Family of slain woman sues Chinese steroid suppliers!

The family of Amanda Jo Earhart Savell, the fitness competitor killed by convicted steroids dealer David Jacobs two years ago this month, has filed a federal lawsuit against Jacobs' Chinese steroid suppliers, saying their products contributed to his "steroid rage" that led to her death.

 Kathy and Gary Earhart of Plano  filed a federal suit in Marshall, Texas, on June 4 against Lei Jin, whom the petition describes as a Chinese citizen in Shanghai with a residence in Wisconsin, and GeneScience Pharmaceutical Co. Ltd., also in Shanghai

This case will be thrown out soon.  For starters, you can't sue a company based in China because an owner has a residence in Wisconsin not to mention that there is no way to distinguish what products was Dave Jacobs taking.

I knew/know several people very close to this situation and spoke with Ron a good amount about them when this all happened.  I will always believe that there was way way more to this story than the conclusion we were led to believe.

yep.  dave did have a big mouth.  i talked with him briefly a few times in metroflex in between sets while resting.  we were never anything more than a 'hey man' acquaintance at the gym, but he told me the names of some of the people he sold to.

even if you discount all the conspiracy behind it, and just look at the solid evidence- who shoots themselves in the stomach when they off themselves- its the slowest way to die from a gun shot. being gut shot means you bleed out, no immediate death there.

That dude loved to tell people who he sold to....

His typical conversation with a new person would go like this;
Guy: "How's it going?  I've seen you around, your name is Dave, right?"

Dave: "Yeah, my name is Dave.  I train with Branch Warren.  I sell gear to......."

Guy: "Okay, have a good workout."

Dave: "You too.  I train with Branch Warren.   If you need gear, I sell to ........, so I can get some if you want."


Can't imagine how that dude got caught.

What a waste of time

This is inaccurate.  If a foreign company places anything into the stream of commerce (i.e., ships products here), any state to which products are shipped would have jurisdiction to hear such a case.  However, the real reason this suit is pointless (from a legal perspective) is that China has no reciprocity agreement with the US, meaning a US judgment cannot be enforced in China.  They may be able to attache the Wisconsin residence, but this is only if they get a judgment against the actual owner of the residence.

Forget about all the legal issues she has, ie no provable causation, intervening criminal act, etc.

I think the lawsuit lists 50 John Does plus anyone associates with Jacobs.  Blaming steroids has nothing to do with what happened.  Two years has past, but the pain for the family and friends will always be there. 

I guess if you are going after the steroids dealers, then might as well go after the gun dealers too, and also the places they ate at, and more.
