My dad actually died when I was 24 of a massive hemorrhagic stroke.  His family and kids will be taken care of just fine.

You have to prove it was that person who did it. Like Text messages, it could have from that computer or cell phone, but there is no proof that the person wrote it. Could have been a friend, a child, a passerby.

Furthermore, chances are this would be handle at the state level, not federal. And chances are the state's laws (depending on the state) may or may not be that harsh. As this can infringe on a person's 1st admendment right. A person can threaten you face to face, and vice versa.

GINO AUGUSTUS TURRELLA, 47, of Des Moines, Washington, was convicted today in U.S. District Court in Seattle of 19 felony counts regarding threats he made against the Boeing Company, Shell Oil, and Chevron Oil Company. The jury deliberated about five hours following a four day jury trial in front of U.S. District Judge John C. Coughenour. TURRELLA was convicted of two counts of making Interstate Communications with Threat to Injure Person, seven counts of making Threat by Instrument of Interstate Commerce, one count of Possessing a Firearm during Threats of Violence, and nine counts of Identity Theft. TURRELLA faces a mandatory minimum five years in prison and up to 10 years in prison when sentenced on February 19, 2010.

You didn't read, you have to prove THAT THE ACTUAL PERSON WROTE IT. You have no proof. It could be a friend, a family member, a minor child, or a stranger who was paid to do it. Kinda like somebody flattening your tires. You actually have to see it, have knowledge of it (they admitted to the person that they did it), or another person saw it or has knowledge of it (they told that person they did it). Otherwise there is no probable cause.

No you don`t have to "actually see it".  Circumstantial evidence works well and convicts just as easy.  Besides, it would be simple to prove he is the author of the posts directed at harming me.

Hammer had made statements on an internet page which described threats of serious physical injury and or death directed toward a local resident. Investigators used a variety of sources to uncover his true identity. Once Mr. Hammer was identified, a warrant was issued for his arrest and he was lodged in the Barren County Correctional Center.

Jackson, Miss - Steven Joseph Christopher was arrested by agents of the United States Secret Service today for making threats against President-Elect Barack Obama, U.S. Attorney Dunn Lampton announced. Christopher, who is from Wisconsin, was arrested in Brookhaven, Miss. Christopher made threats against President-Elect Barack Obama on an internet chat forum on Jan. 11, 15 and 16, 2009.

"Threats against the President-Elect will be taken very seriously," said U.S. Attorney Lampton. "Use of internet chat rooms to express those threats is as much a crime as uttering the words. Threats of this nature will be pursued swiftly and vigorously."

According to an Affidavit filed by Special Agent Kelly Adcox with the United States Secret Service, Christopher posted the following on the Web site www.alien-earth.org on Jan. 11, 2009:

Christopher was arrested without incident by agents of the U.S. Secret Service and members of the Lincoln County, Miss., Sheriff's Department and agents of the Mississippi Bureau of Investigation pursuant to a criminal complaint charging him with a violation of Title 18, United States Code, Section 871 which makes it a crime for anyone to threaten to kill the President-Elect of the United States. The maximum penalty for this offense is 5 years in prison and a $250,000 fine.

Lampton praised the efforts of local law enforcement for their assistance in this matter, particularly the Sheriff of Lincoln County, Steve Rushing, and his deputies, along with the agents from the Mississippi Bureau of Investigations.

Not that there’s ever a good time to unleash death threats across trendy Web communities but, given its recent surge of popularity and market growth, using online micro-blogging service Twitter to announce upcoming personal bloodbaths probably isn’t a particularly good idea.
More specifically, the Federal Bureau of Investigation (FBI) has moved quickly to collar a 52-year-old man in Oklahoma who used Twitter’s expanding community to announce his plans to unleash an attack during an organised ‘Tea Party’ tax protest.
“Locked AND loaded for the Oklahoma State Capitol,” wrote Twitter user CitizenQuasar (identified as Daniel Knight Hayden) in his penultimate blog message, or ‘tweet’, which was posted on April 15. “Let’s see what happens.”
With authorities swiftly alerted to the potential threat, the FBI duly arrested Knight Hayden later on the same day, according to the U.S. Attorney’s Office in Oklahoma City.
Other inflammatory and threatening tweets posted by Knight Hayden between April 11 and April 15 included:
“Of course they will kill me BUT life is no longer worth living. NOT in Oklahoma!”
“After I am killed on the Capitol Steps, like a REAL man, the rest of you will REMEMBER ME!!!”
“I really don’t give a shit anymore. Send the cops around. I will cut their heads off… and throw them on the State Capitol steps.”
Wired reports that Knight Hayden’s personal page on social networking site MySpace is, “a breathtaking gallery of right-wing memes about the “New World Order,” gun control as Nazi fascism, and Barack Obama’s covert use of television hypnosis.”
Following his arrest on April 15, Knight Hayden was arraigned on April 16 before being released to a halfway house pending trial on federal charges of making interstate threats.
