One of the women who accused GOP presidential candidate Herman Cain of sexual harassment wants to tell her side of the story but is barred by a confidentiality agreement, her attorney in Washington said Tuesday.
Lawyer Joel P. Bennett called on the National Restaurant Association, where the woman and Cain worked in the late 1990s, to release the woman from her written promise not to talk about the allegations or disparage the trade group.
The association, which Cain headed from 1996 to 1999, has remained mum since the story broke in Politico on Sunday evening, citing a long-standing policy not to comment on personnel issues. Cain denied the sexual harassment allegations, saying they were “totally baseless and totally false.”
Bennett represents one of the two women, who attended an Ivy League school and now works for the federal government. She has avoided the limelight since the allegations were aired, and she is staying with relatives while the media stakes out her home in suburban Maryland, Bennett said.
If she is released from the confidentiality ban, “then it is whole new ballgame,” Bennett said.
“If we didn’t have a written settlement agreement that says confidential and no disparagement, I think she’d be very comfortable coming forward,” the attorney told The Post on Tuesday. “Not because she would be so hellbent on doing something to Herman Cain — I don’t know that.
“For all practical purposes, Herman Cain has already done that” — waived confidentiality, Bennett said. “But legally that might not constitute a waiver.”
Because the case is more than a dozen years old, Bennett said he no longer has the file nor the confidentiality agreement. He said his client is sending it to him for review to determine how she might speak publicly.
Bennett, who has practiced employment law for four decades since graduating from Georgetown University, said that he disagrees with Cain’s statements that the settlement agreement with his client was only for severance.
“If there hadn’t been [sexual harassment] claims, there wouldn’t have been a settlement,” Bennett said.
Over the weekend, as the story was breaking, Bennett said his client called him. At the time, he said that he had not even remembered the name of the association official who his client had accused. He said doesn’t remember going to the association offices and thinks the matter might have been handled over fax and phone, and quite expeditiously.
Calls to the restaurant association and the Cain campaign were not returned.

But Joel Bennett, the lawyer for one of the accusers, who is a married federal employee who lives in Maryland, told CBS News today that his client is telling the truth.

But Bennett said said he does not remember the specific allegations, or what kind of settlement they eventually reached.

Cain has said he remembers one woman accusing him of harassmentand described the episode on PBS' Newshour last night.
"I reference this lady's height," Cain said. "And I was standing near her and I did this, saying 'you're the same height as my wife.'"
Bennett said Cain was talking about the case of another woman, not his client. But Bennett said now that Cain is talking about specifics, the confidentiality agreements may no longer be binding.
"I think the National Restaurant Associaion ought to waive the confidentiality and non-disparagement provisions and let the two women, if they choose to do so, come forward and tell their stories so that it can get a complete public airing," Bennett said.

he did say she was probably making 40 to 50k a year.
2 months severance woudl be $6700 to $8300.

I've read that one of the women got a year's severance, which was about $35,000.
If one got a year's pay and the other about 3 months' pay, those two got less than $50,000.
For a sexual harassment claim, especially in the 90s, that's PEANUTS (which leads me to believe that their claims were flimsy; they were given severance and told to walk).

“It is just frustrating that Herman Cain is going around bad-mouthing the two complainants, and my client is blocked by a confidentiality agreement,” Bennett said in that interview.
But later, one of the two women who accused Cain of sexual harassment indicated she might be having second thoughts about going public with her side of the story, according to her attorney and another person who knows her.
But a second person familiar with the thinking of the woman, who spoke on condition of anonymity, said the woman is wary of the ramifications of her name becoming public.
The woman “did not create this story,” the person said. She has been “completely swept up in this hurricane” and is discussing with her husband and family whether to make her story public.
The woman is a federal employee barred from political activities by the Hatch Act, Bennett said. According to public records, she is married to a registered lobbyist who is a registered Republican and has donated to both Democratic and Republican political candidates.
Tuesday night, on CNN, Bennett seemed to back off his earlier comments with the Post. In a telephone interview with Anderson Cooper, Bennett said the woman was “mulling over what she wants to do” and apparently was undecided about going public. “She’s naturally been upset about it.”

