Because Obama is not in a beauty pageant posing for lingerie ads and it wasn't perceived as a politically incorrect thing for him to say it.  Most applauded him saying it because he didn't try to dance around the issue.  Also I don't think Obama didn't state his religious beliefs as a reason for saying it.

Iv had photoshoots myself, and you can tell when pics are taken by "ACCIDENT" and when you are posing properly... those pics were NOT an accident and any photographer, model or human being with common sense can tell that...

Photographer cant be sued...Copyright laws in the United States go to the person who took the pics... Since photography is considered "Art" the intellectual property is owned by the person who Takes the pics... he could sue HER if she used them with out HIS consent...  Now if she was 17 he could be jailed for "kiddy porn" since she is underage...
