not be convicted...the conviction comes on the court date or after the jury comes in with the verdit... There are people out there that are arrested for a crime and have beatern mutliple murder cases, but were held on a bond or without bond and are awaited sentencing for said case...

Yes, but he states in that same quote above that he has no convictions, yet has a criminal record.
I am aware that a person can be brought to jail to await legal proceedings in a court (when a person is charged with a felony), but he states that he has been to jail (Fair enough), but afterward had no convictions. So why would he have a criminal record that impedes him from getting an apartment?
If you are not convicted of a crime, how can you have a criminal record? Remember, you are innocent until proven guilty and if he wasn't found guilty (free of conviction), why would he have to pay the price by carrying around a criminal record?

For some reason, I thought I had read somewhere that arrest records are not visible to the public unless it is a law enforcement agency like the FBI(i.e. Landlords reviewing your application for an apartment).
Logically, if you have no conviction, you are not guilty of the crime. ANYONE can get arrested for anything, but unless they are proven guilty, they are INNOCENT.
Why would someone have to carry around an "arrest" record that will dissuade people from trusting your character due to speculation regarding whether or not you actually committed a crime, especially after you have been vindicated in a court of law?
What am I missing here?

This...all arrest records go to the FBI, once your case is adjudicated, states have what's called Expungements, you can expunge certain cases off your record. Like Not Guiltys, Judgement of Acquittal, Nolle Prosequi. If you want these expunged from the FBI record, you have to file with them.

Right now there are 1,700,000 give or take a convict or two Americans in jail & prison. Nobody, nobody arrest more of their citizens then we do.

local papers here have a section for police arrests, no court date set but your name makes the paper, NOT a big fan of this. If I'm not mistaken, even if first offense and let's say you get convicted but get accelerated rehabilitation, it's still on record. Most states have a judicial website and input someones name and take a gander at what pops up

Does it not go against the very definition of these terms?
To seal a record, completely lock away so that no one sees it.
To expunge, being to completely destroy any trace of it.
By the logic you presented, anyone who has ever been arrested of anything has a record and will have to carry that cross for the rest of their lives because of an arrest that probably came about due to probable cause that then in court was proven without a reasonable doubt as erroneous.

Depending on what state your in...but in maryland, when one expugnes a case, the arrest repord is expunged out of the Police Records, Court Records, the State's Attorney Office records...like it never happened..but it stays in FBI records.

It depends on the particular jail.
Some you will eat decently.. others you will just about starve.
County jail:
If you’re locked up in an urban setting (Chicago/LA).. in a max division.. and most of the guys are violent - in for murder, home invasion etc - county jail is worse than prison on multiple levels.
Tensions run high in that scenario.. everyone is facing 30 year - life sentences... and the environment completely sucks.
For long sentences prison is better than jail guys doing long time in county jails beg to go to prison..

Fighting - broke somebodies arm while fighting - spend the first 3 days in a cell with an afghan man who was about
to be "send" back to afghanistan that was way before the war and the taliban was in power - he was so scared he
was crying every day all the time.
Fight wasn't my fault but I was lucky and I go him good and I stomped on his arm while he was already down just because
he was a big guy and I wanted him to stay down I was scared I get my ass kicked.
So they said I was beating an already beaten man, they didn't believe that he was still kicking and trying to bite me.

I'm sorry if I come across as naive with regards to legal matters, but if you had no convictions (as mentioned above), how can you still have a record?
When convicted, you are found guilty of an actual crime, if not convicted you are then released and the charges are dropped with no record to be had.
Help me out here chief, how do you have a record with no prior convictions?

I kid you not I applied for an apartment on my own in July and the chcik was like 'oh no, I dotn think you can live here'...............on some background search thing it showed 15 assault charges all the way up until I left wilmington...I worked security all thru college and they would CAHRGE all the staff and once we can down there and were told we were part of it they would let us go.........fckn EVERY TIME that shit happens it shows up on some background search taht even a gddamn apartment complex can do.......I working on gettn it expunged :-\

I absolutely agree with your premise and with the theory of having one's arrest record expunged- however doing so would mean; destroying all paper work from the arrest, deleting all computer files pertaining to the arrest and booking. Destroying all paperwork from all court proceedings, deleting all booking photos, deleting the fingerprints from the data base, destroying paper work and computer files pertaining to jail and prison housing/cell assignment, etc. etc.
I simply don't think it can be done.

some dude that my dad knows just got 5 months for tax evasion. i think that's federal though. he's kind of a twink, and foreign, i wonder if he's getting reamed as we speak?
