I’ve recently had gotten a response from Dr Connelly and spoke with him for about an hour in regards to the lawsuit and had gotten additional information from Aaron Thomas and now I have enough information to give a final analysis of the company and give a proper assessment of the company lawsuit. Due to the complexity of this matter, I have also consulted with a number of nutritional experts in the field such as Dr Layne Norton and contacted a number of manufacturers as well to to conclude the issues in regards to the formula. Just to let everyone know, Dr Norton has only provided a general analysis of Connelly’s research on hydrolyzed whey protein concentrate and has no opinion on Dr Connelly or Aaron Thomas allegations. In other words, Layne helped me understand the Progenex formula in plain English. I thank him again for all his help especially answering my questions one day before he competes on stage. This report is in two separate parts. Part One will be a final assessment of the lawsuit and Part Two will cover the rest of the supplemental claims that’s been made on both sides. Before I begin, there are some people who think that I am going to give a bias report against Dr Connelly based on an issue I had with Progenex 3 years ago where they had slandered my business in order to take control of an internet bodybuilding contest, The Mr Getbig in 2007. However, I have placed on hold my personal grudge of Dr Connelly’s associates to preserve the integrity of my final report for my readers.
Complaint No 1. Using Progenex financial and human resources to launch a competing company.
Final Assessment: After researching this matter, I have come to the conclusion that this complaint does not appear to have any merit. Dr. Connelly has no secondary company in operation that is producing any nutritional supplement or protein food product whatsoever on the market or even in production.
Complaint 2: Falsifying his educational background and true qualifications as a scientist/formulator.
Final Assessment: This complaint also does not have any merit and there is no basis to it. Dr Connelly’s educational background is of public record and would have been available to every investor to know so there’s no reason to cite this matter as part of a lawsuit. In addition, while Dr Connelly’s degree is not in nutritional science, when you study for any medical degree, there are a broad range of courses that must be passed and completed in order to graduate in a number of different subjects including….well chemistry, biochemistry, pharmacutical research, even herbalism must be studied especially given Dr Connelly’s degree in anesthesiology. After all, Dr Connelly could not prep anyone going into surgery without knowing anything about drug interaction or what to give someone if they were taking a supplement that could affect how he reacts to being placed on any sedatives for surgery. Dr Connelly is more than qualified to formulate nutritional supplements based on his general education and career experience alone not even counting his involvement in Met Rx.
Complaint 3. Concealing numerous lawsuits against him filed by government agencies and past partners (all of which he either lost or settled).
Final Assessment: Lawsuits are of public record and information….end of story. There’s no way to conceal them
Complaint 4. Conspiring with a manufacturer and others to defraud investors
Final Assessment: This is the only thing that may have warrant for concern as I have found some indications that Dr Connelly or a representative may have contacted a manufacturer to possibly manufacture a product. However, this issue is a fringe accusation at best because there is no evidence that the product is a nutritional supplement. In addition, the likely evidence more or less leads to Dr Connelly’s Body Rx concept of selling food products such as pizzas, waffles, and pancakes and this isn’t something new. Dr Connelly attempted the same thing almost 20 years ago with Cafe Met-Rx which was not successful. Given that there have been a number of improvements and advancements in production in making healthier food….likely due to the growing rate of obesity in America causing many more people to seek out healthier alternatives, Dr Connelly is making another go at it. The emails sent to us clearly showed that Aaron Thomas had knowledge of this venture so if that’s the case, then there is no merit. However there has been subsequent reports made that some Crossfit Athletes have received samples of a protein bar given to them by Dr Connelly or a representative. While these claims have not been examined or substantiated, if it is true then Dr Connelly may have defrauded Progenex and its investors.
Conclusion:
There are a number of other claims that are being made by Progenex and the case is so complex that it is now in the hands of a business court. The claims that I have given an assessment are essentially some of the core complaints that I was able to obtain a general judgment upon based on the information at hand only. Ultimately it lies in the hands of the court systems now
