It's the pits to break a tooth while eating. Just ask Rep. Dennis Kucinich.

The Ohio Democratic representative is suing House cafeteria service providers for $150,000 for allegedly selling him a sandwich wrap with a stray olive pit in it.

Kucinich, who ran for president in 2008, said in a Jan. 3 lawsuit filed in the Superior Court for the District of Columbia that the pit caused "serious and permanent" damage to his mouth and wellbeing.

He said he is entitled to recover damages, "including but not limited to past and future dental and medical expenses, compensation for pain, suffering and loss of enjoyment and other damage."

An initial scheduling conference is set for April. The four respondents named in the case are all food service providers for Capitol Hill. The offending sandwich was purchased at the Longworth House Office Building.

According to the lawsuit, a copy of which was obtained by courthousenews.com, Kucinich is filing civil charges on two counts of negligence and two counts of breach of implied warranty.
The suit claims the sandwich wrap in question was purchased "on or about April 17, 2008."

"Said sandwich wrap was unwholesome and unfit for human consumption in that it was represented to contain pitted olives, yet unknown to plaintiff contained an unpitted olive or olives which plaintiff did not reasonably expect to be in the food prepared for him, and could not visually detect prior to consumption," the lawsuit reads.

Kucinich, who as a member of Congress receives dental coverage among the health care insurance he is entitled to receive, alleged in the suit that as a result of his consumption of the unwholesome and unfit food, the plaintiff "sustained serious and permanent dental and oral injuries requiring multiple surgical and dental procedures, and has sustained other damages as well, including significant pain, suffering and loss of enjoyment."

Asked about the suit, which cost $120 to file in the D.C. Superior Court, Kucinich attorney Andrew Young told Fox News, "This is a private matter that needs to be tried in the courts and not in the public media."

Something similar happen to me..However, i paid the 1200 dollars to fix my front tooth myself. :'(

However, i had to walk around with a broken front tooth for about 36 hours before it was fixed.

Libs think its ok to sue government entities and corporations for as much money as possible because tax payer $ doesn't count and corporations print their own money. It's not like the costs trickle down to the consumer, or taxpayer or anything like that. ::)

The lawsuit had sought $150,000 in damages from companies involved with the Longworth House Office Building’s cafeteria. It was settled for an undisclosed amount.

Kucinich Requests Meeting With Manning

Rep. Dennis Kucinich, D-Ohio, is hoping for a face-to-face with Pfc. Bradley Manning, the soldier accused of leaking classified military documents that were later posted on whistleblower website Wikileaks.

Kucinich, who sits on the Committee on Oversight and Government Reform, sent a letter to Defense Secretary Robert Gates asking for a chance to meet with Manning at the Marine Corps Base in Quantico, Va. "As you know, I am concerned about reports of his treatment while in custody that describe alarming abuses of his constitutional rights and his physical health," Kucinich writes.

Kucinich cites a 2009 article as the basis for his concern over Manning's treatment while in custody. The article, written by surgeon Atul Gawande, states that "without sustained social interaction, the human brain may become as impaired as one that has incurred a traumatic injury."

Kucinich is urging Gates to coordinate the meeting so the congressman can assess Manning's current state of mind and whether he is mentally fit to stand trial.

The military has adamantly denied any mistreatment involving Manning. The prisoner remains in lockdown with no trial date set.

The Federal Election Commission has ordered Rep. Dennis Kucinich (D-Ohio) to repay more than $50,000 that that the agency says was improperly used for campaign expenses in 2004.

In a ruling issued Thursday, the FEC said Kucinich used $52,443 in public matching funds to pay for campaign expenses after he was no longer a candidate for president.

The Ohio Democrat was given 30 days to pay back the funds to the U.S. Treasury.

"The Commission reaches this conclusion because the Commission found that received an insufficient amount of private contributions after the candidate's 001 to pay for all of its continuing to campaign expenses. KFP, therefore, paid some of those expenses with matching funds," the FEC's decision reads.

Rep. Dennis Kucinich, D-Ohio, said earlier this week that President Barack Obama may have committed an impeachable offense in attacking Libya without first obtaining congressional approval. Sen. Mark Kirk, R-Ill., said Thursday that Kucinich has committed himself to irrelevance, The Hill reports.

