Always... you have a CCW? that's awesome man.  I've had mine 9 years now.

In FL, you can shoot a person in your home.  Period.  He can be a thug with a handgun or a bum with a sandwich.  in the dark you really don't have time to make the differentiation.  of course, if you can, you avoid killing the guy.  But you will not be prosecuted if the man you kill in the dark ends up homeless.

And as a result, home invasions are VERy rare in FL.  Chances are if you push your way into a house, you're looking at a shotgun exchange immediately.



i thought it through today.  If a neighbor molested my child, I'd pick up a box of cereal or somee other diversion, politely knock on his door, then proceed to pucn the guy about 20 times before returning to my house and calling police.  You get some justice, but you don't go to prison.  No jury will convict you for beating a guy who did such a thing.  now killing a guy, they gotta convict ya of something...

The only problem with a CCW is I since I have rage issues I carry less then I should since I do not want to be posted here in a news artical called "dumbass shoots somebody because of road rage". Been thinking about getting something smaller then I carry now but with winter coming and bigger shirts and jackets may wait till spring.

A guy tried to break into a friend of mines house. He heard the ruckus, went outside and put his 1911 up to the kids temple. Another friend of mine in got into a road rage incident. A guy came up to his car with a bat and said- "you got a problem"? to which my friend Ritchie replied- "only if your superman" as he held his Glock he always carries. Needless to say the guy high tailed it out of there.

That's the problem; it makes sense for a split second then you regret it for the next 40 years. Easy to say but the father of the child should've gone over without thinking to pick up the knife.

The guy stabs some guys after taken the word of a 2 year old?  The guy should be put in jail for life.  These big mouth women gossiping all fu---- day...these wash women make up better story's than kids do these days.  She was probably a lazy stay at home mom that had nothing else bettert to do than concoct these ridiculous story's in her head.  Any of you here about the 5 year old girl that came home with some crazy story about a coach....later after the wash women got together they all start questioning the kids and come up with about 12 of them to accuse this guy.....later it was found the kids were lying...simple...  The parents are like, oh no not my kids...please.  Listen if the guy is a child molester then it's good he's gone but ALOT of times ESPECIALLY with a 2 year old it will turn out to be false.

I think it will turn out that the guy simnply got busted breaking into the house and he stabbed the home owner and this is the excuse/defense.   

If this happened to my kid I would immediately head over there to confront him, question him then take it from there, but not many people would wait till 3 am to break through a guys window, they would just go straight to him.

I don't think the law would agree: it's simple-shoot to defend oneself only. Morally I agree with that, wouldn't be comfortable shooting unless under the threat of attack, and then only would aim to wound, if there was the luxury to choose. A break-in by itself isn't sufficient justification to shoot someone.

I would argue that anytime someone breaks into your house, especially at night, you have a reasonable fear of imminent, seriously bodily injury or death, which justifies self defense by any means available.   

Many states used to have what I think was called the "castle doctrine" (man's home is his castle), which allowed the use of deadly force anytime an intruder broke into your home.  Don't know whether that doctrine is still alive or used around the country.

I kind of disagree here. Ya, protect yourself, ...but first determine if there even is a threat against you before you start firing indiscriminately at will.

Years ago, I heard someone entering my home through my garage at 4:00 in the morning. I happened to be awake at the time, and heard the garage door opening, as well as the door from the garage into the laundry room. First thing I did was call 911, ...then went to investigate.  It turned out my mother, who had been living in Jamaica had decided to come back to Canada. Unfortunately, she never told me, my sister, or anyone else that she was coming back. She got held up at the airport, and wasn't able to make it to my house until 4:00 am. Had I followed the 'shoot first, ask questions later' policy, she would have been dead.

I hope your wife or daughters aren't into late night snacking... they might get a louisville slugger to the head. 

There is a threat the moment an intruder sets foot in your house IMO.

Police: Daughter of Father Who Killed Neighbor Was Never Molested

NEW HAVEN, Conn. —  Police have concluded that a 2-year-old girl was not molested by a neighbor whom the girl's father is accused of stabbing to death in rage, a police official told The Associated Press Thursday.

Jonathon Edington, a 29-year-old attorney from Fairfield, is charged with killing Barry James on Aug. 28 after his wife told him their daughter had indicated James touched her inappropriately "in the starry night," police said.

Edington pleaded not guilty last week.

