It Is The Judge That Should Be Jailed...

The story below is less about the attack by the pitbulls and more about the criminal justice system that would allow a judge to dismiss charges on this woman who expressed such idiotic behavior and actions that has destroyed this child's life forever. This especially in light of the fact that this woman (who by the way is NOT a young mother at 23 y.o.) had her other children taken away just a week earlier. If the other children were taken, then why was this one left in her custody?

RIVERSIDE, Calif. -- Charges have been dropped against a young mother whose baby son lost his testicles in a dog attack.

Carrie Rae McKinney was charged with felony child endangerment back in April after her 6-month-old son was mutilated by a friend's pit bull mix in Riverside County.

But at McKinney's preliminary hearing last Friday, Judge Dennis McConaghy dismissed the case, calling the attack a terrible accident.

"I don't see a crime here," he said.

According to court records, the 23-year-old San Diego woman was visiting a friend in Murrieta on April 3 when she left her son on the floor in a baby carrier near the dog.

She was in another room for about 10 minutes when she heard a scream and returned to find the child's groin area was injured and his diaper had been torn off, according to Deputy District Attorney Gerald Fineman.

The baby's testicles were severed in the attack, Fineman said.

The boy will need hormone therapy for life.

Animal control seized the dog, as well as another dog that may or may not have been involved in the attack.

Both dogs were euthanized.

Prosecutors say the attack was foreseeable because the dog had previously shown an interest in the baby's diaper.

The judge did not allow testimony from police about child protective services having removed McKinney's two older children from her custody within a week before the dog attack.

I think the argument can be made that instead of judging the situation, people make the mistake of judging the woman. The woman didn't intend for the dog to do that. The woman didn't train the dog to do that. The woman had no knowledge that the event would take place. If the dog didn't attack the baby, then would people still be saying the woman should be sent to jail (or whatever punishment they are calling for)? So people are judging her based on actions she couldnt control, which was the dog doing what it did.

Just an alternative point of view.

I'm of the opinion there was a bit of negligence involved, ...but that's just me.
I can't say she is responsible for the attack, ...but I can't help but to think leaving an infant alone with a dog, ...and a pitbull no less is not the wisest move one could make. Very Tragic.  :'(

I have 2 kids, one of which is 11 months old.

I feel very wary when I am with my kids and there is a dog around.

To leave a child alone with a dog is idiotic.

There is very much an argument that can be made... the woman should have gotten LIFE for this senseless act of idiocy. First thing that needs to be known is why the other children were removed from her home by CPS only days before this incident. Second, Does this person have psychological issues? Third, Where is the father of the child/children? Fourth, what person with an operating brain leaves a child on the floor next to a pitbull? All pitbulls are inbred to the point of being retarded (which is why they are so violent) and none can be trusted. Fifth, what was she doing in a home with someone else that you would leave a child alone in another room unattended? No woman/mother leaves a/her child alone...ESPECIALLY A SIX MONTH OLD. Was she in that home doing drugs with someone else while this was occurring? Was she in a sexual act with a cop or prominent figure and so to keep that figure out of this mess the charges were dismissed? This story stinks to high heaven

I dont know who you are, but so far I've agreed with everything i've read you type within the past week or two. Strange I've never noticed you before.

But in response to samson:
Yes I think there was negligence involved too. But ignoring all the other stuff (the other kids get taken away, the situation with the father, etc) and just focus on this one case (She left the baby in a room and a dog attacked the baby).  I'm just focusing on her leaving the baby on the floor and a dog attacked the baby. My point is that if the dog DIDNT attack the baby, if the woman had thought "oh crap i left the baby on the floor with the dog" and then came rushing back into the room and grabbed the baby. She would still be equally negligent, she still would have left the baby on the floor. But I don't suppose you would still say that she should be given life in prison for just leaving the baby on the floor when nothing happened to it? So what is the defining moment when you think that she deff deserves life in prison is the dog doing what it did, which she couldn't control. It was just 'bad luck" as thomas nagel would say lol