Sen. Mark Kirk “I think Dennis Kucinich is one of the most irresponsible, fringe members of Congress, and hardly anyone in Congress listens to him,” Kirk said on Chicago radio station WLS 890.

Kucinich has criticized Obama for intervening in Libya without going to Congress for authorization first.

Kucinich, other liberal Democrats, and some conservative Republicans have said that Obama’s move to attack Libya without congressional consent is unconstitutional, as the Constitution gives Congress the power to declare war.

WikiLeaks suspect Manning to be moved to Fort Leavenworth

Washington (CNN) -- U.S. Army Pfc. Bradley Manning, suspected of leaking classified information to the WikiLeaks website, is being moved to the Joint Regional Correctional Facility at Fort Leavenworth, Kansas, defense officials said Tuesday.

"At this juncture of the case, given the likely continued period of pre-trial confinement, we have determined that the new pre-trial facility at Fort Leavenworth is the most appropriate one for Private Manning going forward," Defense Department General Counsel Jeh Johnson told reporters.

A defense official initially told CNN Manning was moving to the U.S. Disciplinary Barracks at Fort Leavenworth, but later corrected that information.

Manning, 23, a military intelligence analyst from Oklahoma, was being held in the brig at Quantico Marine Base south of Washington. There had been a push by friends and supporters to have his confinement conditions eased. Supporters said he was confined in a one-man cell with only one hour a day outside of the cell for exercise.

Defense officials said at a briefing that an evaluation aimed at determining whether Manning is competent has been completed, and there was no need for him to remain in the Washington area.

Among those arrested at a demonstration protesting Manning's conditions last month were Daniel Ellsberg, the 1971 Pentagon Papers leaker and Retired U.S. Army Col. Ann Wright.

Johnson told reporters that the decision to move Manning is not meant as a criticism of the Quantico facility and congratulated the military personnel there for the job they did "in difficult circumstances."

"We remain satisfied that Private Manning's pre-trial confinement at Quantico was in compliance with legal and regulatory standards in all respects," he said.

Manning's case -- and the details of his detention -- drew attention last month in the aftermath of comments by former State Department spokesman P.J. Crowley and Crowley's sudden resignation.

Amidst reports that Manning had been forced to sleep without clothing and was confined to his cell 23 hours a day, Crowley had criticized how Manning was held at Quantico, calling it "ridiculous and counterproductive and stupid," according to news reports. He later stepped down from his post.

The Pentagon has maintained that Manning is held in accordance with rules governing all maximum-custody detainees at Quantico, for his protection and the safety of others, and that Manning is on "POI" status, for "prevention of injury."

Rep. Dennis Kucinich, D-Ohio, released a statement Tuesday after news of Manning's pending transfer broke, promising to demand written assurances from Defense Department officials that Manning's rights will be protected.

"Any move of Pfc. Manning does not change the underlying fact, which has not been disputed by the Department of Defense, that he has been held under conditions which may in fact constitute 'cruel and unusual punishment' in violation of the 8th amendment," he wrote.

U.S. military officials have told CNN that Manning is the prime suspect in the leak of hundreds of thousands of classified documents that ended up on the WikiLeaks website. He is awaiting a decision on whether he will face a court martial.

Last month, the Army notified Manning that he faces 22 more charges in connection with the alleged downloading of secret information from computers in Iraq, bringing to 34 the total charges in the case. The most serious new charge alleges he aided the enemy by making the information public; that charge is punishable by death.

A statement from the Army said the prosecution team "has notified the defense that the prosecution will not recommend the death penalty," but technically it is up to the commander overseeing the case to make the final decision.

How the mighty have fallen. In 2008 Rep. Dennis Kucinich, D-Ohio, was running for president on an anti-Iraq war platform that drew him substantial attention if not votes. Now he’s considering moving to another state to save his seat in Congress, Politico reports.

Ohio is losing two House of Representatives seats starting next year thanks to the latest census, and Kucinich may be redistricted out of his home base in Cleveland.

Kucinich wrote in an email to supporters that he’s been approached by backers from “Washington to Maine.”

Washington is adding a House seat in next year’s elections.

Earlier this month, he spoke to a standing-room-only crowd of almost 800 in Washington. Kucinich said he’s received numerous speaking invitations from labor, environmental, and other political groups.
