(CNN) - Kentucky Democratic Senate candidate Jack Conway is putting the heat on GOP rival Rand Paul over Paul's recent comments regarding the 1964 Civil Rights Act.

Paul - the Tea Party favorite who easily beat Kentucky Secretary of State Trey Grayson in the state's May 18 Senate primary - repeatedly dodged questions in recent media interviews about whether he thinks parts of the landmark legislation amount to a constitutional overreach.

An interview with the Louisville Courier-Journal last month highlighted Paul's controversial views during which he said: "I don't like the idea of telling private business owners-I abhor racism-I think it's a bad business decision to ever exclude anybody from your restaurant. But at the same time I do believe in private ownership. But I think there should be absolutely no discrimination on anything that gets any public funding and that's most of what the Civil Rights Act was about to my mind."

Following his primary victory on Tuesday, Paul was again questioned over his views regarding the legislation on National Public Radio and MSNBC's Rachel Maddow. In response to questions, Paul said he supports the 46-year old measure except for the provisions that outlaw private businesses from discriminating on the basis of race.

While stressing that he is opposed to discrimination in any form, Paul suggested the measure runs up against individuals' First Amendment and property rights.

"I think what's important in this debate is not getting into any specific 'gotcha' on this, but asking the question 'What about freedom of speech?' Should we limit speech from people we find abhorrent? Should we limit racists from speaking? I don't want to be associated with those people, but I also don't want to limit their speech in any way in the sense that we tolerate boorish and uncivilized behavior because that's one of the things that freedom requires," he said.

Well,again,it is a motel and to get there you are travelling on government roads.So its a sticky issue.Id ask can the miss blac America contest discriminate against whites,couldnt this harm a potential white women the opportunities that come with the title?

I'm not sure a contest is really similar to a motel, restaurant, etc. (e.g., a contest doesn't really engage in interstate commerce), but I do think they should get rid of race-exclusive contests.

This is really amusing.Let me get this straight.Paul said he would have wanted a debate on the issue and the left dubs him a racist.Obama sits in a church for twenty years listening to rev. Wright,wrote a book based on his sermon,said he couldnt throw wright under the bus and NONE of that makes Obama a racist.Even when Wright said the reason he doesnt see Obama in the white house is because "dem jews wont let me see him".[which was just another example of his racism].NONE of that points to Obama being a racist,but Paul,because he said he would have wanted a debate on the issue is a racist.WOW!!!!!!!!!!

TO BEACH BUM,THE CONTEST HAS MONEY PRIZES AND IS A BUISINESS.

I guess you can make an argument that a beauty contest engages in interstate commerce because women compete from different states for money. 

I wonder if any woman has ever tried to compete in one of those contests and was precluded based on race?  Although you'd have to wonder why, for example, a Hispanic woman would try and compete in the Cherry Blossom contest (Asian).

I don't think it's all that complicated.  I like the public accommodations, interstate commerce limitation.  That still allows a private school, private club, etc. to do whatever they want, so long as they don't get government funds.  

Paul ought to leave this issue alone, because it will only become a major distraction.

In a May 30, 2002, letter to the Bowling Green Daily News, Paul's hometown newspaper, he criticized the paper for endorsing the Fair Housing Act, and explained that "a free society will abide unofficial, private discrimination, even when that means allowing hate-filled groups to exclude people based on the color of their skin." (Hat tip: Page One Kentucky.)

"The Daily News ignores," wrote Paul, "as does the Fair Housing Act, the distinction between private and public property. Should it be prohibited for public, taxpayer-financed institutions such as schools to reject someone based on an individual's beliefs or attributes? Most certainly. Should it be prohibited for private entities such as a church, bed and breakfast or retirement neighborhood that doesn't want noisy children? Absolutely not."

In language similar to the language he's used talking about the Civil Rights Act, Paul criticized racism while defending the right of businesses to discriminate.

"A free society will abide unofficial, private discrimination," wrote Paul, "even when that means allowing hate-filled groups to exclude people based on the color of their skin. It is unenlightened and ill-informed to promote discrimination against individuals based on the color of their skin. It is likewise unwise to forget the distinction between public (taxpayer-financed) and private entities."

Well the problem with that 333 is that all men are created equal according to the founding fathers.  By that standard you can not discriminate against anyone else based on skin colour in the United States of America.  Private does not mean 'above the law' you can not have a private murder club or rape club either.

Sexual segregation is still a legal and permissible thing.  It is NOT the same as racial discrimination in the eyes of the law or the constitution.
