It's the company's fault for not having a more secure structure to hold there product.
This statement (not picking on you) is what's wrong with todays society. It's not the operaters fault for gassing a multi ton machine into a support beam, it's the companies fault for not having a more secure structure, that can sustain catastrophic impacts, due to negligent driving!!!
This is pretty simple, imo. You see the machine launch a puff of smoke from the exhaust when the driver hits the throttle by mistake. It's 100 percent the operators fault. Now, one could argue that providing the fork lift operator has a spotless driving record, that what happened was a freak accident, but the fact of the matter is that Mr operator royally fucked up!
