The fact that the story(I believe) mentions nothing about the thieves criminal records leads me to believe that the punks most likely do have one. And that the guy who wrote the story left out that fact so that public opinion wouldn't be favored one way or the other.

Really don't know where they are getting that the guy killed the kid.  It's one thing if he choked him out till he died, but given the fact that he didn't die on the spot it seems pretty clear that he just chocked him our until he passed out and maybe a little longer to be sure. 

I cannot, in good conscience, say that a man should be prosecuted for protecting himself against two other men and getting the better of them.

He ran out and attacked the owner of the car, intending to cause injury or even kill him.  If Montalvo wasn't strong enough, he would of been beaten or killed.  However, Montalvo defended himself against an attacker.  Self defense. Period. 

Can't argue that he tried too hard to defend himself.  Get real.