This is the blurb from Rush that I heard earlier:
This lawyer, Joel Bennett, is out there making it look like this woman's got a bombshell. That's what this means. He is laying the groundwork. He wants everybody to think this woman's got the goods; this woman's got more than a pubic hair on a Coke can. This woman can nail Cain, but she's being forbidden because of the confidentiality agreement -- and damn it, we want to be released! ... Except, according to the story, the lawyer hasn't contacted the National Restaurant Association yet to ask them if they will release his client. He's doing it all in the media. He's trying to add all this pressure. We're told that this woman? She's ready! (panting) This woman is loaded for bear!
She is ready come out and she gonna take Cain out! She gonna come out and she's got the goods, boy! She is gonna destroy this guy! She gonna take him out; she can't wait! ... Yet a few paragraphs later in the story we are told she's wary of her name becoming public, and that she is discussing with her family whether to make her story public. The Post article says that her lawyer is "calling on the Association to wave the confidentiality agreement," and then a few paragraphs later we learn he hasn't yet contacted them. I'm sorry, all I can do is laugh at this, at the picture that they are trying to create here. When has a confidentiality agreement ever stopped anybody that really wants to talk and really thinks there's added money at the end of the trail here?
I would think if Cain's accusers really wanted to speak up they would have found a way by now, especially if they think -- and (chuckles) I hate to say this but my family are all lawyers. But obviously they think that there's a payoff at the end of the trail here. That is why this lawyer's involved. Meanwhile, the news media is bashing Cain for not giving more details. (laughing) So the lawyer says, "Oh, yeah, my client, she's got the goods! My client can take Herman Cain down!" He's not saying that. This is what everybody's being led to believe by the way the lawyer is handling this. "This woman, she's got it all -- and it's juicy. Oh! It's more than just a hand up on the chin. It's something really, really bad out there. She can't wait to talk about it!"
Except she doesn't want her name published. She's so eager to talk about it her lawyer hasn't even called the NRA and asked 'em for permission yet to break the confidentiality agreement. Meanwhile, the media are bashing Herman Cain (laughing) for not giving more details, at the same time attacking him for violating the confidentiality agreement. So he's not saying enough while he's saying too much; and now CNN, for what it's worth, is accusing Herman Cain of "getting testy with reporters" this morning as he tried to make his way around Capitol Hill. He had to push his way through a phalanx of reporters who were pestering him about the sex harassment charges; and I don't know about you, if you look at the video clip, it looks like he was being very polite to me.

RUSH: Folks... Folks, get this. The Washington Post story that I have been citing liberally here for the last ten to 15 minutes? There are two versions of that story. There is a story that appeared online yesterday and a second version where something has been omitted. I have here what has been omitted near the end of the story as it ran yesterday on the Washington Post website. Are you ready? (shuffling paper) Ahem. Ahem. This has been deleted: "Because the case is more than a dozen years old, Bennett," the woman's lawyer, "said he no longer has the file nor does he have the confidentiality agreement. He said that he had not even remembered the name of the Association official who his client had accused. He said he doesn't remember going to the Association offices. He thinks the matter might have been handled over fax and telephone quite expeditiously."
It was that insignificant! That has since been deleted from the Washington Post story that is now, at present, running. Let me read it to you one more time. "Because the case is more than a dozen years old," that would be 12 for those of you in Rio Linda, Bennett, Joel Bennett, "the woman's lawyer said he no longer has the file," doesn't have the case file, he doesn't have "the confidentiality agreement. He said that he doesn't even remember the name of the Association official who his client accused," meaning he didn't even remember it was Herman Cain! "He said he doesn't remember going to the Association offices ever to handle this matter. He thinks the matter might have been handled over fax and phone quite expeditiously," meaning rat-tat-tat, couple faxes, couple phone calls.
Yep, 35 grand? Fine. We're done here. See ya -- and it's 12 years old and couldn't even remember that it was about Herman Cain. And doesn't have the confidentiality agreement, and the Washington Post has stricken that from their only version of the story. This was on their online version of the story yesterday. Not there now. But Diana Schneider, editrix of the Limbaugh Letter saved the cache file of it (c-a-c-h-e, for those of you in Rio Linda) so that we have it in perpetuity; and this lawyer is running around making it sound like this woman's got the goods. "Oh, yeah, she can't wait to talk! She's gonna nail Herman Cain! It's not gonna be pretty. We can't wait! It'll be big bucks! Wait 'til you hear it!"
Yesterday, he didn't even know who this was about.

Politico's recent report revealing allegations that Herman Cain sexually harassed two female employees in the 1990s has taken the Washington Establishment by storm. Pundits can barely mask their relief at what looks like the possible end of the Cain "boomlet," and conservatives have gleefully seized on the opportunity to call the mainstream media racist and accuse women in the workforce of not being able to take a joke.
But while the national press corps works itself into a tizzy, one key fact appears to have been overlooked. Republican primary voters — the people who will actually decide Cain's electoral fate — don't seem to care. According to the Des Moines Register, Iowa voters seem totally willing to give Cain the benefit of the doubt. In fact, the story has barely been mentioned on Iowa conservative talk radio or blogs this week.
This is not to say that Politico is running some kind of "smear campaign" — Cain is running for president and sexual harassment allegations clearly warrant a story. But unless something much more serious comes to light, this probably won't be the death knell Washington reporters are making it out to be.
Here's why:
* No one else has come forward. Usually, high-profile sex scandals open up a Pandora's Box of accusations as more people go public (see Anthony Weiner, Tiger Woods, Bill Clinton). Cain must have interacted with hundreds of women over the course of his restaurant industry career, but it has been days since the harassment story broke and no other women have emerged from the woodwork. While this doesn't diminish allegations against Cain, it does indicate that he is not a habitual leecher, and lends credence to claims that his behavior toward his female accusers was simply misunderstood.
