Gym Rant II: I really need to cancel my membership NOW

Earlier this evening, my baby mama wanted to take my daughter and her cousin (who is visiting for a week or so) to the gym.  They were going to be in the kids area for about an hour while we trained and then we'd take them swimming there immediately afterwards. 

Because I had to take care of the dog, they got there about 10 minutes before I did and when I arrived, K told me that they'd been denied entry...because the cousin is not our child.

She was frustrated and walked out and I believed her when she said she didn't cause a scene (her usual M.O...just one more reason for the divorce, for those keeping score at home - lol).  She hadn't spoken to management, though, just the desk clerk, so I told her to take the kids for ice cream and then to the local water park, while I went in to argue the case. 

After a brief wait, I was able to speak with a very polite young manager, who explained their policy to me.  I told her that, while she's with us, we're her legal guardians and we have to make decisions on her behalf as if we're her parents and we're liable for her welfare as if we're her parents. 

I then told her that her liability waters are already murky given that most kids under the age of, say, 16 don't have any identification anyway.  She agreed that a person could easily identify a child as their own and sign them in without any verification whatsoever. 

At any rate, I do applaud this particular manager for understanding why they're not exposed to any greater liability allowing a guardian to sign in a child than they would be if a parent signed the waiver...especially considering the lack of verification of the child's identity. 

If something were to happen and the club is found to be negligent in their supervision of the kids in the play area or is determined to knowingly allow an unsafe condition to exist in there, they'd be liable for any injuries *regardless* of the identity of any of the children in their care.

In closing, she did agree to grant us a one-time exception and to waive the additional child's fee if K wants to take them there again, so I guess we'll take advantage of that later in the week. 

That's the story. 

As a GetBigger, should we be deceptive and say that the child is ours?  I'm probably not going to pass for the dad of a white kid LOL, but there's no reason why K couldn't be her mother.

He should have did a back double bicep pose at the manager and screamed 'I have pro size naturally' and that although his babymama is a 'mudshark' he is 'no doubt a man with muscles' so the manager should just 'back off'

Tre--seriously dude, you have some anger management issues.  They don't allow you to bring just any kid to the childcare area for two reasons.  First, is a licensing issue.  They would have to be licensed as a daycare in my state if the gym allowed that.  Second and most importantly, you are not their legal guardian unless you have a power of attorney executed by the parent.  When you sign the kid into childcare you probably sign a liability waiver.  That waiver would not be effective if a non-parent siged it for a kid.  Without the waiver, childcare cost would be prohibitive (thank you trial lawyers).  Also, if medical care was need you could not legally consent for the child.

Step back, take a deep breath and relax dude.  It's just working out.  It aint that serious.

Bingo!  No gym, other than the one in your home is going to be exactly as you would like.  Stop searching for excuses to not workout and then coming here for validation.  Adapt Tre, adapt!

Whoa whoa...just for clarification, I get what you're saying about my anger and going with the flow, but my motivation isn't a problem at all.  I'm absolutely obsessed these days in regards to my training and nutrition (thanks, GetBig!). 

My daughter's mother, however, is a different story.  She's got issues when it comes to getting to the gym and hates the very concept of clean eating.  Although I didn't include this part in my long-ass story, this was to have been our first workout together in a LONG time.  She might've worked out 6 times all year.  She had asked me to train with her and believe me, that's a HUGE step.  I'm hoping she won't be deterred, but it was a big deal for her to want to do it at all.  I think it's important for our daughter to see her mom making working out a priority. 

I still got in and blasted legs...including a giant drop set to 120+ reps on the leg press.  I haven't missed any workout because of these recent incidents.  They haven't been deal-breakers in that regard. 

When I'm into something, I get a bit obsessive.  Being back into hard training for the first time in years feels great and yeah, I definitely want things my way...little impediments aren't cool. 

But doesn't my way make so much sense, though??  At some point in the next few weeks, I'll see whether my attorney can answer the question of whether a non-parent can legally sign a waiver for a child.

I really hope you aren't paying your attorney for that research.  I will do it for you at no cost.  Here's the answer--NO.  Unless you are a parent or legal guardian you can't sign away a kid's rights.  Seriously dude, just drop it move on.  You sound like the twinks that get all pissy about planet Fitness having a sign about grunting.  Get over it.
