Text messaging is hard to prove, you don't really know if it came from that person. If there are four people in a room, and one phone, and you are outside, and a text comes from that "room"...you can't prove who it came from...no probable cause for that charge... And, in most states harrassment is course of conduct in which the person has been told to stop...no probable cause if you can't pinpoint who the test came from... And, a attorney doesn't charge a person--- usually the DA or State's attorney prosecutes the case...a private attorney tries the cause...they don't really know too much about the probale cause to charge someone...
