SC makes the right decision and overturns sotomayor

WASHINGTON —  DEVELOPING: The Supreme Court ruled Monday that white firefighters in New Haven, Conn., were unfairly denied promotions because of their race, reversing a decision that high court nominee Sonia Sotomayor endorsed as an appeals court judge.

New Haven was wrong to scrap a promotion exam because no African-Americans and only two Hispanic firefighters were likely to be made lieutenants or captains based on the results, the court said Monday in a 5-4 decision. The city said that it had acted to avoid a lawsuit from minorities.


The fact that it was a 5-4 decision is very troubling this is a no brainer imho but at the very least they got it right. If you read the dissent from the four "understandably attract this court's sympathy. But they had no vested right to promotion. Nor have other persons received promotions in preference to them." I can somewhat understand what they are saying but the city itself says that they didnt promote anybody b/c of fear of law suits by minorities. While nobody recieved promotions in preference to them they were denied promotions in preference to others...

Again the fact that it was this close of a decision is very troubling and frustrating.

Thankfully, for these firefighters, this was overturned but the vote was disturbingly close.
We cannot continue preferential treatment in this country.  Its not black and white anymore.  Its time to treat everyone equal now.

Justices Stephen Breyer, David Souter and John Paul Stevens signed onto Ginsburg's dissent, which she read aloud in court Monday. "

How can Ginsberg justify that statement?  Thats ridiculous.  If a bunch of black firefighters were held back because they scored better, I'd be complaining they were discriminated against.  We must treat each other fairly and equally in this country.  The country is a mix of people now.
