Oh no..... what will Trumpturds do now about whining how Hunter is protected from the system?
Yeah, he struck a deal that pretty much says no jail time.

Why not ask Agnostic what the penalty is for the average person lying on a federal firearms application, getting the gun and then tossing into a dumpster

Is not Agnostic a detective? Are police detectives usually involved in solving or pursuing these types of cases? If you know someone in the FBI or a tax attorney, they would be a better source.
The bad news is that the penalty can be as harsh as 10 years in prison. Lying about drug use is 5 years. According to what I read more than half the cases were filed. In the 2019 fiscal year, when Hunter Biden purchased his gun, federal prosecutors received 478 referrals for lying on Form 4473 — and filed just 298 cases, according to data extracted from the U.S. attorneys' case management system. Very few are prosecuted. Do folks who falsely fill out this form face much risk of prosecution. The answer? They don't. A 1990 Justice Department study noted how difficult it was to bring cases against people who falsely answer questions on the form, especially because there is no paper trail for drug abusers like there is for felons.
These statistics are relevant as Congress discusses how to strengthen gun laws after high-profile mass shootings. They are a prime illustration of how existing laws are not always rigorously or consistently enforced. Broadly popular measures like background checks are not as appealing to some Republican voters as they are to Democratic voters. Interestingly, it is Republicans who tend to resist proposals such as the one for universal background checks for gun buyers. This is evidenced on Getbig, whenever the subject of gun control is broached. Where do you stand on gun control, Coach?
When someone has firearms or ammunition that they wish to get rid of, they are supposed to report it to local law enforcement and either drop it off at their police station or wait for an officer to come by their location and take care of it. If a firearm is disposed of in another way, one could be charged with criminal disposal of a firearm. A person can be charged with unlawful disposition of a firearm even by throwing a found firearm away. Good thing that he didn't illegally try to sell the gun because the penalty for this can put you away for 5- 10 years depending on whether it is a 1st, 2nd, or 3rd degree charge.
The IRS is known for picking high profile tax fraud cases to pursue. Hunter Biden fits that profile. Filing late is not a big deal. They usually result in a fine. Too bad Hunter didn't file for an extension. Penalties for filing late can mount up at a rate of 5% of the amount of tax due for each month that you're late. If you're more than 60 days late, the minimum penalty is $100 or 100% of the tax due with the return, whichever is less. Filing for the extension wipes out the penalty file by the extension deadline. I personally know someone who didn’t file his taxes for 5 years. When the IRS decided to do something about it, he was not penalized. He had to pay what was due and they allowed him to pay what he owed on an installment plan.

Thanks for that. Along with lying on the 4473 from the FFL, he later threw the same gun in a dumpster. Thanks for the info though

I believe I covered this when citing the laws regarding gun disposal (disposition).
From my point of view him lying on application 4473 and illegally disposing (threw it in a dumpster), of a gun is far more serious than filing his taxes late. I think I made that pretty clear. To be fair, I should admit that I am for stricter gun control laws... but than, I am a liberal, so there is that. ;D

I couldn’t care less about the two years of taxes, on that point it’s a much bigger picture than the two years he admitted to purposely not paying. This will eventually snowball into the $10million bribery once all of the details are out. Since there is no justice system for the ruling class, the court of public opinion will judge.
If you or I lied on that 4473 and threw a gun in dumpster, we would be in prison especially if the trial were held in Democrat stronghold

I am not worried about going to prison because I never lied on a 4473 or threw a gun in a dumpster. Maybe this is because I never owned a gun and likely never will. Also, I am not worried about the IRS coming after me because I file my taxes and pay them on time every year. I have on occasion Jay-walked and my excuse is that I should be allowed since my name is Jay (yeah, I would still get a ticket if caught doing it). LOL!

Actually the crimes he was charged for are hardly what the average person would go to jail for. They are usually only brought along with more serious offenses.

Lie on a gun application then take that gun and go throw it in a garbage bin and when you get caught, let us know the results ….dipshit. It’s a federal crime

You don't think lying on a federal form would land the average guy in jail? Then disposing of the gun in a public trashcan while high as a kite? Have you ever purchased a gun?

People lie on gun forms all the time. No, I don't think it would land the average guy in jail unless more serious charges were tacked on with it.

Really? Have you ever purchased a gun?
The penalty is something like $250,000 fine and up to 10 years in prison. On top of that, you don't get your gun and your forfeit the money you paid for it. Yet, the presidents drug addict kid was able to get his gun and throw it in a trash can.

You are correct that is the fine and the possible sentence. Funny how almost nobody is fined or imprisoned for breaking this law. Why, because it is darn hard to prove someone intentionally lied. Trump should be happy about the lying to the Feds part... at this point, it looks like he needs all the breaks he can get.
If he could only keep his lies straight... guess this speaks to the topic of his being too old and crazy for the job he aspires to.

So what you are really saying is that more background checks and restrictions are needed?
Who gives a shit where he threw it?

Douglas Berman, a professor of law at Ohio State University and a sentencing expert, read the court papers unsealed Tuesday morning and said that it was difficult to assess from the filings whether Biden received a sweetheart deal.
The crimes to which Biden is pleading guilty, Berman said, are ones that the average person is rarely prosecuted for because they are usually only brought along with more serious offenses.
In Biden’s case, they include a charge stemming from lying about drug use on the government form used for his purchase of a handgun. Current and former officials say tens of thousands of Americans, out of the 25 million who buy guns each year, lie on their forms and are not prosecuted.

Maybe try another excuse? Your current one isn't really cutting it.

