Cops Claimed To Have Done No Wrong In This Case

Some of you may have heard of this case which happened in 2008 of a homeowner whose home was broken into by a escaping armed man terrifying the homeowner and his wife and children. The homeowner and family raced into the back of the home where the homeowner retrieved his gun and the potential bandit held until the police arrived. When the idiotic police arrived they immediately shot the homeowner SIX TIMES leaving him with serious damage and a life of pain and suffering. The home owner is seeking a little under six million (far too little) for the near life ending encounter and the cops of course were recently found INNOCENT of any wrong doing.

A homeowner who was holding an intruder at gunpoint just before a Phoenix cop shot him multiple times is seeking at least $5.75 million from the city for himself and his family.

Tony Arambula, 35, still suffers pain and will require several more surgeries following the September 17, 2008 shooting, according to a notice of claim filed Monday with the city of Phoenix. Attorney Michael Manning, who's made a name for himself on high-profile cases involving mistakes or abuses by law officers, states in the claim that if it comes to a jury verdict, the city may end up paying $5 million to $9.5 million -- or more.

The case -- told in a readable style by Manning in the notice of claim -- is a fascinating, bizarre and tragic tale sure to send chills up the spines of Arizona's many gun enthusiasts:

A crazed man wielding a 9mm handgun broke into the Arambula's home near 32nd Street and Osborn while the family was inside. Tony crawled with his youngest son to meet his wife -- a legal secretary for a local law firm -- at the back of the home, then got his own gun and confronted the intruder in his oldest son's room. The older boy fled out of a closet while his dad held the stranger at gunpoint.

Moments later, three Phoenix cops burst into the home. They had already been in the area to look for the gunman, who had already frightened the owners of another home.

According to Manning's notice of claim, six-year veteran Officer Brian Lilly then shot Arambula in the back, blowing a hole in him the size of a Dixie cup. The officer fire several more times, hitting Arambula in the legs and arm.

Arambula had been on the phone to 911 at the time: "You just killed, you killed the homeowner," Arambula told the operator.

A transcript of the 911 call attached to the claim records the obscenity-ridden reaction by police, who quickly understood a mistake had been made.

Arambula didn't die. But his survival, says the claim, came despite further bad treatment by the cops. Manning says cops dragged the bleeding homeowner across gravel, right in front of his wife and kids, and then tossed him on the superheated hood of a squad car.

The intruder, Angel Anastacio Canales, was arrested. The 9mm was found under one of the kids' beds. When Channel 15 (KNXV) came to her door later, Lesley Arambula (pictured above) called her husband a hero.

Tony Arambula may still need to have a hand amputated, and "doctors have told him to expect a lifetime of pain and arthritis..." in his wrist and knee. Another source of pain is Arambula's hip -- surgeons busted it apart to obtain material for a bone graft in his wrist.

Manning's claim says Arambula is willing to settle the case for $3.5 million for himself, plus $750,000 each for his wife and two kids.

IT WAS AN ACCIDENT...were they wrong of course they were and he is entitled to and will receive a settlement...

youre article doesnt say anything about the cops being found innocent of any wrong doing...

you should also know that accidents arent wrong doing...wrong doing is purposeful actions or actions outside of the scope of their job...

Cops being found "innocent" doens't mean they didn't shoot before giving an order of "Drop the gun".

it just means they were cleared.  The rodney king cops were cleared too, right?  They were obviously dogshit guilty of beating a man once he stopped moving.


Granted, this guy should have either shot the guy or beat him in the head a bit (what I would have done lol).... and initially, he should have exchanged verbal LOUD orders with the police upon their arrival.  More than likely, they ran in with guns drawn, saw him and opened fire.  Shooting him in THE BACK is a clear sign of that.  The cop saw a man with a gun, and they have a responsibility to order him to drop it.

The article is an old one I posted just to recant the details of the story. The announcement (CNN) was made last night of the cops being found "innocent of wrong doing". It was NOT an accident as the audio tape of the exchange was also played on the air last night and it was clearly said by one of the cops "I FUCKED UP" "I FUCKED UP" "I SHOT THE HOMEOWNER". What makes the matter worst is Leslie Arambula made it very clear to the arriving cops that her husband had a gun and was holding the 'bandit' in their bedroom on the floor at gun point. Now how the hell much more information was needed for the braindead cops to know which one was the assailant and which one was the victim. Thankfully Mr arambula did NOT die and not near scumbag cop returned with an apology or any sorrow.

However let a scumbag cop be shot and there is no end to the claims of the person doing it deliberately, declaring war on cops, being a murderer or attempted murderer and you can bet the person will NEVER be excused for the crime.

BTW Are you a cop? You are always in defense of those idiots and their actions. It is just a matter of time before you are their victim ... let see how you respond afterward.

The operator on 911 might be to blame if they didn't let the cops know of the situation (not that this would justify the cops' actions 100%). Otherwise if the cops ignored what 911 had told them then they couldn't claim "accident".

Still the guy should sue the city and the PD to the ground, 6m for his damages are nothing.

some ppl defend the cops every time, you see that a lot.

we weren't there.  But just because "he was found innocent".... well, that doesn't mean he followed procedure.  yeah, either the 911 operator fuct up, or the cop didn't listen and just went in hot.


NOTE: When my brother shot a guy at his pharmacy, he already had his gun locked back and hands in the air when they arrived.  Of course, there was nobody to hold at bay in that situation.

LOL no bro Im not a cop but have known my fair share a couple of whom have been shot in the line of duty...

all youve done is give your accounts of the events...no offense jagson but you have a reputation of spinning shit so please post a link to back up your accounts...from this article the police didnt know he had the perp at gun point for all they knew he was the perp...we dont know if they asked him to drop the gun or not 240 it doesnt say so in the article...so please post a link...

I dont back the cops I WAIT FOR ALL THE FACTS!!!!!!!!!!!!!! unlike many including jagson who cant wait to condemn them without even hearing the facts of the situation...
