If the Native Americans were strong enough to defend their territory, they would have repelled the Europeans and who knows what the USA would be right now, but almost certainly not the USA. What don't you get about this? Do you really think the Europeans gave a shit about the laws of the Native Americans? No they cared about British or French law or whoever was there at the time. There was something they wanted they took it, by force if necessary. Saying well it just shouldn't be like that doesn't play into the equation, and you can't look at things from a modern day perspective either.