Well Coach.,. as I've said, I was a Detective.. Sergeant, Lieutenant, Commander. While those ranks and positions gave me some valuable experience, lying on a firearms application fell under another agency's jurisdiction. Jurisdiction is a term used to determine who has legal authority to pursue charges and enforce certain laws.
You also mentioned in another post about a 2-tiered justice system. Since around 1995 with the OJ Simpson Trial, I kind of felt the law wasn't applied equally. Seeing the makeup on Death Row kind of solidified that for me. So yes, I agree there is a 2 tiered system. And I fully expect Trump to do zero time because of it as well.

Dumbass. What I'm saying is the two tiered justice system (liberals vs everyone else) needs to stop and people need to be held accountable fairly and justly.

Just going back to the 60's.. the 2 tiered justice system wasn't really about liberals... Many much smarter than you or I would say it's laughable for Republicans to complain about a 2 tiered system.

Ok, let’s try this angle. The very same “gun control” laws that Biden is pushing is one of the very same laws his kid got away with. Part of his plea deal was a diversion deal, basically probation, if he doesn’t violate his probation, he’s gets to buy and carry again. If this you I, we’d more than likely be in prison with a felony attached and never to be able to purchase a firearm again.

Do you have any stats on sentences for very similar offenses? I don't. If you have stats that show the majority of people who do the same thing get a prison sentence I wouldn't argue it.But generally, some laws aren't enforced or prosecuted unless they are tied in with other charges. What's the reality based on available statistics?

Not unless you had some priors first. Or a shitty lawyer that didn't represent you well enough to get a plea deal.

We didn’t “win” anything. What this still means is, after two years if he doesn’t violate the term of his “probation” which part of it is, No drugs, no alcohol and violate any part of the “probation” he gets his record expunged and gets to buy and carry a firearm again and would avoid jail time. Meaning, if that fucker even has a glass of wine on Air Force One he technically violated the terms and conditions of his probation. I would love to see those terms and conditions, but would it really matter? No!
If this were anyone else, we would at the VERY LEAST not be able to have a firearm in my possession, in my home, in my business or anywhere for the rest of my life. If I were (or anyone) were even to get caught at a gun range, we would be re-arrested

Legal experts cast doubt on GOP claims of a ‘sweetheart deal’ in Hunter Biden case
Republicans wasted no time Tuesday calling into question the plea agreement Hunter Biden reached with the Justice Department over two tax charges and a felony gun charge, claiming President Joe Biden’s son received special treatment in a long-running probe that had been a cause célèbre on the right.
But tax and criminal law experts stress that, based on publicly available information on the case, the resolution reached does not represent a two-tiered justice system in which Hunter Biden benefited from his name.
The opposite may be true, in fact, especially since he later repaid the taxes he owed.
“If Hunter Biden’s name was John or Jane Doe, no criminal tax prosecution would have ever been contemplated and he would have almost certainly been slotted into a pre-trial diversion program, saving the government the time and expense of a trial,” said Martin Sheil, a former supervisory special agent in the IRS Criminal Investigation.
“So if Hunter has paid all of his taxes, albeit delinquently, arguably Uncle Sam has suffered no harm and justice was done,” Sheil said.
As part of the agreement, Hunter Biden will plead guilty to two tax misdemeanors and struck a deal with prosecutors to resolve a felony gun charge. The DOJ has agreed to recommend a sentence of probation for the two counts of failing to pay taxes in a timely matter for the years 2017 and 2018, according to sources.
Federal district Judge Maryellen Noreika, an appointee of former President Donald Trump, will preside over the case and likely have the final say on any sentence. Noreika, a former patent lawyer in Delaware, had the support of both Democratic senators from the state when she was nominated in 2017.
A hearing is scheduled for July 26.
Hunter Biden owed at least $100,000 in federal taxes for 2017, and at least $100,000 in 2018, but did not pay what was due to the Internal Revenue Service by the deadlines. Part of the argument included that he paid back taxes owed, including penalties.

Hunter Biden owed at least $100,000 in federal taxes for 2017, and at least $100,000 in 2018, but did not pay what was due to the Internal Revenue Service by the deadlines. Part of the argument included that he paid back taxes owed, including penalties.

Again, you can't stop lying can you? Dumb ass.

This country has likely spent more $$$ and lost more classified info in keeping this turd of a human above ground than any other single person I can think of.... Dad is clearly under pressure to do anything to keep this POS from coming up missing or "OD".

Just today, I pointed out that Coach referred to my stooping to insults which don't exist. Unfortunately, some folks have difficulty reading what is written, verses what they hope, or think was said. Coach is one of those people.

Obviously, the voices in his head are stupid too.

Let’s see how dumb Lurker can be today. You referring to him as a “legal expert” there’s no text of him anywhere that I’ve found that he even went to law school. Not even a JD. When you refer to someone as a “legal expert” that means they went to law school…at the very least. The fact you’re trying to spin your way out getting caught in your bullshit is hilarious.

Legal expert doesn't mean attorney you stupid little fuck. Maybe in that empty little head of yours only.
The credentials in his field pretty much given him an expert insight. Damn you really are dumb.
Speaking of lawyers, you can't even name the one you claimed Biden just got. ::)

Legal expert = attorney? Then prove it retard. You can't even prove I claimed he was an attorney like you said. You won't be proving this either.
Prove it or continue to post bullshit. That's really the only two choices you have.

"Bobulinski, a former business partner who worked directly with Hunter and James Biden on a sketchy deal with a Chinese energy firm and who came forward as a whistleblower before the 2020 election, was never asked to testify to the Delaware grand jury investigating Hunter Biden, CBS News reported Thursday.
Bobulinski was reportedly “open to testifying, and his attorney reached out to the office of Delaware U.S. Attorney David Weiss,” but the prosecutor did not return their calls, two sources familiar with the discussions told CBS News’ Catherine Herridge."
