Is 23 years in the slammer for blowing a 16 year old too much?

a 41 y o texas mom recently got this sentence.

she was offered 7 years probation if she plead out, but she didn't want to be classified as a sex offender, so she went to trial in Williamson county (n. austin).

her lawyer was the geriatric but famous racehorse haynes. could be looking at malpractice if it was his advice not to take the probation offer.

If the kid isn't going to have any lasting negative effects from the oral sex then what the hell is the point of sentencing her to prison? Probation would have been sufficient.

so they gave her prison time.

i am guessing that the premise for the law is something like..

"The participating in, or recieving of, sexual acts with a minor is a emotionally scarring action to the minor whose mind is not fully matured and developed yet; and thus can and will lead to mental instability, at leats in the sexual realm, in later life. such actions, when performed by an adult; are to be deemed a crime, because they are such for reason prior explained. while the effects of crimes on most victims are tangible losses; it does not have to be so in order for the crime to be punishable by law. In the case of Statutory rape, the effects to the victim are not apparent untill time has passed; so rulings are not based upon what the victims emotional state is currently like; but upon what experts deem the future damage to the victims mental health will be"

maybe if she had braces, ...it might be an appropriate sentence, ...

But seriously, it is shameful, ...especially in light of being offered 7 yrs probation.

it is saying if you dare to exercise your legal right to be tried by a jury of your peers, you will be convicted punitively. Don't like the idea of adults having relations with minors regardless of the sexes, but that is excessive. Hopefully she can appeal it.
