Women aren't like men...they do it on the sly...for instance, she might say, "That's a nice shirt"...and she looking at a guy, who you notice has the square jaw model look, what that means is that she think's he's attractive.
Incriminating statements given while being detained and not under arrest can be challenged if you can argue successfully that the totality of the circumstances would lead a reasonable person to believe they are under arrest and not just detained. For example, if you are handcuffed, placed in a room surrounded by 14 cops, you may have a case. But just the mere fact of being handcuffed has never been successful in establishing arrest verses detention. It wouldn't rise to the level of suing the pants off of the cops, it would simply be a matter of evidence being obtained during the custodial encounter being inadmissable.
In Maryland they have to tell that they placing you under arrest...and if they do charge you, it must be in the Statement of Facts.
