If you’re frustrated by poor service at a restaurant, think twice before you decide to not tip. You may be in for a bit more than just a dirty look from the waiter.

"Nobody, nobody wants to be forced to pay a tip or be arrested for terrible service," Leslie Pope said when her happy hour ended in handcuffs.

Pope and John Wagner were hauled away by police and charged with theft for not paying the mandatory 18 percent gratuity totaling $16 after eating at the Lehigh Pub in Bethlehem, Pa. with six friends.

Pope claimed that they had to wait nearly an hour for their order and that she had to get napkins and silverware for the table herself.


“At this point I became very annoyed because I had already gone up to the bar myself to have my soda refilled because the waitress never came back,” Pope said.

After the $73 bill came, the group paid for food, drinks, and tax but refused to pay the tip. After explaining the bad service to the bartender in charge, Pope claimed he took their money and called police. The couple was handcuffed and placed in the back of a police car.

“I understand that, you know, we didn’t pay the gratuity, but it was a gratuity, it wasn’t something that was required,” said Wagner.

The owner admitted that the group waited unusually long for their food, but said the pub was extremely busy that night. He said managers offered to comp the food, a claim the couple denies ever happened.

“Obviously we would have liked for the patron and the establishment to have worked this out without getting the police involved,” said Deputy Police Commissioner Stuart Bedics.

Police charged them with theft since the gratuity was part of the actual bill. However, it is doubtful that the charges will hold up in front of a judge. The couple is scheduled to appear in court next month.

A tip (also called a gratuity) is a voluntary extra payment made to certain service sector workers in addition to the advertised price of the transaction.

While I think there should be some sort of sliding scale for gratuities, there should never be anything mandatory about tipping, or else the waiters will just slack off.

I've had some horrible service in my time, one time leaving .25 for a $70 dollar bill. Other times I've left notes at the top of the receipt saying "horrible service! You suck" too.

Is it on the Philly Lawbooks for a mandatory gratuity? If so, that shit is wrong. I shouldn't have to tip for bad service. Let's say, that I don't even get my food and I wait an hour and then leave, you gonna have me arrested for not tipping? Or if they bring me the wrong order, spill drinks on me, so I still have to tip? Fuck that!

So - I would say that legally speaking, the owner was within their rights to push for payment.

Having said that, they must be as dumb as dogshit to call the police over it and have their customers handcuffed and marched out of the place.

Also - the cops must have handled it badly too - why handcuff 2 people who paid for their food but were unwilling to pay for shitty service. It's not theft - it's a civil issue.

I'm surprised the police didn't taze them.

Stripping doesn't count, if it did, I'd be a whole lot of competition for you...make you work for that tip.

BTW, I'm considered a generous tipper, so much in fact, that twice the woman I was with either said, "No, that is too much!", or "What the hell are you thinking?", but yeah 18 percent gratuity, fuck no, if it is on the menu, I'm rolling the fuck out. Get me a damn cheesesteak or a pizza and call it a night!

Isn't it a requirement that a customer sees and fully understands the total price of anything (s)he buys? Around here it is, and I'm sure there is something like that in US too.

I don't understand people that say they make a living off their tips, what a weird part of american culture. Get a new job if you must live on peoples pity.

bingo. we dont tip in australia either. pay people for their work and adjust your tax system, dont rely on the citizens to prop up a crap financial framework.

i remember not tipping when i was in the US and couldnt believe the look i got from the staff. its like they expect it.

if they expect it, then for gods sake put an extra 10% on the price of menu items and sort it out amongst yourselves.

are you serious?..you have to tip for such clever things like not waiting for an hour, getting the right order and not spilling a drink on you?

isnt that an expected part of the service youve already paid for?

if they want to gain extra $, they should detail what it is exactly what you are getting with your meal. i.e. in the place mentioned above...theyve had to explain that what you are paying for is just a meal..excluding delivery to you in a timely manner and without messing it up.

Very common for a tip to be added in for a larger group.  Almost all restaurants do this.

And for those that don't understand why some "rely on tips" it's because wait staff aren't entitled to make minimum wage.  They rely on tips to make up the difference.

All that said, the pub sucks ass.  If you make someone wait an hour and give them lousy service during that time......and then call the cops?  C'mon, hope they go out of business.

No, I've never held a job in the service industry...except a 4 month stint as a bouncer at a bar.

I've eaten at many restaurants/bars/pubs... what have you. I expect great service no matter where I choose to eat. I don't give a fuck if the restaurant is short staffed and it took you 10 minutes to refill my water or it takes forever to take my order. Not my problem. You're getting a shitty tip.

I went to Friday's a while ago and had a table near the back where the waiters punch in your orders on the screens. I guess one server was late so the one who was supposed to punch out had to stay extra to cover my table. This fucking bitch didn't even make eye contact with me, didn't ask if I needed refills on my drink, never brought me a napkin after asking her three times. Guess what? Fuck you & your tip!

The best service I've ever had was Texas de Brasil here in Chicago. Those gauchos/waiters pamper the shit out of you. I dropped a napkin on the floor and before I could pick it up, a waiter got it and another one brought a fresh one. Outstanding service. I always feel good about tipping there.

Obviously, I don't expect 5 star service at a $10/plate restaurant. Just normal courtesy and timely response when I ask for something.

I have many friends in the service industry who complain about shitty tipping.  These motherfuckers average more per hour than the pharmacists I work with doctorate degrees! I never tip on the % of the bill, only on the quality of service. There's no way some douchebag with spikey hair and flair on their uniform should be making couple hundred bucks a night bringing me a beer/plate/whatever.

no, big party of people you pay gratuity. Pretty std in places that are at least good. If you don't want to pay a tip i know a nice little scottish place that your don't have to tip at.
