The felony worthless check warrant that two Tampa police officers were about arrest Dontae Morris on during a traffic stop Tuesday night had been issued before the convicted drug dealer was to be released from prison three months ago.
Yet, Morris, charged with gunning down the two officers, David Curtis and Jeffrey Kocab on Tuesday night, was able to walk out of prison. He remains on the loose and a massive hunt is on for him involving some 200 law enforcement officers from a wide variety of local, state and federal agencies.
As grief-stricken Tampa police officers continued their relentless search for Moore today, his release from prison nags at Police Chief Jane Castor.
She said the circumstances around his release – the outstanding warrants – are not a priority at the moment.
"I am focused on catching him," the chief said this morning. "If errors were made (in releasing Morris from prison on April 4), we will look at that after he has been captured."
Two of the bogus check warrants issued in Duval County are misdemeanors and likely would not have held up his release, law enforcement officials said.
The felony warrant might have, but it was never received by the Florida Department of Corrections, said Gretl Plessinger, spokeswoman for the department.
"We did find a warrant in this case out of Duval County," Plessinger said on Thursday afternoon. "We contacted Duval County and they notified us that they did not want to extradite or detain the inmate.
"We only can hold inmates who have been convicted and sentenced to state prison," she said. "If charges are pending, we don't hold them."
The exception is if law enforcement agencies file detainers to hold an about-to-be-released inmate, she said. And that wasn't done in Moore's case.
"We can't hold anybody past their court-ordered time," she said.
She said contact was made with the Jacksonville Sheriff's Office in Duval County in October and again during the days before Moore was released to double check about whether a detainer would be filed of if deputies would pick him up before his release on the felony charge.
"There was one misdemeanor warrant," Plessinger said. "We did not find a felony warrant."
Jacksonville deputies told corrections officials they would not file a detainer on Morris.
Jacksonville Sheriff John H. Rutherford said the misdemeanor warrants call for extradition only in Clay, St. Johns, Baker and Nassau counties.
The felony warrant has a statewide extradition order, and even though the department of corrections did not receive the felony warrant, it did go out to state law enforcement agencies to pick Moore up.
Rutherford said his office is reviewing its October 2009 communication with the department of corrections regarding Morris' release from prison.
"We are working to determine if our Records and Identification clerk missed the third worthless check warrant," he said, "which indicates a statewide extradition order."
Further complicating the matter is that the checks were said to be written to Publix in Jacksonville in April 2008, after Moore began his two year sentence in prison
