Sheriff responds to lawsuit settlement

HAMILTON — The Butler County sheriff said he settled a lawsuit with an arrested undocumented immigrant worker for $100,000 because the other side didn’t want to go to trial, an explanation disputed by the plaintiff’s attorney.

“Basically the other side didn’t want to go to trial, they didn’t want to take a chance on losing,” Jones said Wednesday, April 21.

Luis Rodriguez, 44, formerly of Lebanon, filed the lawsuit claiming his constitutional rights were violated in 2007 when he and others were rounded up at a Port Union Road construction site by Butler County deputies and a former immigration specialist hired by Jones.

Jones added that there would have been serious ramifications to law enforcement if the county lost at trial.

“Both sides came to an agreement,” he said. “We believe we would have won if we had gone to trial.”

However, Rodriguez’s attorney, Al Gerhardstein, said Tuesday he was prepared to go forward with the case.

“I certainly was prepared to go to trial,” he said. But he said there had been ongoing negotiations on a settlement for weeks.

Gerhardstein argued that Jones did not have power to enforce the federal civil immigration law. The case was pending on motions for summary judgment and only weeks away from trial when the county agreed to pay $100,000 in settlement of the claims, Gerhardstein said.

Gerhardstein said his client, who had lived in Butler County for 11 years, was arrested and charged with providing a false identification and deported to Mexico, though he was later acquitted of the charge.

Rodriguez, who admitted to being in the country illegally and voluntarily departed the country in August 2008 to live in Mexico, will never be allowed back in the United States, Jones said.

Jones’ attorneys had argued investigators did not violate the law when they conducted a work site visit Jan. 2, 2007, according to court documents. They stated it is clearly established that local law enforcement may conduct activities relating to the enforcement of federal law.

Yes, it's sitting in front of the Jail....  I'll see if I can find another photo.

He actually sent a bill to Mexico for all their citizens that he's housing in the jail.  ;D

How is it treason?  His rights were trampled.  You can cover it up with 'oh we knew we'd win but...' truth it it was challenged and they backed down so Luis in my opinion is in the right here, his rights were trampled and he now is 100k richer.  American dream really litigation to an elevation in bank balance.

now, if legal AMERICANS are rounded up and carded - that would be some bullshit.  Neither side seems to be able to CLEARLY break down EXACTLY what the law lets police do.  Weird.

I'm really curious why liberals are such huge supporters of so called illegal-immigrant rights? Why are they not concerned about all the problems that have already contributed heavily to the bankruptcy of states like California. Now, there's a dangerous contingent of illegal alien drug smugglers plus the overburdening of social services.. I really don't get it. How can anyone who is not an illegal alien be upset that Arizona signs a bill that permits you to actually question someone whether they are legally in the country? I understand if you're a politician and you don't want to alienate hispanic voters, but why would any other decent American not support this bill. If there were a ton of illegal Irish people flooding the borders and a cop asked me to show my drivers license to prove I wasn't one of them, I wouldn't care. I really can't comprehend the liberal mindset at all.

I've only been pulled over one time in my life, and the cop let me off.  He was friendly, I was friendly, decent cop...  Still I was pissed off, I can't even imagine being "detained" like you were.  I'd have a fucking meltdown...

Person X comes into the states illegally. His illegal status dosent override anything dealing with his imaginary "rights" i mean. Its pretty retarded to me that an illegal can sue someone when the lawsuit revolves around his illegal status.

Happens all the time.  I had a case recently involving illegals on a construction site who got hurt and they walked away w money. 

I represented one of the subs and the legal status did not make any difference at all.

Of course it won't skip.  I already posted a thread about a week ago on this and how the libs stripped language out of the bill at the last minute allowing illegals to sign up for this once amnesty goes through.