"We're confident this 2-year-old was not molested," said Capt. Gary MacNamara. "We are confident in our investigation that Mr. Edington did in fact kill Mr. James. We are as confident in our investigation that Mr. James did not molest the Edingtons' daughter."

MacNamara confirmed that investigators interviewed the girl but declined to release further details.

MacNamara also would not comment on whether the girl's mother would be charged. A molestation complaint was filed against James shortly after he was killed.

"The family of Barry James is adamant that Barry James was not a child molester, would never have harmed that child," Richard Meehan, the family's attorney, said Tuesday. "We fully anticipated and expected there would be nothing to corroborate this. I believe the complaint is untrue."

According to a police report describing the mother's account, the girl told her mother about the alleged molestation while the family was visiting relatives in Rhode Island.

The girl "explained that she did not want to go home because of Barry," police said in the report. When her mother asked her to explain, the girl said "that Barry puts it on her belly and her nose," the report said. When her mother asked her when James does this, she replied, "He comes to me in the starry nights."

Police say that after Edington's wife told him what their daughter said, Edington climbed through James' bedroom window and repeatedly stabbed him.

FAIRFIELD, Connecticut (AP) -- A lawyer climbed through a neighbor's bedroom window and stabbed him to death after being told by a family member that the man had molested his 2-year-old daughter, authorities say.

Barry James, 58, was stabbed in the chest nearly a dozen times Monday. The lawyer, Jonathon Edington, 29, was charged with murder and burglary and was released on $1 million bail Wednesday.

Capt. Gary MacNamara said that police had not received a complaint about the child being assaulted before the killing, and "we have no indication it's true or not true."

Edington's attorney, Michael Sherman, said the information came from Edington's wife. "The daughter gave the mother information which was alarming and disturbing. The mom relayed it to her husband. That was the spark," Sherman said.

James' 87-year-old mother discovered his body. When officers went to Edington's home, they found him standing by his kitchen sink with what appeared to be blood on him, and a large kitchen knife next to him on a counter, authorities said

"He's in shock," Edington's attorney said. "This is the most unexpected turn of events one can imagine with this young man's background."

Police had gone to the neighborhood before, when Edington called to complain that he could see James through a window, police said. "Either he was partly clothed or revealed parts of his anatomy that were inappropriate," MacNamara said.

Edington, a graduate of Syracuse University and Fordham University Law School, has been practicing patent law, Sherman said. Police said Edington has no criminal record.

Rita James declined to comment on her son's death.

James served two days behind bars in 2001 on a drunken driving charge, according to the state Correction Department.

"He had some bizarre behavior over the last month," said Darrell Maynard, a neighbor. "He drove his car through his garage, hit the other neighbor's building."

Another time a neighbor found James intoxicated on the street, Maynard said. James shouted obscenities at children, he said.

As for Edington, Maynard said: "Something had to happen that was terrible for this to have occurred." Edington "seemed like a computer geek or something. He was not anybody you would ever feel you were threatened by."

The sister and parents of Barry James claim the killing caused them emotional distress and are seeking a court order placing a $5 million lien on the property and any other assets of attorney Jonathon Edington.

A hearing on the lawsuit was planned Monday in Bridgeport Superior Court. The claim was filed Tuesday, said Richard Meehan, attorney for the family of James, who police concluded did not molest Edington's 2-year-old girl.

"There should be compensation to his estate, particularly his parents, for the ordeal they witnessed," Meehan said. "They have not been able to return to their home because of this."

A telephone message was left Wednesday for Edington's attorney, Andrew Bowman.

Edington, 29, pleaded not guilty to fatally stabbing James on Aug. 28.

According to a police report, the girl told her mother that James, 58, had inappropriately touched her.

After Edington's wife told him what the girl had said, Edington climbed through James' bedroom window and stabbed him repeatedly, police said.

James' 87-year-old mother, who is legally blind, lived with him and was present during the killing, legal papers say. In the lawsuit, the family claims she suffered "serious, severe shock and emotional injury."

Edington faces murder and burglary charges. He was freed on $1 million bail and was ordered to have no contact with James' relatives, who lived in the house where James was killed.

If she's blind, then she didn't 'witness' shit.

Sucks that the victim was killed for something he didn't do, but failure to act with due diligence is the reason this Edington guy was doing patents instead of real law.

And that's too bad considering that kids in general lie to easily and way too much.  Couple that with a gossipy mom and you get a time bomb, which is exactly what happened here.  Too bad for the innocent victim.....If the wife really did relay the lies to her husband she should get life as well for being an accessory to murder.
